THE LAW
of 26 October 2011
amending Act No. 120 / 2002 Coll., on the conditions for the placing on the market of biocidal products and active substances and amending certain related acts, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 120 / 2002 Coll., on the conditions for placing biocidal products and active substances on the market and amending certain related acts, as amended by Act No. 186 / 2004 Coll., Act No. 125 / 2005 Coll., Act No. 297 / 2008 Coll. and Act No. 136 / 2010 Coll., is amended as follows:
1. in § 1 (1), § 4 (1), § 4 (2) (c), § 7 (4), § 8, § 12 (1) and (8), § 24 (1) (k), § 24 (3) and (4), § 27 (a) to (c), § 31a (3), § 32 (1) (h) and in § 35 (3) (a), the words "European Communities" shall be replaced by "European Union."
2. footnote 1 shall read:
"(1) Directive 98 / 8 / EC of the European Parliament and of the Council of 16 February 1998 concerning the placing of biocidal products on the market.
3. in Articles 2 (2) and 13 (4), the words "No 1" shall be deleted;
4. In Paragraph 2 (4), the words "as set out in Annex 3 to this Act 'are deleted.
5. In Paragraph 2 (6), the words "Commission of the European Communities' are replaced by the words" European Commission 'and the words "Regulation of the European Communities' are replaced by the words" Regulation of the European Union '.
6. In Paragraph 2 (10), the words "the European Community 'are replaced by the words" the European Union'.
7. Paragraph 3 (2) reads as follows:
"(2) Biocidal products may contain only active substances included in the list of active substances and in the list of low-risk active substances and only basic substances, while complying with all specified requirements. The specific conditions for the authorisation and use of biocidal products and low-risk biocidal products containing the active substance shall be the responsibility of the legal person or the acting natural person who places the biocidal product on the market, with the exception of the specific conditions imposed on the holder of an authorisation issued in accordance with Article 7 under which that holder is responsible and the specific conditions relating to the use of the biocidal product under the responsibility of the person referred to in Article 3a (2). The list of active substances, the list of low-risk active substances and the specific conditions for the authorisation and use of biocidal products and low-risk biocidal products containing that active substance shall be laid down by the Ministry of Finance. ';
8. In Article 3a (2), the words "Annexes 2 and 3 to this Act 'are replaced by the words" Order'.
9. In Article 4, at the end of paragraph 1, the sentence "The application shall include the completed form generated from the Register for Biocidal Products established by Commission Decision 2010 / 296 / EU 23 and bearing the signature of the statutory representative of the applicant."
Footnote 23 reads:
"(23) Commission Decision 2010 / 296 / EU of 21 May 2010 establishing a Register of Biocidal Products."
10. in Articles 4 (2) (a) and 7 (4), the words "Annex No 2 or 3" shall be replaced by the words "Order."
11. in Article 7 (1) (a), the words "Annex No 2 or 3 to this Act" shall be replaced by the words "the list of active substances or the list of low-risk active substances laid down by the Decree."
12. in the first and second sentences of Paragraph 7 (7), the words "Annexes 2 or 3 to this Act" shall be replaced by the words "the list of active substances or the list of low-risk active substances laid down by the Decree."
13. in Paragraph 9 (2) of the Introductory Part of the provision, the words "Annexes 2 or 3 to this Act" shall be replaced by the words "the list of active substances or the list of low-risk active substances laid down by the Decree."
14. in Article 9 (2), the first and second sentences of the final part of the provision, the words "the list provided for in Annexes 2 or 3 to this Act" shall be replaced by the words "the list of active substances or the list of low-risk active substances laid down by the Decree."
15. in Article 10 (1), the words "the list set out in Annex 2 or 3 to this Act" shall be replaced by the words "the list of active substances or the list of low-risk active substances laid down in the Decree."
16. In Article 11 (2), the words "the lists set out in Annex No 2 or 3 to this Act 'are replaced by the words" the list of active substances or the list of low-risk active substances laid down in the Decree'.
17. in § 11 (3), § 16 (2) (d) (2), § 19 of the introductory part of the provision, § 20 (1) (m) and § 32 (3), the words "Annex No 2 or 3 to this Act" are replaced by the words "Order."
18. in Article 11 (4) (a):
"(a) the active substance has been removed from the list of active substances or the list of low-risk active substances set out in the Decree or the requirements or specific conditions set out therein are no longer met,";
19. in Article 16 (2) (a):
"(a) an active substance which was not on the market before 14 May 2000 and which is included in the list of active substances or the list of low-risk active substances laid down in the Decree for a period of 15 years from the date of its first inclusion in those lists,"
20. in Article 16 (2) (b) (2), the words "the list set out in Annex No 2 or 3 to this Act" shall be replaced by the words "the list of active substances or the list of low-risk active substances set out in the Decree."
21. Annexes 2 and 3 are deleted and the designation of Annex 1 is deleted.
Efficacy
This Act shall take effect on the day of its publication.
