DECLARATION
of 19 December 2014
on vehicle registration
The Ministry of Transport provides, pursuant to § 91 (2) of Act No. 56 / 2001 Coll., on the conditions for the operation of vehicles on the road and on the amendment of Act No. 168 / 1999 Coll., on liability insurance for damage caused by the operation of a vehicle and on the amendment of certain related laws (Act No. 170 / 2007 Coll., Act No. 297 / 1999 Coll., Act No. 103 / 2004 Coll., Act No. 411 / 2005 Coll., § 7e § 3, § 14 (3), § 5 (8), § 6 (7), § 7 (6), § 7a § 7a § 3, § 7b § 7d § 3, § 7e § 4, § 4 (6), § 5 (6), § 6), § 7 § 7 § 7b § 3, § 7b § 3, § 7d § 3, § 7e § 6, § 6), § 4, § 4, § 6 § 6 § 4 § 4 § 4, § 6 § 4 § 4 § 4 § 4 § 6 § 6 § 6 § 6 § 6 § 6 § 6 § 7, § 7, § 7, § 7 § 7 §
INTRODUCTORY PROVISIONS
Subject matter
This decree implements the relevant provisions of the European Union1), following the directly applicable regulations of the European Union2) and provides for
(a) the way in which the register of road vehicles is maintained;
(b) the manner in which data are entered in the register of road vehicles and their scope and content;
(c) models of the forms used for keeping the register of road vehicles;
(d) the particulars entered in the road vehicle documents and the manner in which they are entered; and
(e) registration marks, their form, content and methods of placing on the road vehicle and the special vehicle.
LEADING THE REGISTER OF STRONG VEHICLES, METHOD AND FORM OF THE DATA REGISTER TO THE REGISTER OF STRONG VEHICLES AND SAMPLES
Management of the road vehicle register
(K § 5 (9) of the Act)
(1) The register of road vehicles is kept electronically.
(2) The correctness of the data entered in the register of road vehicles by manual inscription shall be verified according to the data provided by:
(a) the application for registration or the annexes thereto;
(b) the identity document of the applicant, if his identity is verified when the application is lodged; and
(c) in the Schengen Information System, the Police of the Czech Republic information system or in the register of the competent authority of another Member State of the European Union, in the case of data relating to a road vehicle, its registration documents or registration mark.
(3) When entering the registration mark data of a road vehicle, it shall be verified that the same registration mark is not registered to another road vehicle; in that case, registration may not take place.
Entry of data in the register of road vehicles and road vehicles of members of the diplomatic mission
(K § 5 (9) of the Act)
(1) Data shall be entered in the registration of road vehicles, owners and operators of such vehicles and in the registration of road vehicles of members of the diplomatic mission of the road register in the form of words, figures, alphanumeric codes and scanned copies of documents.
(2) The entry of data in the registration of road vehicles, owners and operators of such vehicles and the registration of road vehicles by members of the diplomatic mission of the road register shall be carried out:
(a) the entry of data provided from the population base register, the basic register of legal persons, commercial natural persons and public authorities, the population's agendas and the alien's agendas in respect of the owner and the road vehicle operator;
(b) the entry of data provided from the register under the End-of-Life Act in the case of road vehicle extinction data;
(c) the input of data provided from the technical inspection station information system in the case of data relating to roadworthiness and roadworthiness checks;
(d) the entry of data from the Schengen Information System or the Information System of the Police of the Czech Republic, in the case of missing or stolen road vehicle data;
(e) by manual typing of data when data are not kept in the information systems referred to in points (a) to (d);
(f) insert a scanned copy of the document
1. the certificate of technical competence of the vehicle;
2. the technical inspection report, if no longer available electronically in the register of road vehicles,
3. documentation containing data to the extent necessary for the registration of the vehicle in the register of road vehicles;
4. documentation to record changes in vehicle technical data;
5. notification of the location and purpose of the storage of the discarded vehicle;
6. a vehicle technical licence which has been surrendered or withdrawn.
(3) The accuracy of data entered in the register of road vehicles by entering data provided from other information systems referred to in paragraph 2 (a) to (d) shall not be verified.
(4) Where data are held in the information systems referred to in points (a) and (c) of paragraph 2 which are not provided at the time of the registration, such data shall be entered by hand. Manually written data shall be replaced by the input of data from the relevant information system as soon as such data are provided.
Registration of registration certificates, technical licences and registration plate tables
(K § 5 (9) of the Act)
(1) Data shall be entered in the register of lost, stolen, damaged and destroyed road vehicle registration certificates, road vehicle technical licences and road vehicle registration plate plates in the form of words, figures and alphanumeric codes.
