on the approval of technical competence and on technical conditions for the operation of road vehicles
The Ministry of Transport provides pursuant to Article 91 (2) of Act No. 56 / 2001 Coll., on the conditions of operation of vehicles on the road and on the amendment of Act No. 168 / 1999 Coll., on the liability insurance for damage caused by the operation of the vehicle and on the amendment of certain related laws (Act on the insurance of liability from the operation of the vehicle), as amended by Act No. 307 / 1999 Coll., as amended by Act No. 103 / 2004 Coll., Act No. 411 / 2005 Coll., Act No. 226 / 2006 Coll., Act No. 311 / 2006 Coll., Act No. 170 / 2007 Coll., Act No. 297 / 2009 Coll., Act No. 152 / 2011 Coll. and Act No. 239 / 2013 Coll.:

INTRODUCTORY PROVISIONS
§ 1
Subject matter
(1) This Regulation shall apply to legal relations in the field of the approval of technical competence and to technical conditions for the operation of road vehicles which are not covered by the directly applicable European Union Regulation on the approval of the technical competence of vehicles of categories L, T, C and R1).
(2) The list of full names of the European Union Directives used in this Decree, including the numerical indication of the basic Directive and the numerical indication of the last amendment, is set out in Annex 1 to this Decree.
§ 2
Basic concepts
For the purposes of this decree:
(a) a towing vehicle for a motor vehicle connected to a trailer;
(b) a towing vehicle combination with one or more trailers;
(c) the replacement superstructure of a separate technical unit, which is in a detachable connection with the base vehicle, the carrier of the replacement superstructures,
(d) approval of a harmonised type of type of road vehicle, its system, component or separate technical unit to which the relevant European Union provisions apply;
(e) by approval of an international type, the procedure for approval of a vehicle, component or separate technical unit system established pursuant to decisions taken pursuant to the Agreement Concerning the Adoption of Uniform Technical Prescriptions for Wheeled Vehicles, Equipment and Parts which can be Fitted and / or be Used on Wheeled Vehicles and the Conditions for Reciprocal Recognition of Approvals Granted on the Basis of these Prescriptions, concluded in Geneva on 20 March 1958, as amended by the Agreement of 16 October 1995,
(f) by the approval of a non-harmonised type-approval of a road vehicle, its system, component or separate technical unit to which neither the relevant European Union provisions nor the international technical competence agreement which the Czech Republic is bound shall apply;
(g) the vehicle identification number of a number of characters, numbers and letters specific to the vehicle, its composition and its use are defined by the relevant European Union provisions;
(h) by a technical protocol, a document drawn up by the technical service or test station confirming that the vehicle, its systems, components or separate technical units which have been submitted to such bodies for testing or verification are in conformity with the information contained in the relevant document containing the technical data or in the information package and meeting the relevant technical, harmonised or international requirements; the measured values shall be reported in the technical report;
(i) the largest authorised mass the largest weight with which the vehicle may be used on the road in the Czech Republic;
(j) the largest permissible axle load, the largest axle load with which the vehicle may be used in road traffic in the Czech Republic;
(k) the technically permissible maximum axle mass corresponding to the maximum technically permissible static vertical load by which the vehicle is applied to the road surface;
(l) the technically permissible maximum laden mass determined for the vehicle on the basis of its design and design; the maximum technically permissible mass of the trailer or semi-trailer includes the static mass transferred to the towing vehicle when the trailer or semi-trailer is connected;
(m) the technically permissible maximum laden mass of the combination of a motor vehicle and one or more trailers based on its structural characteristics and design or the maximum mass intended for a combination of a trailer tractor and a semi-trailer;
(n) the immediate weight of the vehicle or combination of vehicles recorded at a certain point in time on the road;
(o) mass in running order
1. in the case of motor vehicles:
the mass of the vehicle, the fuel tank of which shall be filled at least 90% of its volume, including the mass of the driver, fuel and liquids, equipped with standard equipment as specified by the manufacturer and, if included in the equipment, the mass of the bodywork, cabin, coupling device and spare wheel, as well as the tools;
2. in the case of a trailer:
the mass of the vehicle, including fuel and liquids, equipped with standard equipment as specified by the manufacturer and, if included in the equipment, the mass of the bodywork, other coupling devices and spare wheels and tools.

