DECLARATION
of 25 September 2009
amending Decree No. 410 / 2005 Coll., laying down health requirements for premises and facilities for the education and training of children and adolescents
The Ministry of Health, in agreement with the Ministry of Education, Youth and Sports and the Ministry of Labour and Social Affairs, provides, pursuant to § 108 (2) of Act No. 258 / 2000 Coll., on the Protection of Public Health and on the amendment of certain related laws, as amended by Act No. 274 / 2003 Coll., Act No. 392 / 2005 Coll. and Act No. 110 / 2007 Coll., for the implementation of § 7 (1) of the Act:
Čl. I
Decree No. 410 / 2005 Coll., on sanitary requirements for premises and the operation of facilities and facilities for the education and training of children and adolescents, is amended as follows:
1. In the first sentence of Article 1 (1), the words "with the exception of establishments for the further education of teaching staff, school guidance and school meals' shall be inserted after the words" the register of schools and school establishments';
2. Paragraph 1 (2), including footnote 4, reads as follows:
"(2) The requirements for the workplace for the practical teaching of secondary school pupils, which takes place in schools and school establishments and in the workplaces of natural or legal persons who are authorised to work in the field of education and have concluded a contract with the school on the content, scope and conditions of practical teaching, are laid down in a separate legislation4).
4) Government Regulation No. 361 / 2007 Coll., laying down conditions for health protection at work. '
3. In Article 2 (j), the words "or standard requirement 'are inserted after the word" value'.
4.Paragraph 3, including footnotes 4a and 5, reads as follows:
„§ 3
(1) The unbuilt area of the parcel for education and training establishments and establishments for education and training intended for the residence and games of pre-school children, including grassland, must be at least 4 m2 per child. In facilities for children requiring immediate assistance and in educational establishments for the performance of constitutional or protective education, the unbuilt area of the land for residence and games of children shall be at least 4 m2 per child, regardless of the age of children. The land must be fenced to protect the health and safety of children.
(2) The land of the establishment for education and training and training establishments providing basic education must have a fixed area and a grassy area for the stay of pupils, as well as an area for gym and sport; the surface of this surface shall comply with the standard requirements of the Czech technical standard governing the quality and safety of the surface (4a). Land must be fenced for health and safety reasons.
(3) The land of the establishment for the education and education and establishment for the education and training providing medium-term education must have an area for the physical and sports sector and the surface area must comply with the standard requirements of the Czech technical standard governing the quality and safety of the surface (4a).
(4) The selection of plants and timber planted on land for education and training facilities and establishments for education and training must take into account the protection of the health of children and pupils. The wood must not cause the parameters of daylight in the teaching and living rooms below the required limit (12) to be reduced. The distance of the planted wood from the perimeter wall of the buildings shall be the same as the expected maximum height. Plants, grasses and trees planted must be properly maintained. Water of at least Class I shall be used for maintenance according to the Czech technical standard governing the quality of the water for irrigation 5).

5. Paragraph 4 (1) reads as follows:
"(1) The conditions and internal arrangements of the facilities for the education and training and training of children of pre-school age must be such as to enable the teaching, the free play of children, their rest, personal hygiene, physical exercise and catering, unless this is ensured in another catering establishment. For 1 child, the area of the daily room used as a playroom and bedroom shall be at least 4 m2; if the bedroom, dining room or gym is separated, the area of the day room shall be at least 3 m2 per child. The area per sleeping cot or bed shall be at least 1,7 m2 per child. The cot or bed shall provide a fixed back support. The space for storing couches and bedding shall allow for proper ventilation and separate storage of bedding for each child. Each child must have individually assigned, marked bedding. '
6. In Paragraph 4 (2), the third sentence is deleted and in the fourth sentence the word "specific 'is replaced by" special'.
7. In the first sentence of Article 4 (3), the words "schools and school establishments', the words" including barrier-free environments 7) 'and footnote 7, including footnote references, are deleted.
8. Paragraph 4 (4), including footnote 8, reads as follows:
"(4) Floors in education and training establishments and establishments for education and training must correspond to the nature of the activity covered by the specific legislation on technical requirements for construction (8) and must be easy to clean. The floor coverings must be matt and bright in the teaching rooms.

