DECLARATION
of 9 September 2025
amending Decree No 401 / 2010 Coll., on the content requirements of the Transmission System Operation Rules, the Distribution System Operation Rules, the Transmission System Operator Order, the Distribution System Operator Order, the Gas Operator Order and the Market Operator Business Conditions, as amended
Pursuant to Section 98a (2) (b) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Performance of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 158 / 2009 Coll., Act No. 211 / 2011 Coll., Act No. 469 / 2023 Coll. and Act No. 87 / 2025 Coll.:
Regulation No 401 / 2010 Coll., on the content requirements of the Transmission System Operation Rules, the Distribution System Operation Rules, the Order of the Transmission System Operator, the Order of the Distribution System Operator, the Order of the Gas Storage Operator and the Commercial Conditions of the Market Operator, as amended by Decree No. 330 / 2017 Coll. and Decree No. 78 / 2024 Coll., are amended as follows:
1. In the title of the Order, the words "and 'are replaced by the words", the Order of the Data Centre, "and at the end of the title of the Order, the words" and the regional distribution system development plan' are added.
2. In Section 1 (d) of the introductory part of the provision, the words "electricity storage facilities' shall be inserted after the word" electricity '.
3. in Article 1 (d), the following point 3 is added:
"3. technical requirements for the connection of electricity storage facilities; ';
4. In Articles 1 (f) (4) and 2 (1) (f) (4), the words "or the operator of the electricity storage facility 'shall be inserted after the words" electricity producer'.
5. In Article 1 (h), the words "and electricity storage facilities' shall be added at the end of the text of point 6.
6. in Paragraph 1 (h), the following point 9 is inserted after point 8:
"9. Rules restricting the supply of electricity to or from electricity storage facilities; ';
Points 9 and 10 shall become points 10 and 11.
7. In Article 2 (1) (b) (4), the words "electricity producers' are replaced by the words" provider of support services'.
8. in Article 2 (1) (d), the words "enabling the accumulation of electricity" shall be replaced by the words "for the storage of electricity."
9. in Article 2 (1) (e):
"(e) requirements for the scope and timing of the transmission of the information necessary for the planning of the development of the distribution system by distribution system users;"
10. in Article 2 (1) (f) (7), the words "consumption and production" are replaced by the words "deliveries and purchases."
11. in Articles 2 (1) (f) (8) and 2 (1) (h) (5), the words "or electricity storage facilities" shall be inserted after the word "electricity."
12. in Paragraph 2 (2), the text ', (c), (d)' is replaced by 'to (d)';
13. in Article 6 (d), the following points 3 and 4 are inserted after point 2:
"3rd change of the aggregate,
4. the allocation of the flexibility provider; ';
Points 3 to 6 shall be renumbered 5 to 8.
14. in Article 6 (d) (7), the words "and residual" shall be inserted after the words "national."
15. in § 6 (d) (8):
"8. the registration of persons to ensure access to the central system of the market operator; ';
16. in Paragraph 6 (f), at the end of the text of point 5, the words "or the aggregate or with the allocation of the flexibility provider" shall be added.
17. in Article 6 (f), the words "or the aggregate or the allocation of the flexibility provider" shall be added at the end of the text of point 7.
18. in Article 6 (f) (12), the words "category C4" shall be inserted after the words "C";
19. in Article 6 (f) (14), the words "distribution system operator" shall be replaced by the words "aggregation or flexibility provider" and the words "assigned to the sharing group" shall be deleted;
20. in § 6 (i):
"(i) procedures for administering operating aid,"
