on the details of the management of biodegradable waste and amending Decree No. 294 / 2005 Coll., on the conditions for disposal and use on the ground and amending Decree No. 383 / 2001 Coll., on the details of waste management (Decree on the details of biodegradable waste management)
The Ministry of the Environment, in agreement with the Ministry of Agriculture and the Ministry of Health, provides, pursuant to § 33b (3) of Act No. 185 / 2001 Coll., on Waste and on the amendment of certain other laws, as amended by Act No. 314 / 2006 Coll., ("the Act '):

ČÁST PRVNÍ

§ 1
Subject matter
This Decree regulates the details of the management of biodegradable waste ("biowaste ').
§ 2
List of bio-waste and quality requirements for waste entering material recovery technology
The list of bio-wastes available at the biowaste recovery facility, including the list of bio-wastes available at a small plant under Section 33b (1) (a) of the Act, and the quality requirements for waste entering the material recovery technology are set out in Annex 1.
§ 3
Technical requirements for the equipment and operation of biowaste biowaste treatment facilities, depending on the quantity and type of biowaste treatment and technological requirements for biowaste treatment
(1) The technical requirements for the equipment and operation of biowaste recovery facilities are established according to the quantity and type of biowaste processed therein for:
(a) small establishments pursuant to § 33b (1) (a) of the Act, Annex 2 and Annex 3;
(b) installations with a higher capacity than those provided for in Section 33b (1) (a) of the Small Equipment Act, depending on the biowaste treatment technology, in Annex 2 and other legislation1).
(2) Bio-waste facilities are divided into:
(a) composting plants and other facilities with an aerobic biowaste treatment process;
(b) biogas stations and other facilities with anaerobic biowaste treatment process.
(3) The technological requirements for each method of biological treatment of biowaste referred to in paragraph 2 are set out in Annex 2.
§ 4
Content of the operating schedule of the installation
The content of the operating order of installations with a higher capacity than laid down in Section 33b (1) (a) of the Small Equipment Act is set out in Annex 4.
§ 5
Method and criteria for the evaluation and classification of treated bio-waste in accordance with their material recovery methods
(1) The evaluation of the outputs from the biowaste recovery facility shall be carried out in accordance with the criteria set out in Annex 5.
(2) On the basis of the results of the evaluation, the outputs from the biowaste recovery facility shall be classified in groups corresponding to the individual uses of the processed biowaste material listed in Annex 6.
(3) The limit values for concentrations of foreign (risk) substances and elements at the outputs from biowaste biowaste treatment facilities are set out in Table 5.1 of Annex 5.
(4) The criteria for checking the effectiveness of hygiene are set out in Table 5.4 and the frequency of checks in Table 5.6 of Annex 5. In the case of the processing of animal by-products, the criteria and frequency of checks for outputs shall be assessed in accordance with another legislation2).
(5) The quality characteristics of the reclamation compost and the reclamation digestor are set out in Tables 5.2 and 5.3 of Annex 5.
§ 6
Frequency and sampling methods
The sampling shall be carried out on the basis of a sampling plan, drawn up in accordance with the principles set out in Annex 7 and in accordance with the operating rules of the establishment. The sampling report referred to in Annex 8 shall be processed.

Decree No 294 / 2005 Coll., on conditions for the disposal and use of waste on the terrain and amending Decree No 383 / 2001 Coll., on details of waste management, is amended as follows:
In Article 12, the following paragraph 3 is inserted after paragraph 2, including footnote 10a:
"(3) The provisions of paragraph 2 shall not apply to outputs from biodegradable waste recovery facilities for which the method and criteria of evaluation and classification in accordance with the recovery arrangements are laid down by other legislation10a).

(a) laid down in the conditions for taking over the waste to a particular establishment, as laid down in its operating rules;
(b) set out for certain types of biowaste in List A.