9. The following Sections 4a and 4b are inserted after Section 4, including footnote 9a:
„§ 4a
(1) The establishment for education and training must be equipped with cloakrooms in accordance with the requirements laid down in specific legislation8). A floor area of 0,25 m2 must be provided for one pupil. The number and equipment requirements for sanitary facilities are laid down in Annex 1 to this Decree. The toilets and washrooms shall be set up separately by sex and shall be illuminated and ventilated. The ventilation requirements are set out in Annex 3 to this Decree.
(2) In education and training establishments, illuminated and ventilated dressing rooms must be established for pupils. A floor area of 0,25 m2 must be provided for one pupil. The number and equipment requirements for sanitary facilities are laid down in Annex 1 to this Decree. The toilets and washrooms shall be set up separately by sex and shall be illuminated and ventilated. The ventilation requirements are set out in Annex 3 to this Decree.
(3) In establishments for education and training and in establishments for the education and education of children of pre-school age, toilets and washrooms shall be accessible from the dressing room and the children's room, shall not be divided by sex and shall be illuminated and ventilated. The number and equipment requirements for sanitary facilities are laid down in Annex 1 to this Decree. The ventilation requirements are set out in Annex 3 to this Decree.
(4) At least one wash basin with a cold drinking water supply must be located in the educational premises of the establishments for education and education. If hot water is introduced, then in the case of effluents within the range of pupils, the temperature shall not exceed 45 ° C.
(5) There must also be a sink with a supply of drinking cold and hot water in the teaching rooms of education and training facilities.
§ 4b
The standard values according to the relevant Czech technical standard governing optimal reverbers9a) must be observed in education and training establishments and establishments.

„§ 5
(1) The areas for teaching physical education and gyms in education and training establishments and establishments for education and training must be such as to enable physical education to be carried out by building and technical conditions. These spaces shall be ventilated; the ventilation requirements are laid down in Annex 3 to this Decree. Control of ventilation holes shall be accessible from the floor. The floor shall be flexible at static and dynamic loads, easy to clean, with anti-slip surface treatment (8). Walls and heating bodies shall be secured in such a way that the health of children and pupils, lamps and window panes shall be protected against breaking. Other requirements for gyms in education and training establishments are governed by specific legislation on technical requirements for construction (8).
(2) In the case of a gym, a dressing room, a washroom and a bathroom with a hall and sink must be set up, separated for boys and girls, where necessary, a toolroom. The dressing rooms shall be equipped with hangers and benches; calculate 0.4 m bench length per pupil. The washroom shall be accessible from the dressing room, allowing the disposal of washing supplies, towels and linen; for up to 8 pupils, 1 shower rose must be installed.
§ 6
When teaching work education in primary schools, if the premises are not part of the school, there must be room for pupils to put down their civilian clothes and wash their hands and a toilet with a hallway and sink separated for girls and boys. The requirements for their equipment are laid down in Annex 1, point 8, to this Decree.
§ 7
Pupils' residence facilities in interest education establishments and interest education establishments shall be adapted and arranged in such a way as to enable the activities for which they are set up by their technical conditions. The smallest area of the room shall be determined by measuring 2 m2 per pupil. If the premises for residence in a school cooperative and a school club are not part of a school or educational establishment, a dedicated space must be provided for the postponement of clothing and footwear, a toilet with a hallway and a sink separated for girls and boys and a background for pedagogical staff under the specific legislation4). The requirements for sanitary equipment are laid down in Annex 1, point 8, to this Decree. ';

„§ 8
Schools in nature
(1) In schools in nature (9b), teaching is provided in a living room with a floor area of at least 1,5 m2 per pupil. If free time is spent in the indoor area, it must be a living room with a surface area of at least 1,5 m2 per pupil or a minimum of 3 m2 per child of pre-school age.
(2) For school accommodation in nature, a minimum floor area of 3 m2 per person is determined.