21. In the title of Section 7, the word "Terms' is replaced by the words" Content '.
22. in § 7 (d) (5):
"5. the registration of persons to ensure access to the central system of the market operator;"
23. in § 7 (j):
"(j) procedures for administering operating aid,"

Content elements Order of data centre
The Order of the Data Center is the content
(a) details of:
1. identification of the data centre, including a list of important addresses and communication links with the data centre;
2. the internet address through which the data centre publishes information under another legislation in a way that allows remote access;
(b) details concerning the data centre information system, which are:
1. setting the conditions for access or changing access to the data centre information system;
2. the procedure for verifying the identity of the person requesting the conclusion or modification of a contract of access to the data centre information system;
3. establishing a procedure for concluding or amending a contract for access to the data centre information system;
4. access to data centre information system,
5. identification of means of communication and message formats for communication through the data centre information system and a description of the technical specifications of the communication method,
6. process of the data centre in case of malfunctioning of the data centre information system,
7. procedure for ensuring access by electricity market participants to the data centre information system;
8. procedure for planned shutdowns of the data centre information system,
9. way of dealing with complaints ensuring access to the data centre information system,
(c) particulars relating to the provision and disclosure of data and information which are:
1. the method of providing and making available measured and evaluated electricity supply and demand data at the transfer points assigned to the sharing group, the transmission points registered to take into account the storage of electricity and the transfer points where the transmission point or the demand facility, the electricity generation plant or the storage facility is assigned an initial supply or electricity collection chart to take into account the flexibility activation of the supply of balancing energy;
2. the method of providing and making available measured and evaluated electricity supply and demand data, taking into account shared electricity, storage of electricity, activation of flexibility for the supply of balancing energy and other data necessary for the billing of the transmission and distribution system services;
3. Method of providing information on the method of allocating shared electricity to transfer points assigned to the sharing group and summary information on the method of allocating shared electricity,
4. how to provide information on the progress of electricity generation and the technical parameters of the electricity generation plant and on the process of storage of electricity and the technical parameters of the electricity storage facilities from which electricity is shared;
5. the means of providing and making available information on the possibilities for activation of the flexibility for the supply of balancing energy at transmission points with registered regulatory energy supply options;
6. how to deal with data claims and information provided and made available by the data centre,
(d) particulars relating to the receipt of data and information:
1. the procedure for receiving and recording measured and evaluated electricity supply and demand data at the transfer points assigned to the sharing group, the transmission points registered to take into account the storage of electricity and the transfer points where the transmission point or the demand facility, the power generation plant or the storage facility is assigned an initial supply or electricity collection chart to take into account the flexibility activation of the supply of balancing energy;
2. the procedure for receiving and recording the measured data on the supply and consumption of electricity from the secondary measuring equipment at the transmission points registered to take into account the storage of electricity or from the secondary measuring equipment installed at the demand facility, the electricity generation plant or the electricity storage facility with the associated initial supply and / or electricity collection diagram to take into account the activation of the flexibility for the supply of balancing energy;
3. the procedure for receiving and recording information on the assigning of the electricity supplier, the clearing entity, the aggregate or the flexibility provider and the transmission system operator or the distribution system operator to the transfer points assigned to the sharing group, the transmission points registered to take account of the storage of electricity and the transmission points with registered regulatory energy supply options;
4. the procedure for receiving and recording information on technical data relating to transfer points assigned to the sharing group, transmission points registered to take into account the storage of electricity and transmission points with registered power supply options;
5. the procedure for receiving and recording information on the activation of the flexibility for the supply of balancing energy from the TSO;
6. the procedure for entering the replacement valid values and the method of indicating them in the event of failure of the measuring device or inaccessibility of measurements;
7. means of checking and correcting data and information received by the data centre;
8. way of dealing with data claims and information received by the data centre,
(e) the elements relating to the sharing of electricity, which are:
1. the method of entering, recording and evaluating the requirements for registration of the sharing group and assigning the registration numbers of transfer points to the sharing group, including the way in which electricity market participants are informed when registering the allocation;