Annex No 2 to Decree No 341 / 2008 Coll.
Technological requirements for individual methods of biowaste treatment and technical requirements for the equipment and operation of biowaste treatment facilities
A. Methods of biowaste treatment
The methods of biological treatment of bio-waste, which are considered to be being used within the meaning of this Decree, are controlled and controlled processes of aerobic or anaerobic microbial biochemical transformation of such bio-waste carried out in facilities for their processing, or other uses or even completely new biological processes and technologies developed on the basis of the advancing development of science and technology with outputs that meet the requirements of this Decree.
B. Essential requirements for equipment
(1) Small installations - the requirements for small installations are set out in Annex 3
(2) Compositories and other equipment with composting process
(a) where agricultural waste of animal origin or animal by-products are processed in the establishment, except for sorted kitchen waste from kitchens, canteens and food stores and certain former foodstuffs, they shall be treated in accordance with another legislation (m2);
(b) the necessary equipment shall be:
1. temperature monitoring equipment;
2. humidification equipment;
3. equipment for aerating, dredging.
(c) additional requirements are laid down in other legislation1).
(3) Biogas stations and other equipment with anaerobic digestion process
(a) the requirements for establishments where animal by-products are processed, with the exception of sorted kitchen waste from kitchens, canteens and catering + and certain former foodstuffs, are laid down by other legislation (m2);
(b) additional requirements are laid down in other legislation1).
Note:
+ Sorted kitchen waste from kitchens, canteens and canteens means waste of a plant nature only (e.g. vegetable and fruit residues) which has not come into contact with raw materials of animal origin (e.g. raw meat, raw fishery products, raw eggs or raw milk).
C. Technological requirements for biowaste treatment
(1) Compost - a process in which the activity of micro and macro-organisms under air access converts usable bio-waste into stabilized output - compost. The technological requirements for this process are:
(a) for the composting of biowaste with the expected hygienic output according to the technology used in the plant, the temperatures listed in Table 2.1 shall be observed, the hygiene being the method of treatment of biowaste which reduces the number of pathogenic organisms which may cause human or animal disease below the specified value.

(b) it is necessary to reach a temperature of at least 45 ° C for 5 days in small establishments during composting and to carry out at least 2 hoops;
(c) the temperature of compost bases above 2 m shall be measured at the centre of the base at a minimum depth of 1 m from the surface of the base. The temperature of the lower compost bases shall be measured at the centre of the base at a minimum depth of 0,5 m from the surface of the base,
(d) the minimum time of the process after homogenisation is 60 days. When composting in enclosed areas, a shorter period may be possible in case of processing only plant tissues or if the device manufacturer determines the minimum processing time otherwise.
(e) when composting the inputs to installations requiring specific loading methods in accordance with Annex 1, List A, the hygiene efficiency of the installation in this case is confirmed by the verification of the carried organisms referred to in points D (1) (c) and D (1) (2) of this Annex;
(f) in the composting process, a temperature below 40 ° C is permitted for the consignment of compost;
(g) during the entire composting process, the measures laid down to comply with other legislation4 must be strictly complied with, in particular in relation to the protection of groundwater and surface water, the protection of health and the reduction of environmental pollution by odour (the permissible level of odour harassment must not be exceeded).
(2) Anaerobic digestion
(a) In the case of anaerobic digestion of bio-waste, which means controlled and controllable microbial mesophilic or thermal degradation of organic substances without air access at the biogas station plant as a separate technology for the production of biogas, digestor or reclamation digestor, it is necessary to achieve a temperature of treated bio-waste of at least 55 ° C and to maintain it for at least 24 hours without interruption, the total duration of the anaerobic digestion process being necessary for more than 30 days.
The total retention period may be less than 30 days, but not less than 20 days if the operator ensures that the produced digestat meets the stability values of another Regulation (5).
Achieving and maintaining a minimum temperature is not required if the treated biowaste is plant tissue.
b) Achieving a lower operating temperature in the reactor than 55 ° C or a shorter period of exposure to the reactor charge by this temperature is possible if:
1. biowaste has been pre-treated at 70 ° C for 1 hour; or
2. the reclamation digestat was subsequently maintained at 70 ° C for 1 hour; or
3rd Reclamation Digestat was composted.
(c) During the entire process of treatment of biowaste in anaerobic digestion, the measures provided for in other legislations4 must be strictly complied with (especially in relation to the protection of groundwater and surface water (e.g. tests of tightness in all tanks and sinks), health protection and the reduction of environmental pollution by odour (permissible level of odour harassment).
(d) A detailed description of the measures to reduce the risk of odour is always part of the operating rules of the establishment and the details of this description are given in Annex 4.
(e) In the case of anaerobic digestion of inputs into installations requiring specific loading methods as set out in Annex 1, List A, the hygiene efficiency of the installation shall be verified according to the point referred to in points D (1) (c) and D (1) (2) of this Annex.
D. Control of biowaste treatment methods in terms of hygiene efficiency
(1) In order to check the effectiveness of the hygiene of technologies - biological treatments in biowaste recovery facilities, the following are used:
(a) monitoring the technological parameters of the technology used (e.g. temperature, humidity, processing time) in accordance with Table 2.1 of this Annex;
(b) the criteria for evaluating output from installations set out in Table 5.4 at the frequency of checks as set out in Table 5.6 of Annex 5;
(c) in cases of processing of animal by-products as referred to in Article 5 (4), verification of the process of biological treatment of biowaste by means of imported organisms.
(2) Verification of the process of biological treatment of biowaste by means of imported organisms shall be carried out in facilities for the treatment of sludge from waste water treatment plants or other biowaste which are expected to be contaminated by pathogenic agents, namely:
(a) checking compliance with established technological parameters and checking compliance with the limit values of the selected output evaluation criteria;
(b) a test of direct evaluation of the process in which introduced indicator micro-organisms are used; the indicated organism is Salmonella senftenberg W 775 (H2S negative) or Escherichia coli.
(3) The process can be considered to be verified if:
(a) the output from the installation complies with the criteria set out in Table 5.4 of Annex 5;
(b) all the technological parameters laid down in the operating rules are complied with;
(c) the number of colonies forming a unit for the introduced organism shall be reduced by at least 6 orders during the process.
(4) Where animal by-product waste is treated, the management requirements are laid down in another legislation6).
Note:
Indicator micro-organisms are specified micro-organisms that indicate microbiological contamination of biodegradable waste and outputs from recovery facilities.

