DECLARATION
of 22 September 2009
amending Decree No. 419 / 2001 Coll., on the scope, structure and dates of the data submitted for the preparation of the draft State closing account and on the scope and dates of drawing up the draft final accounts of the chapters of the State Budget, as amended by Decree No. 581 / 2004 Coll.
The Ministry of Finance provides pursuant to § 30 paragraphs 2 and 4 of Act No. 218 / 2000 Coll., on Budgetary Rules and on the Amendment of Certain Related Laws (Budgetary Rules), as amended by Act No. 320 / 2002 Coll., Act No. 482 / 2004 Coll. and Act No. 26 / 2008 Coll.:
Decree No. 419 / 2001 Coll., on the scope, structure and dates of the data submitted for the preparation of the draft State closing account and on the scope and dates of the draft final accounts of the chapters of the state budget, as amended by Decree No. 581 / 2004 Coll., is amended as follows:
1. In Article 1, the words "voluntary communal volumes, regional councils of cohesion regions (hereinafter referred to as the Regional Council) 'shall be inserted after the words" local authorities'.
2. In Article 2 (2), the words ", voluntary communal and regional councils' shall be inserted after the words" Territorial self-governing bodies'.
3. In Paragraph 2 (4), the words ", voluntary communal volumes, regional councils' shall be inserted after the words" territorial authorities'.
4. In Annex 1, Part 1, Title 1 In point 1, "contributions and subsidies' is replaced by" contributions', "non-investment subsidies and investment transfers' is replaced by" non-investment and investment transfers' and "subsidies and loans' is replaced by" transfers and borrowed funds'.
5. In Annex 1, Part 1, Title 1 In point 3, "(Table 10) 'is replaced by" (Table 14)';
6. In Annex 1, Part 1, Title II, Part 1, point 4, the word "subsidy 'is replaced by" transfers'.
7. 10. 11. In Annex 1, Part 1, Title II, Part 1, point 7 (b), the words "as amended," shall be added at the end of the text of footnote 9.
12. In Annex 1, Part 1, Title II, Part 1, point 7 (c), third sentence, the words "social 'and" similar to the chapter of the Ministry of Labour and Social Affairs, with the entry "other benefits' being deleted.
13. In Annex 1, Part 1, Part 1, Part 1, Part 1, point 7 (e), the words "(e.g. Act No 154 / 2002 Coll., on the Temporary Financing of Certain Social Benefits of Miners, Decree No 287 / 2001 Coll., on the Contribution related to the Restructuring and Reduction of Brown Coal Mining, Regulation No 181 / 2002 Coll., on the Contribution related to the Restructuring of Steel Industries, Decree No 322 / 2002 Coll., which amends Government Regulation No 322 / 2002 Coll., and the Method for the Provision of a Contribution to the Social Conversion of the Transformation of the Czech Railways State Organisation) 'are replaced by the words" (for the Ministry of Industry and Trade, for example, Act No 154 / 2002 Coll.
14. In Annex 1, Part 1, Title II, Part 1, point 8, including footnote 9a, the following text is added:
'8. Evaluation of the appropriations spent on joint programmes of the European Union and the Czech Republic established by binding state budget indicators for the year under assessment. In the commentary, detailed information on the actual use of funds in the evaluation year is provided on a programme-by-programme basis, or on the source and financing instrument 9a) for each programming period (see Table 9a, 9b), the evaluation of expenditure in relation to the state budget including justification for the possible low implementation of the state budget, the evaluation of expenditure on the state of implementation of the programme or project, the drawing of the reserve in the evaluation year, the information on the entitlements of unused expenditure for the evaluation year (Section 47 of Law 218 / 2000 Coll.) and, where appropriate, the comparison of the expenditure of the year evaluated with the year in the previous year. Similarly, the assessment of the use of the funds under the EEA Financial Mechanism (see Table 9c) is carried out.