(2) The entry of the data in the register of lost, stolen, damaged and destroyed road vehicle registration certificates, road vehicle technical licences and tables bearing the registered road vehicle register registration mark shall be carried out by manual data entry.
Entry of data in the register of special registration marks
(K § 5 (9) of the Act)
(1) Data shall be entered in the register of assigned special registration marks and lost, stolen, damaged and destroyed tables with assigned special registration mark of the road register in the form of words, figures and alphanumeric codes.
(2) The entry of data in the register of assigned special registration marks and lost, stolen, damaged and destroyed tables with assigned special registration mark of the road vehicle register shall be carried out by manual entry of data.
Entry of data in the register of produced forms and tables
(K § 5 (9) of the Act)
(1) Data shall be entered in the register of forms of road registration certificates bearing the identification marks and the manufactured and unpublished plates of the vehicle registration plate of the road register in the form of words, digits and alphanumeric codes.
(2) The entry of data in the register of manufactured forms of road registration certificates bearing identification marks and the produced and unpublished plates of the vehicle registration plate of the road vehicle register shall be carried out by manual entry of data.
Model applications
(Articles 5 (9), 6 (7), 9 (4), 12 (9) and 13 (7) of the Law)
(1) The model of the application for data from the road vehicle register is set out in Annex 1 to this Regulation.
(2) The model of the application for registration of a road vehicle in the register of road vehicles is set out in Annex 2 to this Decree.
(3) The model of the application for registration of the change of owner or road vehicle operator is set out in Annex 3 to this decree.
(4) The model of the application for the decommissioning of a road vehicle, the cessation of the decommissioning of a road vehicle and the registration of the demise of a road vehicle is set out in Annex 28 to this Decree.
SCOPE AND CONTENTS OF THE DATA PROVIDED FOR IN THE REGISTER OF STRONG VEHICLES
Data relating to the withdrawal of a road registration certificate issued by another Member State
(K § 4 (7) of the Act)
The data relating to the withdrawal of registration certificates issued by another Member State shall be:
(a) the designation of the Member State;
(b) the date of withdrawal of the document; and
(c) the reason for the withdrawal of the document.
Data on the decommissioning of a road vehicle, the demise of a road vehicle and the export of a road vehicle to another State
(K § 4 (7) of the Act)
(1) Data on the decommissioning of a road vehicle are:
(a) the date on which the road vehicle was taken out;
(b) the registration number,
(c) the legal reason for the exclusion of a road vehicle;
(d) details of the submitted certificate of registration of a road vehicle,
(e) the number of registration plates surrendered;
(f) data on the purpose of the use of the road vehicle and location of the disembarked road vehicle, if the road vehicle is discarded for more than 12 consecutive calendar months; and
(g) an indication of the maintenance of the registration mark, the plates bearing this registration mark and the vehicle registration certificate if the road vehicle has been disabled for more than 3 consecutive years.
(2) Data on the demise of a road vehicle are:
(a) the date of registration of the demise of the road vehicle;
(b) the registration number,
(c) the legal reason for the disappearance of the vehicle;
(d) details of the submitted certificate of registration of a road vehicle,
(e) the number of registration plates surrendered; and
(f) an indication provided from the register under the end-of-life product law.
(3) The data relating to the export of a road vehicle to another State are:
(a) the date on which the export registration plate table was allocated;
(b) the export registration number;
(c) the owner of the road vehicle requested the period of validity of the export registration mark;
(d) by the owner of the road vehicle, the information communicated concerning the person who will use the vehicle during the period of validity of the export registration plate, which is:
1. name and surname, date of birth, address of residence, state, or
2. the company or name, identification number, registered office, State; and
(e) details of the newly issued road vehicle document.
(4) Where data are recorded on the basis of a notification by another Member State of the registration of a road vehicle in that State, the data on the export of a road vehicle shall also include data on the new registration of a road vehicle, which shall be:
(a) State of new registration of a road vehicle;
(b) the date of the new registration of the road vehicle;
(c) the number of the new registration document; and
(d) an alphanumeric combination of a new registration mark.
Purpose of identification of road vehicle
(K § 4 (7) of the Act)
Indication of the purpose for which the road vehicle is intended
(a) a taxi service vehicle;
(b) a vehicle with a right of priority in driving;
(c) a car rental vehicle for hire,
(d) a vehicle for general use;
(e) a vehicle intended to operate road transport for hire or reward by its operator; or
(f) a vehicle intended to operate public regular services.
Type, category of road vehicle and road vehicle designation
(K § 4 (7) of the Act)
(1) The indication of the type of road vehicle is:
(a) motorcycle,
(b) a passenger car,
(c) bus,
(d) a truck;
(e) special purpose vehicle,
(f) trailer,
(g) a motor-powered wheelchair, if its width or length exceeds 1,4 m, its design speed exceeds 15 km.h-1 or its maximum permissible mass exceeds 450 kg; or
(h) other road vehicle.