Annex No. 3 to Decree No 341 / 2008 Coll.
Essential requirements for the establishment and operation of a small biowaste recovery facility (composting)
(1) Small installations must be set up in accordance with other legislation7).
(2) In addition, it is required:
(a) choose a place with a slope of not more than 3 °; if necessary, the base may be covered with waterproof textiles or composted in bags or foundations,
(b) comply with a minimum distance from surface water (water flow, pond, lake, etc.) of 50 m (local hydrological situation must be taken into account),
(c) maintain a minimum distance from drinking water sources, sources of medicinal water and natural mineral waters of 100 m (local hydrogeological situation must be taken into account),
(d) choose a place outside the active flood zone in accordance with other legislation8);
(e) secure a site against unauthorised entry and identify (indicating contact information on operator and installation operating time),
(f) keep an operating diary.
1. The small device operating log shall contain:
(i) the name of the small establishment and address including the land parcel number and the name of the cadastral territory and the identification details of the owner of the land;
(ii) identification data of the small-scale operator;
(iii) the name of the person responsible for the operation of the small equipment and the availability details thereof;
(iv) the names of the persons responsible for keeping each record and an overview of the data and information to be recorded in the operating log.
2. Records in the small device's operating log must be kept (numbered) in an uninterrupted number series, dated and signed by the person who made the alert, recorded immediately after the situation described (on the same day) has occurred, at least to the following extent:
(i) all the factors characteristic of the operation of the plant - for example the names of the operator, the data collected on the monitoring of the operation of the plant - the types and quantities (weight) of biowaste received, the date of establishment of the establishment, the types of biowaste and the raw materials used for the establishment of the plant, the date of quarries, the dispatch of the recovery compost and the method of its recovery;
(ii) temperature measurement within the technological method used;
(iii) records of training of equipment personnel, inspections of equipment, etc.,
(iv) emergency situations and how they are handled.
3. Data on the mass of biowaste reported in the operating log can be determined on the basis of an expert estimate (weight of cargo on the car, conversion for volume, etc.).
The annex to the journal shall include the logs or copies thereof of the output checks carried out 1x per year and the records of checks carried out by the inspection authorities.