BASIC TYPE AND VEHICLE CATEGORIES
§ 3
Basic characteristics for the determination of vehicle types, variants and versions for each vehicle category
(Paragraph 2 (10) of the Law)
(1) Basic features for the identification of types, variants and versions of road vehicles, when approved by the harmonised type, for vehicles
(a) categories M, N and O are listed in Annex II, Part B, to Directive 2007 / 46 / EC establishing a framework for the approval of motor vehicles and their trailers, as well as of systems, components and separate technical units intended for such vehicles, as amended (hereinafter referred to as "Directive 2007 / 46 / EC"),
(b) categories L are listed in the directly applicable European Union Regulation concerning the approval of two or three-wheel vehicles and quadricycles and market surveillance (12);
(c) categories T, C, R and S are listed in the directly applicable European Union Regulation on the approval of agricultural and forestry vehicles and market surveillance (13).
(2) Paragraph 1 shall apply mutatis mutandis to determine the essential characteristics of the types, variants and versions of road vehicles of category Z.
§ 4
Basic features for the identification of types of systems, components and separate technical units
(Paragraph 2 (11) of the Law)
(1) Essential features for determining the types of systems, components and separate technical units, when approved by the harmonised type, for vehicles
(a) categories M, N and O are referred to in Articles 3 and 10 of Directive 2007 / 46 / EC;
(b) categories L are listed in the directly applicable European Union Regulation concerning the approval of two or three-wheel vehicles and quadricycles and market surveillance (12);
(c) categories T, C, R and S are listed in the directly applicable European Union Regulation on the approval of agricultural and forestry vehicles and market surveillance (13).
(2) The essential features for the identification of the types of systems, components and separate technical units to which the international agreement to which the Czech Republic is bound applies are set out in the Decisions adopted pursuant to the Agreement concerning the Adoption of Uniform Technical Prescriptions for Wheeled Vehicles, Equipment and Parts which can be Fitted and / or be Used on Wheeled Vehicles and the Conditions for Reciprocal Recognition of Approvals Granted on the Basis of 20 March 1958, as amended by the Agreement of 16 October 1995 (hereinafter referred to as "Decisions adopted on the basis of an International Contract ').
(3) Paragraphs 1 and 2 shall apply mutatis mutandis in order to determine the essential characteristics of the types of systems, components and separate technical units to which neither the relevant European Union provisions nor the international agreement in the field of the approval of technical competence which the Czech Republic is bound.
§ 5
Type of vehicle components and separate technical units that can be approved independently of the vehicle
(Paragraph 2 (6) and (7) of the Act)
The type of component or separate technical unit may be approved independently of the vehicle only if it can be demonstrated that all technical, harmonised technical and international technical requirements laid down for that type of separate technical unit or component are met without the separate technical unit or component being mounted on the vehicle.
§ 6
Category of road and special vehicles
(K § 2 (8) of the Act, § 3 (4) of the Act)
A description of the categories of road and special vehicles, their further breakdown and division into categories is given in Annex 2 to this Decree.

TYPE-APPROVAL
§ 7
Vehicles, systems, components and separate technical units not covered by the relevant European Union provisions
(Paragraph 16 (9) of the Law)
The relevant provisions of the European Union shall not apply to:
(a) road vehicles of categories M, N and O designed and constructed for use by armed forces, civil protection, fire services and services responsible for maintaining public order;
(b) road vehicles of subcategory LZ;
(c) special vehicles of categories T4.1, T4.2, C, R and S when the manufacturer requests the approval of a non-harmonised type, as well as special vehicles of subcategories SS and SN,
(d) vehicles of category Z; or
(e) systems, components and separate technical units intended for vehicles referred to in (a) to (d).
