DECLARATION
of 3 November 2022
amending Decree No. 99 / 2012 Coll., on Minimum Personnel Security Requirements for Health Services, as amended
The Ministry of Health provides, pursuant to Section 120 of Act No. 372 / 2011 Coll., on Health Services and the Conditions for their Provision (Health Services Act), as amended by Act No. 111 / 2019 Coll. and Act No. 261 / 2021 Coll., for the implementation of Section 11 (4) of the Health Services Act:
Decree No. 99 / 2012 Coll., on minimum staff security requirements for health services, as amended by Decree No. 287 / 2013 Coll., Decree No. 285 / 2017 Coll., Decree No. 304 / 2019 Coll. and Decree No. 357 / 2020 Coll., are amended as follows:
1. In Paragraph 1, the dot is replaced by a comma at the end of paragraph 1 and the following point (j) is added:
"(j) the urgent income is set out in Annex 10 to this decree."
2. In Annex 3, Part I, at the end of the text in point 20, the words "or a medical paramedic 'shall be added.
3. In Annex 3, Part I, point 21 is deleted.
Points 22 to 25 shall become points 21 to 24.
4. the following Annex 10 is inserted after Annex 9:
"Annex No. 10 to Decree No. 99 / 2012 Coll.
Requirements for emergency reception personnel
1. Personnel security of urgent reception workplaces is as follows:
a) Urgent doctor, anaesthesiologist, intensivista, surgeon, intern, cardiologist, neurologist or trauma surgeon,
(b) a general practitioner or an intern, provided that medical emergency services are also provided at the workplace;
(c) a practitioner for children and adolescents, a pediatrician or a pediatrician, provided that an emergency medical emergency service for children and adolescents is also provided at the workplace; and
d) Nurse for intensive care or medical paramedic for emergency medicine.
If the emergency intake is not provided by an emergency physician, anaesthesiologist or intensifier, the physical presence of at least one of these physicians shall be ensured within 5 minutes of the request.
Furthermore, the physical presence of a radiological assistant without supervision is ensured within 5 minutes of the request.
2. Personnel security of the bed part of the emergency reception workplaces is as follows:
a) 3 intensive care nurses or emergency medical emergency care nurses for each 4 resuscitation beds, but always at least 1 intensive care nurse or emergency medical emergency care nurse for emergency medical care in resuscitation beds,
(b) a general nurse without supervision or a medical paramedic for a maximum of 4 dispensers, but always at least 1 general nurse without supervision or a medical paramedic for care on the dispensing beds; and
(c) an orderly or a nurse for a maximum of 4 beds.
3. Personnel security of the contact point for cooperation with the health rescue service provider shall be provided by a general nurse without supervision or by a medical paramedic. "
Transitional provision
The health service provider, which has established an urgent income workplace before the date of entry into force of this decree, shall comply with the requirements for minimum personnel security of urgent income workplaces in accordance with Annex 10 to Decree No. 99 / 2012 Coll., as effective from the date of entry into force of this decree, until 31 December 2023.
Efficacy
This Decree shall take effect on 1 January 2023.
