DECLARATION
of 4 November 2024
amending Decree No. 164 / 2002 Coll., on the conditions for access to information in the Czech National Bank Information Database - Central Credit Register, as amended by Decree No. 292 / 2010 Coll., and repealing Decree No. 273 / 2014 Coll., on the compilation and submission of information for the Czech National Bank Information Database - Central Credit Register by banks and branches of foreign banks
The Czech National Bank provides pursuant to § 38a (4) of Act No. 21 / 1992 Coll., on Banks, as amended by Act No. 126 / 2002 Coll. and Act No. 285 / 2009 Coll., and pursuant to § 41 (3) of Act No. 6 / 1993 Coll., on the Czech National Bank, as amended by Act No. 227 / 2013 Coll.:
Decree No. 164 / 2002 Coll., on the conditions for access to information in the information database of the Czech National Bank - Central Credit Register, as amended by Decree No. 292 / 2010 Coll., is amended as follows:
1. footnotes 1 to 3 are deleted, including the footnotes.
2. In Article 3, at the end of paragraph 2, the dot is replaced by a comma and the following point (d) is added:
"(d) persons on whom the information is registered for the purpose of implementing certain measures against the legalisation of proceeds from crime and terrorist financing or fraud or for the purpose of implementing international sanctions.";
3. Paragraph 3 (6) reads as follows:
"(6) The registry user shall designate at least two persons in charge of managing the access rights to the registry and ensuring substantive and technical communication with the Czech National Bank.
4. In Article 3, the following paragraph 7 is inserted after paragraph 6:
"(7) The registry user shall inform the Czech National Bank without undue delay of the designation of persons pursuant to paragraph 6 or of changes to their contact details."
Paragraphs 7 and 8 shall be renumbered paragraphs 8 and 9.
Repeal
Decree No. 273 / 2014 Coll., on the compilation and submission of information for the information database of the Czech National Bank - Central loan register by banks and branches of foreign banks, is repealed.
Efficacy
This Decree shall take effect on 1 January 2025.