§ 8
Technical requirements for road vehicles, systems, components and separate technical units
(Paragraph 16 (9) of the Law)
(1) For the determination of the technical requirements for road vehicles referred to in Article 7 (a), their systems, components and separate technical units, Annex 3 to this Regulation shall apply mutatis mutandis and the European Union provisions directly applicable to the approval of road vehicles of categories M, N and O. This does not apply to technical requirements whose application is hindered by operational technical reasons related to the activity carried out by the operators of such vehicles. In order to determine the technical requirements for road vehicles referred to in Article 7 (b), their systems, components and separate technical units, the European Union provisions directly applicable to the approval of two or three-wheel vehicles and quadricycles and the surveillance of the market12 shall apply mutatis mutandis). This does not apply to technical requirements whose application is hindered by operational technical reasons related to the activity carried out by the vehicle operators. For the purpose of establishing the technical requirements for road vehicles referred to in Section 7 (d), their systems, components and separate technical units, Annex 3 to this Regulation and the European Union provisions directly applicable to the approval of road vehicles of categories M, N and O, or the European Union Regulation directly applicable to the approval of two or three-wheel vehicles and quadricycles and to market surveillance (12) shall apply mutatis mutandis.
(2) For the determination of technical requirements for systems, components and separate technical units intended for road vehicles pursuant to Section 7, Annex 5 to this Decree shall apply mutatis mutandis.
§ 9
Harmonised technical requirements for vehicles, systems, components and separate technical units
(Paragraph 16 (9) of the Law)
The harmonised technical requirements for road vehicles of categories M, N and O, systems, components and separate technical units intended for such vehicles are set out in Annex 3 to this Regulation and in the directly applicable European Union provisions governing the approval of road vehicles of categories M, N and O.
§ 10
International technical requirements for systems, components and separate technical units
(Paragraph 16 (9) of the Law)
The international technical requirements for systems, components and separate technical units are set out in decisions taken under an international contract. These decisions are set out in Annex 5 to this order.
§ 11
Method of ensuring conformity of production of vehicles, their systems, components or separate technical units with the approved type
(Paragraph 16 (9) of the Law)
(1) The method of ensuring compliance of the production of road vehicles, their systems, components or separate technical units with the approved type, when approved by the harmonised type, for vehicles of categories M, N and O is set out in Annex X to Directive 2007 / 46 / EC.
(2) The method of ensuring conformity of production of road vehicle systems, their components or separate technical units with an approved type at the time of approval of an international type shall be that indicated in the decisions taken under the international agreement.
§ 12
Maximum number of vehicles in small series
(Paragraph 16 (9) of the Law)
The maximum number of road vehicles of categories M, N and O in a small series is given in Annex XII to Directive 2007 / 46 / EC.
§ 13
Scope and content of technical documentation
(Paragraph 17 (7) of the Law)
(1) The scope and content of the technical documentation, at the time of approval of the harmonised type, for vehicles of categories M, N and O, their systems, components or separate technical units are set out in Annex 3 to this Regulation and in the directly applicable European Union provisions governing the approval of vehicles of categories M, N and O.
(2) The scope and content of the technical documentation for the approval of an international type is set out in the decisions taken under the international agreement.
§ 14
Method of verification of conformity of production
(Paragraph 19 (2) of the Act)
(1) The method of verification of the conformity of production of vehicles, their systems, components or separate technical units with an approved type, at the time of approval of the harmonised type, for vehicles of categories M, N and O is set out in Annex X to Directive 2007 / 46 / EC.
(2) The method of verification of conformity of production of road vehicle systems, components or separate technical units with an approved type at the time of approval of the international type shall be that indicated in the decisions adopted pursuant to the international agreement.
§ 15
Forms of communication of the result of the verification of conformity of production
(Paragraph 19 (2) of the Act)
The communication of the result of the verification of conformity of production shall contain, for all vehicles of categories M, N and O subject to the approval of the harmonised type, at least the particulars listed in Annex X to Directive 2007 / 46 / EC.
§ 16
Scope and method of verification of technical requirements, harmonised technical requirements and international technical requirements
(K § 20 (4) of the Act)
(1) The scope and method of verification of the harmonised technical requirements, at the time of the approval of the harmonised type, for vehicles of categories M, N and O is set out in Annex 3 to this Regulation and in the directly applicable European Union provisions governing the approval of vehicles of categories M, N and O.
(2) The scope and manner of verification of international technical requirements for international type-approval is set out in decisions taken under an international agreement.
§ 17
Method of determining the number of road vehicles, components or separate technical units for the purpose of verifying technical requirements, harmonised technical requirements and international technical requirements
(K § 20 (4) of the Act)
(1) The number of road vehicles of categories M, N and O and vehicles referred to in Section 7, components or separate technical units for the purpose of verifying technical requirements and harmonised technical requirements shall be determined in such a way that all tests on the vehicle, component or separate technical unit necessary to verify compliance with the technical requirements or harmonised technical requirements have not yet been carried out.