9a) Decree No. 16 / 2001 Coll., on the manner, dates and scope of the data submitted for the evaluation of the implementation of the state budget, budgets of state funds and budgets of local authorities, as amended, and the communication from the Ministry of Finance published in the Financial Rapporteur pursuant to § 9 (2), Annex 5 (15) and Annex 9 (8) of Decree No. 16 / 2001 Coll. (update of the code list of special-purpose characteristics and binding indicators of the state budget). '.
15. In Annex No 1, Part 1, Title II, Part 1, point 9, at the end of footnote 10, the words ", Act No. 262 / 2006 Coll., Labour Code 'shall be added.
16. In Annex 1, Part 1, Title II, Part 1, point 11, first sentence, the word "subsidy 'is replaced by" transfers'.
17. In Annex 1, Part 1, Title II, Part 1, point 13, including footnotes 11, 11a and 11b:
"13. Evaluation of transfers and borrowed funds or repayable financial assistance which have been made available from the budgets of the various chapters of the national budget during the evaluation year to the public territorial level budgets. These are transfers which have been made to regional councils, councils and the capital city of Prague directly from the budgets of chapters, or to municipalities through regional councils and councils, in whose district the respective municipalities are located 11). The evaluation shall be carried out according to each subsidy title (s) for which the special-purpose funds have been provided. The Ministry of Labour and Social Affairs, the Minister of Labour and Social Affairs, commented on transfers to municipalities with extended scope for the care allowance of persons dependent on the assistance of another natural person in order to ensure the necessary assistance (11a), transfers to municipalities for benefits of assistance in material needs (11b) and transfers to municipalities for welfare benefits conditional on disability.

18. In Annex 1, Part 1, Title II, Part 1, point 14, the first sentence is replaced by the following: "Commenting on non-investment transfers to business entities (subgrouping of items 521 and 523 of the budget composition)."
19. In Annex 1, Part 1, Title II, Part 1, point 15, third sentence, the word "subsidy 'is replaced by" transfers'.
20. In Annex No 1, Part 1, Title II, Part 1, point 16, the word "loans' is replaced by" borrowed funds' and the word "subsidy 'is replaced by" transfer'.
21. In Annex No 1, Part 1, Title II, Part 1, point 18, including footnote 13:
"18. Quantification of the amounts of claims on outstanding expenditure of the State's bodies on 1 January of the current year and entitlements on 31 December of the current year in accordance with the relevant statutory provisions (13) and the difference between those amounts. The main reasons for not spending budget expenditure in the year in question and the use of the reserve fund funds are mentioned. 22. In Annex No 1, Part One, Part II, Part 1, Part 1, point 28 (a), after the words "forced labour ', the words," Government Regulation No 622 / 2004 Coll., on the provision of a supplement to pensions to alleviate certain social injustices caused by the Communist regime, as amended by Government Regulation No 405 / 2005 Coll., Act No 357 / 2005 Coll., on the award of national combat participants for the creation and liberation of Czechoslovakia and certain survivors thereof, on the special contribution to retirement to certain persons, on the lump sum of money to certain participants in the national struggle for exemption between 1939 and 1945 and on the amendment of certain laws'.
23. In the first sentence of point 33 of Part 1 of Part 1 of Part 1 of Part 1 of Part 1 of Part 1 of Part 1 of Part 1 of Part 1 of Part 1 of Part 1, the words "(concerning the chapter) 'are replaced by the words" (with which the competent administrator of the chapter operates)' and the words "to which the chapter is entrusted by another institution 'are deleted.
24. In Annex No 1, Part One, Title II, Part 1, point 34, second sentence, the words "compensation 'and" under the agreement on the accession of the Czech Republic to the European Union' are deleted.