2. the method of entering, registering and evaluating the requirements for the registration of allocation keys, including the way in which electricity market participants are informed when registering;
3. the way in which the input data are checked and the assumptions in the processes relating to the taking into account of shared electricity and informing electricity market participants of the results of such checks and verifications;
4. the method of rounding taking account of shared electricity;
5. how to deal with complaints about sharing group registration, assigning transfer point registration numbers to share group, registering allocation keys and taking into account shared electricity;
(f) the elements relating to the taking into account of the storage of electricity which are:
1. the method of entering, recording and evaluating the requirements for the registration of transmission points to take account of the storage of electricity, including the way in which electricity market participants are informed in the registration,
2. the way in which secondary measuring equipment is entered and registered to transfer points to take account of the storage of electricity;
3. the manner in which input data are checked and the verification of the assumptions in the processes relating to the taking into account of the storage of electricity and informing electricity market participants of the results of such checks and verifications;
4. the method of rounding taking account of the storage of electricity;
5. how to deal with the registration of transfer points to take into account the storage of electricity and with the storage of electricity;
(g) details relating to the processing of information on flexibility activation options for the supply of regulatory energy, which are:
1. conditions, deadlines, procedure and manner of input of information on the unavailability of the transmission system and the unavailability of the distribution system for the activation of flexibility;
2. types of unavailability of the transmission system and distribution system for activation of flexibility;
3. the manner in which the input data are checked and the verification of the assumptions in the processes relating to the processing of information on the possibilities for activation of flexibility and information to electricity market participants on the results of such checks and verifications;
4. how to handle complaints processing information about flexibility activation options,
(h) the elements relating to taking into account the activation of the flexibility for which the supply of regulatory energy is taking place;
1. the method of assigning the starting diagram of the supply or collection of electricity to the transfer point or to the electricity collection, electricity production or storage facility;
2. the way in which the initial diagrams of electricity supplies or withdrawals are processed;
3. the manner in which the input data are checked and the verification of the assumptions in the processes relating to taking into account the activation of flexibility and informing electricity market participants of the results of such checks and verifications;
4. how to deal with complaints processed by default diagrams of electricity supplies or withdrawals, complaints about assigning the default diagram of electricity supply or collection to the transfer point or to the electricity demand facility, power generation or storage facility, and complaints regarding the activation of flexibility;
(i) details concerning the coordination of the preparation of the operation of the electricity system, which are:
1. the process and manner of receiving information on the certified performance values of the demand facility, electricity generation plant or electricity storage facility, with the possibility of activation of flexibility for the supply of balancing energy, at the transmission point;
2. the procedure and manner of transmission of the information received by the data centre referred to in point 1 to the distribution system operator to which the electricity demand facility, electricity generation or storage facility is connected;
3. the procedure and manner in which the transmission system preparation data is made available to electricity market participants;
(j) particulars relating to payment and invoicing conditions, which are:
1. means of clearing and settlement of prices for the activities of the data centre and other payments;
2. way of dealing with the complaint bill of payments for data centre activities and other payments. "
25. The following Section 7b is inserted after Section 7a, including the title and footnotes 5 and 6:
Content elements of the regional distribution system development plan
The content elements of the regional distribution system development plan (the plan) are:
(a) details of:
1. identification of the distribution system operator, including a list of important addresses and communication links with the distribution system operator;
2. the internet address through which the distribution system operator publishes the plan,
(b) data on the distribution system operated, which are:
1. the area of the territory in km2 in which the distribution system service is provided;
2. operating voltage levels in kV;
3. number of high voltage transformers at high voltage,
4. number of high voltage transformer distribution stations at low voltage,
5. length of lines broken down by operating voltage levels;
6. the number of connected sampling points broken down by operating voltage levels;
7. the number of electricity generation and production modules connected, broken down by typo5) and the type of primary source of electricity,
8. Number of connected electricity storage facilities;
9. Total reserved consumption of the sampling points and total installed and reserved output of electricity generation and storage facilities broken down by operating voltage levels;
10. Geographical indication of the defined territory of the distribution system operator;
