of 9 September 2009

amending Act No. 72 / 1994 Coll., adjusting certain co-ownership relations with buildings and certain ownership relations with apartments and non-residential premises and supplementing certain laws (Law on Housing), as amended, and Act No. 183 / 2006 Coll., on Urban Planning and Construction Regulations (Construction Act), as amended

Parliament has decided on this law of the Czech Republic:

Amendment of construction law

Čl. III

Act No. 183 / 2006 Coll., on Territorial Planning and Construction Regulations (Construction Act), as amended by Act No. 68 / 2007 Coll., Act No. 191 / 2008 Coll., Act No. 223 / 2009 Coll., Act No. 227 / 2009 Coll. and Act No. 281 / 2009 Coll., is amended as follows:

1. In Paragraph 110 (2), the words "if it is a builder of the community of owners of units, the contract for the construction or decision of the assembly of owners of units adopted under a special law 'shall be added at the end of the text of point (a).

2. In Paragraph 110, the following paragraph 6 is added:

"(6) The construction plant of underground buildings subject to this Act shall not be obliged to demonstrate a property or other right to land or construction on it, if it is a building which is not related, functionally or by its construction, to the construction on or operation on the land and which cannot otherwise affect the use of the land for the purpose for which it is intended. '