25. In Annex 1, Part 1, Title II, Part 1, point 35:
'35. Evaluation of the chapter of the Operation of State Financial Assets (evaluates the administrator of the chapter of the Operation of State Financial Assets), quantification of the initial and final stocks of the bank accounts of the State Financial Assets and commenting on their changes (revenue, expenditure or financing) during the year. '
26. In Annex No 1, Part 1, Title II, Part 1, the following point 38 is added:
'38. Evaluation of the expenditure of the chapter resulting from the concession contracts and other expenditure related to them pursuant to Act No. 139 / 2006 Coll., on concession contracts and concession procedures (concession law), as amended, the identification of individual concession contracts, the indication of the total amount for which the concession contracts are concluded and the comment of any amendments thereto. '
27. In Annex 1, Part One, Title II, Part 1, in the last paragraph of the sentence, the first word "grants' is replaced by" transfers'.
28. In Annex No 1, Part One, Title II, Part 2, in the titles of Tables 5 and 6, the words "subsidies and loans' are replaced by the words" transfers and borrowed funds' and, at the end of the title of Table 6, the words "to municipalities' are added to the words" and to other entities in the budget of the chapter '.

31. In Annex 1, Part 1, Title II, Part 2, in the paragraph starting with "Tables of the final account of the chapter" number "8" is replaced by "12."
32. In Annex No 1, Part One, Title II, the text "To Table 8, a detailed comment on the transfers made of the undrawn part of the budget of expenditure shall be submitted at the end of Part 2, in relation to the purpose for which the appropriations may be used in subsequent periods. In Annex No 1, Part Two, point 1, at the end of the first paragraph, the sentence "The assessment report is also submitted to the Supreme Audit Office as a basis for the processing of the opinion on the State Final Account pursuant to Act No. 166 / 1993 Coll., on the Supreme Audit Office, as amended."
34. In Annex No 1, Part Two, point 3 (c), the words "until 4 February 'are replaced by the words" until 5 February'.

The City of Prague provides data on loans received, borrowed funds and repayable financial assistance to finance operational programmes for the cohesion region of Prague co-financed by the European Union budget in Table 4a. Table 4b provides data on non-investment and investment transfers received from the state budget and from the budget of Prague to finance operational programmes for the cohesion region of Prague co-financed by the European Union budget and provided for funding programmes. The capital Prague presents data broken down by operational programmes and priority axes.
The counties shall submit data on the number and structure of the contribution organisations established by the counties and municipalities broken down by sector (by budget composition section) in Tables 5a and 5b. Data on the number and structure of voluntary municipalities in the region, broken down by sector (by budget composition section), shall be presented in Table 5c.
In the event of an extremely urgent need for surveys other than those mentioned above, the Ministry of Finance may request the submission of further specified data from municipalities, regions, Prague, regional councils and voluntary associations of municipalities.
The counties, municipalities, voluntary associations of municipalities, regional councils and the capital of Prague evaluate in Table 6 the expenditure resulting from the concession contracts and other expenditure related to them under Act No. 139 / 2006 Coll., on concession contracts and concession procedures (concession law), indicate the total amounts for which concession contracts are concluded and comment on any changes to them. '
58. In Annex No 2, Part One, in the last paragraph, the words ", voluntary communal unions and regional councils' shall be inserted after the words" local authorities'.
59. In Annex No 2, second paragraph, first sentence, the words ", voluntary volumes of municipalities and regional councils' shall be inserted after the words" local authorities', in the second sentence, after the words "regions, municipalities', the words" and 'shall be replaced by a comma and the words "the capital of Prague' shall be inserted after the words", voluntary volumes of municipalities and regional councils'.
60. "(b) Prague Capital Evaluation Report
The content of the evaluation report of the capital city of Prague is a brief but accurate assessment of the financial management of the capital city of Prague and directly managed organisations in the year of evaluation. The evaluation shall be carried out by comparing the results achieved in the revenue and expenditure part of the budget of the capital of Prague in the year evaluated with the results for the year preceding and, where applicable, the years preceding.
The report focuses on the implementation of budgetary policy objectives, on budgetary measures carried out during the year and on the evaluation of the current budgetary results. The focus is also on the involvement of non-budgetary resources, their share of overall results and their comparison with previous years.
