amending Act No. 61 / 1996 Coll., on certain measures against the legalisation of proceeds from crime and amending and supplementing related laws, as amended, Act No. 358 / 1992 Coll., on notaries and their activities (notarial order), as amended, and Act No. 284 / 2004 Coll., amending Act No. 61 / 1996 Coll., on certain measures against the legalisation of proceeds from crime and amending and supplementing related laws, as amended, and certain other laws
Parliament has decided on this law of the Czech Republic:
Change of notarial order
Act No. 358 / 1992 Coll., on notaries and their activities (notarial order), as amended by Act No. 82 / 1998 Coll., Act No. 30 / 2000 Coll., Act No. 370 / 2000 Coll., Act No. 120 / 2001 Coll., Act No. 317 / 2001 Coll., Act No. 352 / 2001 Coll., Act No. 501 / 2001 Coll., Act No. 6 / 2002 Coll., Act No. 18 / 2004 Coll., Act No. 239 / 2004 Coll., Act No. 284 / 2004 Coll., Act No. 554 / 2004 Coll., Act No. 88 / 2003 Coll.
1. In the second sentence of Article 7 (2), the words "Minister of Justice of the Czech Republic (hereinafter referred to as" Minister '), on a proposal from the Notary Chamber (hereinafter referred to as "Chamber'), may be replaced by" Do ', the words "count' shall be replaced by" count 'and the words "Supreme Administrative Court' shall be inserted after the words" Supreme Court ';
2. In the second sentence of Article 7 (3), the words "The Minister may recognise the Chamber on a proposal 'are replaced by the words" The person who passed the notarial examination shall also be considered as the person who passed it'.
3. In Paragraph 8 (1), the word "Chamber 'is replaced by" Notary Chamber of the Czech Republic ("Chamber') '.
4. In Paragraph 56 (6), the words "to the relevant organisational component of the Ministry of Finance 'are deleted.
5. In Paragraph 57, the present text becomes paragraph 1 and the following paragraphs 2 and 3 are added:
"(2) The notary shall be relieved of the liability referred to in paragraph 1 if he can prove that he could not prevent the damage even if all the efforts he may have made were made.
(3) The State's liability for damage under special legislation (4b) is without prejudice to this.
(b) Article 4 of Act No. 82 / 1998 Coll., on liability for damage caused in the exercise of public authority by decision or by maladministration, as amended. '
Amendment to Act No. 284 / 2004 Coll.
In Part First Article II of Act No. 284 / 2004 Coll., amending Act No. 61 / 1996 Coll., on certain measures against the legalisation of proceeds from crime and amending and supplementing related laws, as amended, and certain other laws, point 3, including footnote 22, is deleted.
EFFECTIVE
This Act shall take effect on the 30th day following its publication.