12. Article 9 shall be deleted;
13. Paragraph 10, including the title, reads:
„§ 10
Accommodation
(1) For accommodation in youth homes, boarding schools, children's facilities requiring immediate assistance and school facilities for the performance of constitutional and protective education and preventive educational care (hereinafter referred to as "accommodation"), the smallest accommodation area of the bedroom is 6 m2 per guest. A living room with a floor area of not less than 3 m2 per resident, youth and boarding houses of at least 1,5 m2 per resident must be set up in school facilities for constitutional and protective education and preventive education. A study room must be set up in the accommodation facility of the youth home, with a minimum of 1,5 m2 per pupil.
(2) The accommodation must have a tea kitchen, a separate clean and used linen warehouse, a space for drying clothing and for storing and cleaning footwear, cleaning and storage of seasonal needs. A part of the accommodation is a background for education4). The requirements for sanitary facilities and their equipment are laid down in Annex 1 to this Decree. ';
14. In Paragraph 11 (1), the words "and supports proper posture 'shall be added at the end of the first sentence, the second sentence shall be replaced by the words" Chairs and tables for children and pupils shall comply with the standard values of the Czech technical standard governing the size indicators of furniture 9c) and shall allow for compliance with the ergonomic principles of sitting work, as laid down in Annex 2 to this Regulation.' and in the fourth sentence the words "a visual angle of not more than 30 degrees from the rear edge of the workspace 'shall be replaced by the words" a distance of at least 2 m from the front edge'.
Footnote 9c reads:
"9c) ČSN EN 1729-1. '.
15. Paragraph 11 (2), including footnote 11, reads:
"(2) Furniture in accommodation facilities shall correspond to the nature of the facilities and age of children or pupils. The bunk beds are set up only in justified cases with regard to the physical and mental abilities of the accommodation and must comply with the standard requirements of the Czech technical standard governing the dimensions and safety of the bunk beds 11). The entry to the upper bed shall be safe and the upper bed shall be provided with a barrier to the fall and an impermeable mat under the mattress. Pupils may not be used in institutions for the education and education of children of pre-school age and in educational institutions for children and pupils under the age of 7. Each bed must provide a firm back support during sleep and have a separate space to store the bedding. Each room must be equipped with a table and a number of chairs according to the number of guests.

16. In the second sentence of Article 11 (3), the words "other than the usual 'shall be deleted; at the end of the text of the second sentence, the words" and in order to comply with the lighting requirements' shall be added, and at the end of the paragraph, the sentence "In the arrangement of benches other than the front of the pane, it is necessary to ensure regular lateral rotation of pupils' seats'.
17. In the first sentence of Article 12 (1), the word "values' is replaced by the word" requirements' and after the first sentence, the sentence "In the case of used buildings, it is exceptionally possible to use the total combined lighting after prior consultation with the public health authority. This lighting shall comply with the standard requirements of the Czech Technical Standard governing combined illumination13. '
18. In Paragraph 12 (2), the second sentence is replaced by the following: "In addition, overall combined lighting may be used in cases with a different bench arrangement than the front facing the pane or in workshops in order to illuminate shielded surfaces."
19. In Article 12 (3), the word "values' is replaced by the words" requirements of the Czech technical standard governing the requirements for lighting for indoor working spaces' and the words "Colour tone of artificial light to choose for the values of the latter ≤ 200 lx hot white shall be added at the end of the paragraph; 200 lx < 40,000 lx neutral white; > 1000 lx cold white according to standard requirements 14). The uniformity of artificial lighting in corridors and staircases shall be greater than 0,2. ';
20. Paragraph 12 (4) reads:
"(4) The lighting of the pane must comply with the standard requirements of the Czech technical standard governing the lighting requirements for the inner workspace (14). The illumination of the white pane shall be at least of the same level as that of the classroom. The plate shall have a matte surface, which shall not apply to a board not covered by chalk. From all positions in the direction of view of the pane, the reflections of the lamps on the pane shall be excluded. In the wall behind the pane there shall be no illuminating hole (window or roof window), otherwise it shall be covered with opaque material whose light reflection factor is close to the value of the reflection factor of that wall. '
21. In Paragraph 13 (3), the first sentence is: "The distance of the display unit from the eyes must be adjustable, at least 0,5 m from the upper edge of the display unit at eye level."
22. in Paragraph 15 (1):
"(1) For most visual activities in education and training establishments and establishments for education and training, the direction of daylight from left and above is required. The lamps in the case of artificial lighting systems shall be placed on the ceiling parallel to the window wall, provided that the layout of the room, in particular vaults or translations, allows. ';
23. in Article 15 (3) (a), the words "for education and training and establishments for education and training" shall be inserted after the words "in establishments."
24. in Article 15 (3) (b) and (d), the words "in education and training establishments and establishments for the education and training of pupils" shall be inserted after the words "lighting."
25. in Article 15 (3) (c), the words "for education and training and establishments for education and training" and the words "0,45 m above the floor" are replaced by the words "given by the prevailing height of the tables, in the other premises of the arcade and in the bedroom of the floor level."
26. In Paragraph 15 (4), the word "close 'is replaced by" immediate' and the words "task14) 'and" task15' are replaced by "task15 '.
27. in Article 15 (5), "(d) to (f)" is replaced by "(e)";
28. Paragraph 16 (3) is deleted.
29. In Article 17 (1), the words "all year round 'shall be inserted after the words" in the room' and the words "both summer and winter 'shall be deleted.
30. Paragraph 18 reads:
„§ 18
(1) The premises of the establishment for education and training and establishments for education and training intended for residence must be directly ventilated. The requirements for fresh air ventilation (air exchange) at the time of use of the interior are set out in Annex 3 to this Decree.
(2) If the temperature of the air in the classrooms intended to stay children and pupils falls below 18 ° C in three consecutive days, but not below 16 ° C, or if the temperature of the air in those classrooms falls below 16 ° C in one day, the operation of the education, education and establishment facilities for education and training must be stopped.
(3) At extreme outdoor temperatures where the maximum outdoor air temperature is higher than 30 ° C or where the resulting spherical temperature is tg max higher than 31 ° C, the teaching must be interrupted and other alternative measures for children and pupils with the possibility of staying outside the building, including the provision of drinking mode.
(4) If the outdoor environment does not allow natural ventilation to be used to exceed the permitted values of pollutants in the outdoor environment, the microclimatic conditions and ventilation by fresh air shall be secured by an air-conditioning device.
(5) The central dressing rooms of children and pupils without natural ventilation must be ventilated under pressure with air exchange in accordance with the requirements set out in Annex 3 to this Decree.
(6) In the case of tight windows, natural ventilation shall be provided with microventilation systems or ventilation cracks. ';
31. Article 19 shall be deleted;
32. In the first sentence of Article 21 (2), the words "for education and training and establishments for education and training 'shall be inserted after the words" for education and training'; in the last sentence, the words "to carry out 'shall be replaced by the words" to carry out'; and the words "in the outdoor environment of the land i 'shall be replaced by the words" to the outdoor environment or'.
33.Paragraph 21 (3) is deleted.
34. in Article 22 (e), the word "a" is replaced by a comma and the words "and light sources" are added at the end of the text of the letter.
35. in Article 22 (f), at the end of the text of the letter, the words "furnishing articles," shall be added.
36. In Article 22, at the end of point (g), the dot is replaced by "a 'and the following point (h) is added:
"(h) regular maintenance of forced ventilation or air conditioning and cleaning of air-conditioning equipment as instructed by the manufacturer or supplier.";
37. in the second sentence of Article 23 (2), the word "or" shall be inserted after the word "washing."
38. In Article 23 (3), the word "closed 'is replaced by" separate' and the word "or 'is inserted after the word" warehouses'.
39. Article 24 shall be deleted;