The report shall analyse the creation of own income and its critical items. A comparison is made between the dynamics of Prague capital revenue in a given year and the previous year, or previous years.
In particular, the scope and structure of the transfers provided by the State Budget and the State Funds shall be commented on in relation to the previous years and their specific use.
On the expenditure side, the evaluation shall be carried out separately for current and capital expenditure. In assessing expenditure, the comment shall focus in particular on the use of resources from the State budget and from the State funds and, where appropriate, from other non-budgetary sources.
The comment shall include detailed information on the use of the funds provided to deal with the consequences of natural disasters, including the transfer of unspent special-purpose funds to the following year. Similarly, the use of resources to address other emergencies is commented on.
The capital Prague comments on all organisational and methodological changes that affected the management of the year.
The analysis of the management of the contribution organisations is carried out on a sectoral basis (according to the budget composition sections), the number of contribution organisations operating in the evaluation year with profit or loss.
The City of Prague comments on fluctuations in the development of financial management during the year under review and derogations from the intentions of the approved budget.
The evaluation report of the capital city of Prague includes an evaluation of the financing of operational programmes for the cohesion region of Prague co-financed by the budget of the European Union [similar to those submitted by the regional councils referred to in point (c)].
(c) Assessment report of the Regional Council of the Cohesion Region
The content of the Regional Council's evaluation report is a brief but accurate assessment of the financial management of the Regional Council in the evaluation year. The evaluation shall be carried out by comparing the results achieved in the revenue and expenditure part of the Regional Council budget in the year evaluated with the results for the year preceding and, where appropriate, the years preceding.
The report focuses in particular on transfers from the State budget to finance programmes co-financed by the European Union budget and their subsequent allocation to bodies in the cohesion region. In particular, the scope and structure of the transfers provided by the State budget, the State funds and the regional budget for financing programmes co-financed by the European Union budget and the activities of the Regional Council shall be commented on in particular as compared to previous years and the specific way in which they are used. The focus is also on the involvement of non-budgetary resources, their share of overall results and their comparison with previous years.
The report analyses the creation of own revenue, comparing the dynamism of the revenue of the Regional Council in a given year with the year of the past or previous years, as the case may be.
On the expenditure side, the evaluation of expenditure on programmes co-financed by the European Union budget, the evaluation of expenditure on the regional council's own activities and the evaluation of the instalments of loans received, loans and repayable financial assistance shall be carried out.
The Regional Council shall comment on any organisational and methodological changes affecting the management of the year under assessment.
The Regional Council shall comment on the fluctuations in the development of the financial management of the cohesion regions during the year under assessment and on deviations from the objectives of the approved budget. ';
70. In Annex 2, Part Three, second paragraph, the words "the word" and "shall be replaced by a comma after the words" the capital city of Prague "shall be added to the words" and the regional councils "and the words" round "shall be deleted.
71. In Annex No 2, third paragraph, third sentence, first sentence, the words "and voluntary volumes of municipalities' shall be inserted after the words" municipalities' and in the sentence, second sentence, the word "round 'shall be replaced by" official'.
72. In Annex No 2, Part Four, first paragraph, the words "a 'are replaced by the words" a' and the words "contribution organisations' are added after the words" and the relevant voluntary volumes of municipalities'.
73. In Annex No 2, Part Four, second paragraph, the words "and voluntary volumes of municipalities' shall be inserted after the words" the management of municipalities'.

In Annex 2, Part Five, under the title of Table 1a, the words "(without central government bodies and state funds)," shall be inserted above the right corner of the table, the words "(in thousand CZK)" shall be deleted, the words "or NFV (in thousand CZK) *" shall be inserted after the words "credit amount" in the second column, the third column with the heading "Currency" shall be deleted and the other columns shall be numbered 3, 4, 5 and 6.
80. In Annex No 2, Part Five, under Table 1a, the note to the table "Note: *) In the case of an accepted loan in foreign currency, an indication in foreign currency shall be added."