Annex No 4 to Decree No 341 / 2008 Coll.
Content of the operating schedule of the installation
(1) The operating rules of the biowaste recovery facility shall contain the data set out for the operating rules of the B and C plant group in Annex 1 to Decree No 383 / 2001 Coll., on details of waste management, as amended, and the following additional information:
(a) the design of the operating diary according to point 10 of Annex No 1 to Decree No. 383 / 2001 Coll., on details of waste management, as amended,
(b) the intended use of the output from the plant (compost, fertiliser, etc.),
(c) measures to comply with health and environmental requirements in accordance with other legislation9);
(d) measures for the control of odour emissions;
(e) in the case of biogas stations, the following information shall always be provided:
1. a clear specification of the inputs to the installation and their estimated quantity by type of input (tonnes / year),
2. means of storage of inputs;
3. a description of the process of anaerobic digestion of biowaste, including classification of anaerobic digestion by dry matter of the substrate and by operating temperature, time of retention of inputs in the anaerobic digestion process;
4. a description of the possible development of odour emissions and a description of the technical and organisational measures taken to prevent the formation and capture of odour emissions in the normal operation of the equipment and in emergency situations;
5. a description of the treatment of the reclamation digestor, including a specification of the treatment of the digesture resulting from emergency or other emergency situations.
(f) measures to minimise harassment and risks from the operation of equipment (odour emissions, emissions of solid pollutants, wind, noise and traffic, birds, parasites and insects, aerosols, etc.),
(g) in the case of the treatment of animal by-products waste, measures to comply with other legislation5).
(h) the principles of the sampling plan for the output from the installation to be processed in accordance with Annex 7; the model of the sampling report is set out in Annex 8;
(i) the extent of the monitored indicators set out for the evaluation of the output from the installation and the frequency of their checks referred to in Annex 5 in accordance with the sampling details set out in Annexes 7 and 8;
(j) the determination of the procedure for the change of operating rules in terms of reducing the frequency of tests in accordance with the sampling details set out in Annexes 7 and 8;
(k) any additional conditions for receiving biowaste, proposed by the operator according to the type of technology operated.

Evaluation and control of outputs
A. Requirements and criteria for evaluation and control of outputs from biowaste recovery facilities
(1) The requirements and criteria for the evaluation of outputs - the limit concentrations of selected risk substances and elements for the inclusion of outputs in the 2 and 3 groups referred to in Annex 6 are set out in Table 5.1.
(2) The quality characteristics of the recovery compost are given in Table 5.2.
(3) The quality characteristics of the reclamation digestor are given in Table 5.3.
(4) The hygiene efficiency criteria based on the monitored indicator micro-organisms at the outputs of the 2nd class Classes I and II set out in Annex 6 are set out in Table 5.4.
(5) Table 5.5 lists the methods of determination.
(6) The frequency and type of checks for each group of outputs referred to in Annex 6 are set out in Table 5.6.
(7) Where animal by-product waste is treated in an establishment, output from an establishment shall, in addition to the requirements set out in this Annex, meet the output requirements set out in another legislation10).

AT4 - respiratory activity test, test method for assessing the stability of biowaste based on measurement of O2 consumption in 4 days according to Austrian standard ÖNORM S 2027 - 1 of 1.9.2004. If AT4 of the test material is less than 10 mg O2 / g dry matter, this material is no longer considered biodegradable.
Notes to Table 5.1:
The output may be used as a technological material for landfills when the AT4 meets the requirements for stabilised bio-waste - Group 3 of Annex 6.
For recovery compost, reclamation digestor and stabilised biological waste, the results of the determination of individual indicators shall be evaluated separately for the purpose of reducing the frequency of tests. A possible reduction in the frequency of determination of individual indicators of selected risk substances and elements is given in point C (2) of this Annex.
In case of disposal of group 3 output - stabilised bio-waste by storing it in a waste landfill, it shall be treated in accordance with another legislation11).