"Annex No 1 to Decree No 410 / 2005 Coll.
Requirements for sanitary facilities
1. The number of sanitary facilities in schools and schools shall be determined as follows:
a) in the hallway of toilets 1 sink for 20 pupils,
b) 1 toilet for 20 girls,
(c) 1 urinal per 20 boys,
(d) 1 toilet for 80 boys,
(e) 1 sanitary cabin for 80 girls.
2. The number of sanitary facilities in schools carrying out education of children, pupils and students with special educational needs, for severe or deep disability, shall be as follows:
(a) in the pantry of toilets 1 washbasin on the first 10 pupils and every 20 pupils;
b) 1 toilet for the first 10 girls and every other 20 girls,
c) 1 urinal on the first 10 boys and every 20 boys,
d) 1 toilet on the first 20 boys and every 80 boys,
(e) 1 sanitary cabin for 60 girls over 12 years of age,
(f) 1 shower (standby).
3. Number of sanitary facilities in establishments for education and education, excluding establishments for the business of childcare under 3 years of age under the daily regime:
a) in the hallway of toilets 1 sink for 20 pupils,
b) 1 toilet for 20 girls,
(c) 1 urinal per 20 boys,
(d) 1 toilet for 80 boys,
(e) 1 sanitary cabin for 80 girls.
4. The number of sanitary facilities at the premises of the child care business below 3 years of age in daily mode shall be determined as follows: toilets and washbasins for such facilities shall not be divided by sex and for 5 children shall consist of 1 child bowl and 1 sink. The number of children's bowls can be replaced from one third by children's pots. The washroom is also equipped with a children's bath tub with shower or shower box and a flowing drinking cold and hot water supply depending on the age of children. The washers shall be sown so that the height of the upper edge does not exceed 43 cm above the floor. The washers and showers shall be provided with only one water discharge connected to a central mixing battery located outside the reach of children. The washroom is also equipped with a changing table and a covered floor trash can.
5. The number of sanitary facilities in education and training establishments and in establishments for the education and training of pre-school children shall be as follows: for 5 children, one children's bowl and sink shall be established. At the most, instead of 2 toilet bowls, children's urinals can be installed, which are usually set at 40 cm. The washbasins are usually set at 50 cm, the discharge valve is 60 cm above the floor. The washers shall be connected to a mixed mixing battery, located outside the reach of children. Each sink shall be equipped with only 1 discharge valve. The washroom is equipped with 1 to 2 showers designed to allow children to enter the showers without any help.
6. In accommodation facilities, sanitary facilities are set up either as part of the accommodation unit, and are set up for 2 triple rooms 1 toilet, 1 shower, 2 washbasins, or as central sanitary facilities in the range 1 shower for 6 guests, 1 toilet for 6 girls, 1 toilet for 6 boys, 1 washbasin for 4 guests and 1 sanitary cabin for 40 girls.
7. In education and education facilities and establishments for education and training, at least one of the floors shall have an air-conditioned cleaning chamber with washable walls, equipped with an outlet with a flow supply of drinking cold and hot water including water drains and on each other floors a space with an outlet with a flow-flowing drinking cold and hot water including water drains and a ventilation space for storing cleaning products and aids.
8. All sanitary facilities in education and training establishments and establishments for education and training must be equipped with washbasins with running drinking cold and hot water. It must be equipped with soap in the dispenser and the possibility of drying hands of disposable towels or hand dryer must be ensured. In establishments for the education and education and establishments for the education and training of children of pre-school age, if the drying of hands of disposable towels is not solved, each child shall have his own towel placed so that the towels do not touch each other. Toilet paper must always be available in all sanitary facilities, and the girls' toilets must have a covered trash can. The walls and floors of each sanitary facility shall be washable and cleaned up to a minimum of 1,5 m and easily disinfected. If showers are part of the sanitary equipment, they must have a supply of drinking cold and hot water.

