Ministry of Industry and Trade
of 11 July 2002
amending Decree No. 262 / 2000 Coll., which ensures uniformity and correctness of meters and measurements
The Ministry of Industry and Trade provides pursuant to § 27 of Act No. 505 / 1990 Coll., on Metrology, as amended by Act No. 119 / 2000 Coll. and Act No. 137 / 2002 Coll., (hereinafter referred to as "the Act") for the implementation of § 6 paragraphs 2, 3 and 9, § 8 paragraphs 2 and 5, § 9 paragraphs 1 and 2, § 9a paragraphs 2 to 4, § 16, § 19 to 21 of the Act:
Čl. I
Decree No. 262 / 2000 Coll., which ensures the uniformity and correctness of measuring instruments and measurements, is amended as follows:
1. In Paragraph 3 (3), the word "Graphic 'is deleted and the word" form' is replaced by the word "form '.
2. In Section 4 of the text in brackets under the heading, the figure "5, 6 'and the word" a' are deleted.
3. in Article 4 (b), the words "the type of which has been approved 'are replaced by the words" the approved type concerned';
4. Paragraph 6 (2) reads as follows:
"(2) The official mark shall be the symbol of the two-tail lion, supplemented by the letters" CM 'assigned to the Institute, or the letters "K' or" CZK 'allocated to authorised metrological centres. The legal importance of these official marks is equivalent. The official marks shall also be accompanied by the registration number, the letter mark or the additional mark of the certifying workshop assigned by the Technical Standardisation, Metrology and State Testing Office (hereinafter referred to as the Office). For specified meters subject to subsequent verification, the official mark shall be supplemented by the last two digits of the year in which the verification was carried out.';
5. In Article 6, the following sentence is added at the end of paragraph 5: "Where, for technical reasons, the reduced legibility of the official mark referred to in paragraph 2 is imminent, the Office shall adapt it to another form. '.
6. In Article 7, the following sentences are added at the end of paragraph 1: "For specified meters and certified reference materials for which a certificate or certificate is issued, the period of validity shall be calculated from the date of issue of the certificate or certificate. ';
7. In Article 7, at the end of paragraph 2, the dot is replaced by a comma and the following point (f) is added:
"(f) even in the case of intact verification, the place of use of the specified measuring instrument shall be changed where the type-approval certificate of the measuring instrument so provides.";
8. In Article 9, at the end of paragraph 2, the dot is replaced by a comma and the following points (d) and (e) are added:
"(d) has no financial or other interests which could affect the results of the metrological activity which is the subject of authorisation; in the case of authorisation for subsequent verification of specified measuring instruments verified at the site of use and intended at the same time to determine quantities for direct sale to the public, the authorised body shall not be the user, manufacturer, repairer, importer or distributor of such measuring instruments; and
(e) demonstrate metrological, technical and personnel competence to verify specified meters by submitting to that effect statutory certificates or accreditation certificates. ';
9. In the first sentence of Article 9 (3), the words "authorisation document 'are replaced by the words" authorisation decision'.
10. in Article 10 (1) (d), the word "tasks" is replaced by the word "acts."
11. In Paragraph 11, the following sentence is added at the end of paragraph 2: "The fulfilment of these conditions shall be considered as the reason for the marketing authorisation. '.
12. in Paragraph 13 (1) (b):
"(b) the field (s) of measurement, including measuring ranges and uncertainties of measurement achieved, to be authorised to carry out official measurements;"
13. in Paragraph 13 (1), the following shall be deleted at the end of point (e) and the following words shall be added: "or the certificate of professional competence of an official meter issued by the Office,"
14. in Article 13 (1) (f):
"(f) a statutory certificate of technical and metrological competence,"
Points (f) and (g) shall be renumbered as points (g) and (h).
15. in the first sentence of Article 13 (2), the words "authorisation instrument" shall be replaced by the words "authorisation decision."
16. in Article 13 (3) (b), the words "or its availability is contractually ensured" shall be inserted after the word "measurement."
17. in Paragraph 13 (3) (c), the words "have been drawn up" shall be replaced by the words "document."
18. in Paragraph 13 (3) (d), the word "staff" shall be deleted;
19. in Article 13 (3), the following point (d) is inserted after point (c):
"(d) documentary evidence of technical and metrological competence to carry out official measurements;"
Point (d) shall be renumbered as point (e).
20. In Article 13, the following paragraph 4 is added:
"(4) The particulars of the document of official measurement and the graphic form of the stamp of the body authorised for official measurement are set out in Annex 9."
21. In Annex 1, item 142, the word "water meters' is replaced by the words" measuring instruments for the flow of water '.
22. In Annex 1, item 143, the word "gas meters' is replaced by" gas gauge '.
23. In Annex 1, "hydrometry 'is replaced by" hygrometry'.

25. Annex 8, including the title, reads:

"Annex No 8 to Decree No. 262 / 2000 Coll.

26. The following Annex 9 is added:

"Annex 9 to Decree No. 262 / 2000 Coll.
Forms of the official measurement document and the graphic form of the stamp of the body authorised for official measurement
The document of official measurement shall be a public instrument and shall contain the following particulars:
1. Header containing the name and registered office of the authorised entity with the following text:
Body authorised to carry out official measurements by decision of UNMZ No j.
of the day.
2. Title Document of official measurement No. /. (year).
3. Orderer of official measurement and No j (mark) of the application or contract.
4. Subject of measurement.
5. Description and identification of the subject of the measurement.
6. Date of measurement.
7. Influential circumstances or conditions of measurement.
8. Measurements or measuring instruments used for official measurements (type, type, range, metrological continuity).
9. The measurement method used.
10. Measurement results.
11. Other necessary measurement data (e.g. sampling).
12. Place and date of issue of the document of official measurement.
13. Name and signature of the official meter.
14. Printing of the stamp of the body authorised for official measurement.
For official weight measurements (official weighing), the document shall be adjusted accordingly. The Authority may also approve, in specific cases, the addition of the certificate of the necessary points.

Čl. II
This Decree shall take effect on 1 September 2002.