(2) The method of determining the number of vehicles, components or separate technical units for the purpose of verifying international technical requirements for international type-approval is set out in decisions taken under an international contract.
§ 18
Approval certificate
(Paragraph 21 (4) of the Law)
(1) The model of type-approval certificate at the time of approval of the harmonised type for vehicles of categories M, N and O, their systems, components or separate technical units is set out in Annex 3 to this Regulation and in the directly applicable European Union provisions governing the approval of vehicles of categories M, N and O.
(2) The model of approval certificate, at the time of approval of an international type, is set out in the decisions taken under the international agreement.
(3) The type-approval certificate at the time of approval of the non-harmonised type shall be a special form with A4 security features containing information on the person who issued the certificate, the vehicle type, the system type, the component type and the type of separate technical unit on which the certificate was issued.
(4) The numbering system for harmonised type-approval certificates for vehicles of categories M, N and O is set out in Annex VII to Directive 2007 / 46 / EC.
(5) Annex No 7 to this Decree contains:
(a) a model type-approval certificate at the time of approval of the non-harmonised type;
(b) a model of the technical certificate of a road vehicle not subject to registration;
(c) a model of the technical certificate of a separate technical unit.
§ 19
Type-approval documentation
(Article 21 (4) of the Law, Article 24 (5) of the Law)
(1) The particulars of the list of approval documents are:
(a) identification of the authority which granted the type-approval;
(b) the stamp of the body which issued the type-approval;
(c) the date of issue;
(d) the approval number,
(e) the total number of sheets,
(f) the number of separate drawings;
(g) the number of separate photographs; and
(h) in the case of extension of approval, the reason.
(2) The revision of the approval is clearly indicated on each page of the information package which has been affected by the revision. The date of the amendment shall be indicated on this pages of the information package. The revision of the type-approval may also be indicated in the new approval documentation, provided that the modifications made are described in detail.
(3) In the case of extension of approval, the new type-approval certificate shall bear the serial number of the extension following the serial number of the previous extension.
(4) Paragraphs 1 to 3 shall apply only to road vehicles of categories M, N and O, vehicles referred to in Section 7 and systems, components and separate technical units of such vehicles.
(5) The particulars of the list of information package and the method of extension and revision of type-approval at the time of the international type-approval are given in the decisions adopted under the international agreement.
§ 20
Declaration of conformity
(Paragraph 23 (4) of the Law)
(1) The certificate of conformity, for harmonised type-approval, is issued for road vehicles of categories M, N and O.
(2) The formalities for the declaration of conformity and its duplicate are set out in Article 18 and Annex IX to Directive 2007 / 46 / EC for vehicles of categories M, N, O.
§ 21
(1) The approval mark shall be affixed to all road vehicles of categories M, N and O, their components and separate technical units and shall be as specified in Annex 3 to this Regulation and in the directly applicable European Union Regulations concerning the approval of road vehicles of categories M, N and O; this shall not apply to road vehicles pursuant to § 7 (a), their components and separate technical units.
(2) At the time of approval of an international type, the approval mark is affixed to all components of vehicles and separate technical units of vehicles and is indicated in decisions taken under an international contract.
(3) The approval mark for vehicles pursuant to paragraph 7, their components and separate technical units shall be affixed to all vehicles, their components and separate technical units and shall be as shown in Annex 8 to this Regulation.
§ 22
Maximum number of vehicles that may be placed on the market after the expiry of the approval
(Paragraph 26 (4) of the Law)
The maximum number of road vehicles of categories M, N and O which may be placed on the market after the expiry of the approval is set out in Annex XII to Directive 2007 / 46 / EC.