"Annex No 2 to Decree No 410 / 2005 Coll.
Principles for sitting and ergonomic parameters of school furniture.
1. Functional dimensions of the furniture to keep the physiological seat and correct position of the spine and pelvis:
(a) The height of the seat is equal to the length of the lower leg, increased by the height of the low heel (1 - 2 cm), i.e. the feet are in close contact with the floor in the rear seat so that they can be firmly supported.
(b) The effective depth of the seat supports at least 2 / 3 of the thigh length. The front edge of the seat shall not interfere with the knee hole and shall be rounded.
c) The back serves primarily as a support for the loins, not the thoracic spine. For free movement of the upper limbs should not reach higher than the lower angle of the blades.
d) The height of the work surface of the table is placed at the height of the elbows of the freely running arm of the seated pupil.
e) An easy to adjust table tilt is suitable. The writing setting level is 10-16 degrees, for reading up to 35 degrees.
2. Chairs and tables in contact with the floor must be stable. For dynamic seating, the seat cushion is suitable in the anterior plane from - 5 to + 5 degrees.
3. The least strenuous session, both for muscle activity and for pressure on intervertebral plates, is in a slight tilt with supported spine (relaxation session).
4. In order to reduce the static overload of muscle groups of the musculoskeletal system, functional position rotation is important. The short-term inclusion of alternative positions outside the bench (for example, cages, lying) and the use of dynamic seating aids (for example, balancing balls, overballs, balance pads) is appropriate. '

The temperature difference at head and ankle level shall not exceed 3 ° C.
Where the difference between the resulting temperature of the spherical thermometer tg and the air temperature is less than 1 ° C, the value of the [° C] measured by the dry thermometer may be used as the result of the temperature.
Indicative check of air temperature in space spaces can be ensured using wall thermometers. Thermometers shall not be placed on walls with windows and walls exposed to direct sunlight. '
Čl. II
Transitional provision
The provisions of Articles 3 (1) to (3), 4 (4), 4a (4) and (5), 11 (1) and 18 (4) of the Decree, as effective from the date of entry into force of this Order, shall not apply to the construction of establishments for the education and training of children and adolescents authorised to be used before the date of entry into force of this Order.

Efficacy
This decree shall take effect 15 days after its publication.