(c) data relating to the load on the distribution system and its expected development, which are:
1. the annual quarter-hour minima and maximum load levels of the distribution system in MW over the last 2 years, including the delineation of the days in which the quarter-hour minima and maxima occur;
2. the expected values of the annual quarter-hour minima and the maximum load on the distribution system in MW or MWh for the period for which the plan is being processed, taking into account the available scenarios processed by the TSO, the conditions of the distribution area, the changes in the load on the distribution system that trigger the requests for connection of the installation and the development changes in the distribution system;
(d) data on the free distribution capacity for the connection of the installations which are:
1. the free distribution capacity of the high voltage line and its expected development over a period of 5 and 10 years;
2. free distribution capacity of high and low voltage lines,
3. free distribution capacity of transformation stations converting very high voltage to high voltage and its expected development over a period of 5 and 10 years;
(e) details of the possibilities for attaching devices which are:
1. a list of the sites of the demarcated territory of the distribution system operator open for the connection of power generating facilities, expressed through the appendability map;
2. a list of the locations of the designated territory of the distribution system operator with limited possibilities for connecting electricity generating plants and an indication of the year in which the situation is expected to be unrestricted taking into account the planned measures necessary to strengthen the distribution system;
3. a list of the sites of the demarcated territory of the distribution system operator open for connecting the demand facilities, expressed through the appendices map,
4. a list of sites defined by the territory of the distribution system operator with limited possibilities for connecting demand facilities and an indication of the year in which the situation is expected to be unrestricted taking into account the planned measures necessary to strengthen the distribution system;
(f) a description of the concept of distribution system development, including the scenarios of distribution system development, for a period of 5 and 10 years;
(g) the elements relating to the development of the distribution system, which are:
1. an evaluation of the development carried out during the period from the publication of the previous plan to the submission of the current plan to the Energy Regulatory Authority, indicating the new and reconstructed lines of very high voltage, the new significant lines of high voltage, the new, expanded and reconstructed transformers that convert very high voltage and high voltage distribution stations;
2. the development planned for the period for which the plan is to be processed, indicating the planned new lines of very high voltage and the new significant lines of high voltage, the planned reconstructed lines of very high voltage, the planned new, extended and reconstructed transformers which convert very high voltage and high voltage distribution stations;
3. an evaluation of the development carried out in the period from the publication of the previous plan to the submission of the current plan to the Energy Regulatory Authority, indicating the locations where the significant development of distribution system facilities at low voltage level has occurred,
4. significant technological development projects to be implemented at low voltage level for the period for which the plan is being processed, specifying the location of the distribution territory, the description of the development projects and the state of preparation;
5. identification of projects strengthening the location of the distribution territory in which strategic investment structures are located pursuant to another legislation6) prepared for the benefit of the State or a legal entity of the State's exclusive ownership;
(h) a list of projects of common interest containing:
1. a description of the individual projects, including the timetable and estimated cost and amount of money drawn from the European Union funds;
2. the implementation phase of the individual projects and the amount of costs already incurred, information on compliance with the timetable, including information on the change in the progress of the project compared with the expected implementation plan, reasons for delays and changes in the timetable;
3. evaluation of the projects implemented in accordance with the cost-benefit analysis;
(i) details concerning the estimated need for flexibility, which are:
1. information on the possibilities for obtaining flexibility services, the potential response of the demand party, energy efficiency and energy storage facilities that the distribution system operator intends to use as an alternative to the distribution system,
2. an estimate of the size of the positive and negative flexibility potential needed to replace the further expansion of the distribution system, expressed in MW and MWh, including scenarios for developing the need for flexibility;
3. the identification and name of the site for which the size of the positive and negative flexibility potential referred to in point 2 is estimated and the estimate of the period for which the positive and negative flexibility potential is needed before the distribution system is expanded on the site;
4. an estimate of the cost reduction in the case of the use of flexibility compared to a further expansion of the distribution system over the lifetime of the assets.
(5) Commission Regulation (EU) 2016 / 631 of 14 April 2016 establishing a network code for requirements for the connection of production facilities to the electricity system.
6) Act No. 416 / 2009 Coll., on speeding up the construction of strategically important infrastructure, as amended. '
Efficacy
This decree shall take effect on 1 October 2025.