§ 22a
Approval of the non-harmonised type
(Paragraph 16 (9) of the Law)
(1) The approval of the non-harmonised type shall apply mutatis mutandis:
(a) Annex 3 to this Regulation and the provisions directly applicable in the European Union concerning the approval of road vehicles of categories M, N and O, where vehicles are approved in accordance with Section 7 (a), their systems, components or separate technical units;
(b) a directly applicable European Union Regulation governing the approval of two-, three-wheel and quadricycle vehicles and the surveillance of the market12), when vehicles are approved pursuant to § 7 (b), their systems, components or separate technical units;
(c) a directly applicable European Union regulation governing the approval of agricultural and forestry vehicles and market surveillance (13), where vehicles are approved under § 7 (c), their systems, components or separate technical units;
(d) Annex No 3 to this Regulation and the directly applicable European Union provisions governing the approval of road vehicles of categories M, N and O, or the directly applicable European Union Regulation concerning the approval of two or three-wheel vehicles and quadricycles and market surveillance (12) or the directly applicable European Union Regulation concerning the approval of agricultural and forestry vehicles and market surveillance (13), where vehicles are approved pursuant to Section 7 (d), their systems, components or separate technical units.
(2) Annex 5 to this Decree shall also apply mutatis mutandis to the approval of the non-harmonised type of systems, components and separate technical units intended for vehicles pursuant to Section 7.
(3) The provisions laid down in paragraphs 1 and 2 shall apply mutatis mutandis to the fixing of:
(a) the means of ensuring conformity of production of vehicles pursuant to Article 7, their systems, components and separate technical units with the approved type;
(b) the scope and content of the technical documentation;
(c) the method of verifying the conformity of production of vehicles pursuant to § 7, their systems, components and separate technical units with the approved type; and
(d) the scope and manner of verification of technical requirements.

TECHNICAL TESTS AND TEST STANCES
§ 23
Technical services
(Paragraph 27 (6) of the Law)
(1) The categories of activities of technical services for vehicles of categories M, N and O, their systems, components and separate technical units are set out in Article 41 of Directive 2007 / 46 / EC.
(2) The requirements for instruments and other necessary technical equipment and the spaces necessary for the performance of the technical service, the requirements for the internal organisation and control system and the method of assessment of compliance with these requirements for test rooms controlling vehicles of categories M, N and O, their systems, components and separate technical units are set out in Annex V to Directive 2007 / 46 / EC.
(3) In order to determine the categories of activities of the technical services, the requirements for their instruments and other necessary technical equipment, the requirements for the premises required for the performance of the activities of the technical services, the requirements for the internal organisation and management system and the way in which the assessment of compliance with these requirements is carried out, appropriate application shall be made.
(a) a directly applicable European Union Regulation concerning the approval of two or three-wheel vehicles and quadricycles and market surveillance (12), where verified
1. at the time of approval of an international type of compliance with the technical requirements, systems, components or separate technical units of L-category vehicles,
2. at the time of approval of the non-harmonised type, the vehicles referred to in Article 7 (b), their systems, components or separate technical units, or
(b) a directly applicable European Union regulation governing the approval of agricultural and forestry vehicles and market surveillance (13) where verified
1. when approved by an international type of compliance with technical requirements, systems, components or separate technical units of vehicles of categories T, C, R and S;
2. when approving the non-harmonised type of compliance with the technical requirements by vehicles referred to in Section 7 (c), their systems, components or separate technical units;
(c) Annex 3 to this Regulation and the directly applicable European Union provisions governing the approval of road vehicles of categories M, N and O, or the directly applicable European Union Regulation concerning the approval of two or three-wheel vehicles and quadricycles and market surveillance (12), or the directly applicable European Union Regulation concerning the approval of agricultural and forestry vehicles and market surveillance (13), where the technical requirements of the vehicles referred to in Section 7 (d), their systems, components or separate technical units are verified.
(4) The test report shall meet the requirements of Appendix 3 to Annex V to Directive 2007 / 46 / EC.
§ 24
Test stations
(Paragraph 72 (3) of the Law)
(1) The test station is divided into:
(a) test stations for road motor vehicles of categories L, M1, N1, O1 and O2;
(b) test stations for road motor vehicles of categories M2, M3, N2, N3, O1, O2, O3 and O4 and special motor and trailers of categories T, C, R and S;
(c) test station for special motor vehicles and trailers of categories T, C, R and S;
(d) test stations combined for motor vehicles and trailers referred to in points (a), (b) and (c) in different combinations by vehicle category;
(e) a test station combined for motor vehicles and trailers referred to in points (a) and (b) in various combinations by category of vehicle in the ADR implementation under the Europe Agreement concerning the international carriage of dangerous goods by road.
(2) Category vehicles Z may control the test station referred to in paragraph 1 which is able to carry out the check with regard to its technical equipment and parameters.