(2) The indication of the road vehicle category is L, M, N, O, Z.
(3) The road vehicle marking data are:
(a) the factory mark established by the road vehicle manufacturer;
(b) trade marks, where provided by the manufacturer of the road vehicle,
(c) the type established by the road vehicle manufacturer; and
(d) variant and version if the manufacturer of the road vehicle is defined.
Additional road vehicle data
(K § 4 (7) of the Act)
(1) The data on the road vehicle engine are:
(a) the type of engine specified by the road vehicle manufacturer;
(b) engine power determined by the road vehicle manufacturer
1. in kW / rated speed in min-1 in the case of an internal combustion engine; or
2. in kW for other engines,
(c) the displacement volume of the combustion engine as determined by the road vehicle manufacturer in cm3; and
(d) fuel according to the code list set out in Annex 4 to this Decree.
(2) The information on the type of bodywork is given in Annex 5 to this Regulation and the colour of the bodywork is given in Annex 6 to this Regulation.
(3) Data on the number of seating and standing positions and, where applicable, beds, loading area dimensions in mm, case volume in cm3 or tank in cm3 are recorded within the scope of the road vehicle design parameters indicated in the roadworthiness document.
(4) Data on the total dimensions of the road vehicle in mm are recorded within the scope of the road vehicle design parameters indicated in the roadworthiness document.
(5) Data on technically permissible masses of a road vehicle in kg are recorded to the extent specified by the design parameters of the road vehicle indicated in the roadworthiness document. Data relating to the authorised mass of a road vehicle in kg shall be recorded to the extent specified by other legislation governing the authorised mass of a road vehicle.
(6) The information on the type of coupling device is given in Annex 7 to this Regulation.
(7) Data on the level of emission performance are:
(a) a reference to the number of the European Union legislation or a reference to the number of decisions taken under an international agreement in the field of the approval of the technical competence of a road vehicle to which the Czech Republic is bound; and
(b) EURO emission standard.
Data on roadside inspection and technical competence
(K § 4 (7) of the Act)
(1) Data on roadworthiness tests are:
(a) the type of technical inspection carried out;
(b) the date of the technical inspection;
(c) the date of validity of the technical inspection;
(d) the identification of the technical inspection station; and
(e) information on the state of the road vehicle according to the result of the technical inspection.
(2) The technical suitability data of a road vehicle found on the road are:
(a) the type of technical control of the state of the vehicle which is:
1. technical roadside inspection; or
2. checking of the technical condition of the vehicle or combination in the event of an accident;
(b) the date of technical inspection of the vehicle's condition; and
(c) the state of the vehicle as determined by the result of the check.
Data on the approval of the technical competence of a road vehicle and data on the approval of the conversion of a road vehicle
(K § 4 (7) of the Act)
(1) Data on the approval of the technical competence of a road vehicle are:
(a) the number and date of approval of the technical competence of a road vehicle and the indication of the municipal authority of the municipality with extended scope, if it is for the approval of the technical competence of a individually imported or manufactured road vehicle;
(b) the approval number of a road vehicle issued by another Member State;
(c) the type-approval number of a road vehicle issued by another Member State;
(d) the number of the certificate of approval of a road vehicle type; or
(e) the number of the certificate of registration of a road vehicle issued by another Member State, unless it is possible to indicate in the register of road vehicles the particulars referred to in points (a) to (d).
(2) The data relating to the approval of the conversion of a road vehicle are:
(a) the date of approval of the conversion of a road vehicle;
(b) an indication of the municipal authority of the municipality with extended scope which approved the rebuilding of the road vehicle;
(c) the approval number of the rebuilding of the road vehicle; and
(d) the location and the means of indicating the vehicle identification number (hereinafter referred to as "VIN") when attending the road vehicle conversion to change the VIN on the road vehicle.
(3) The data concerning the approval of a mass conversion of a road vehicle type are:
(a) the date of approval of the mass conversion of a road vehicle type; and
(b) the approval number of a mass conversion of a road vehicle type.
Details of data entered in the register of road vehicles
(K § 5 (9) of the Act)
Details of the data entered in the register of road vehicles are given in Annex 8 to this decree.
DOCUMENTS ON THE STRONG VEHICLE
Means of recording the data in the new registration certificate of a road vehicle and its scope
(K § 7f (3) of the Act)
(1) Data shall be entered in the registration certificate of a road vehicle within the scope of Annex 12 to this Regulation.
(2) The entry in the registration certificate of a road vehicle shall be carried out by a computer printer of the register of road vehicles and certified by the stamp, signature of the authorised person and shall be dated.
