on the one-off exceptional compensation for damage to health in the performance of fire protection tasks
The Government of the Czech Socialist Republic orders pursuant to § 81 of the Act of the Czech National Council No. 133 / 1985 Coll., on fire protection:
§ 1
(1) One-off exceptional compensation belongs to:
(a) the staff of a legal person or an undertaking natural person included in a fire brigade unit of an undertaking, a member of a community's voluntary fire brigade, a member of a company's voluntary fire brigade and a fire brigade member who, in the course of fire fighting, in a fire protection unit or in the event of a disaster or other emergency (1), or in direct connection with the performance of such tasks; and
(b) a citizen who has provided
1. in the case of firefighting or rescue of persons or property in the event of fire;
2. in the event of emergency work in the event of a natural disaster or other emergency (1), the fire protection unit shall, at the request of the commander of the fire protection unit, or with their knowledge or at the request of the municipality;
has suffered damage to health resulting in him becoming a disabled person under the Employment Act ("the injured ').
(2) The one-off exceptional compensation referred to in paragraph 1 shall be granted at the rate of seven to twelve times the average gross monthly nominal wage on the number of employees in the national economy recorded according to the published data of the Czech Statistical Office for the preceding calendar year (hereinafter referred to as "the average wage '), depending on the degree of damage to health and taking into account the degree of difficulties in social application, the share of the injured party in fighting fire or rescue work and the personal, family and social circumstances of the injured party.
§ 2
(1) If the injured party has died as a result of the damage to his health, one-off exceptional compensation shall be granted to his spouse and the child entitled to an orphan's pension; in cases justified by personal, family and social circumstances, one-off exceptional compensation may also be granted to his parents and, where appropriate, to other persons who have been dependent on him for maintenance.
(2) One-off exceptional compensation as referred to in paragraph 1 shall be granted:
(a) a child damaged at 12 times the average wage;
(b) to a spouse damaged at 12 times the average wage;
(c) parents who have suffered a total of 12 times the average wage;
(d) other persons who have been fed on the victim to a total of 12 times the average wage.
§ 3
The one-off exceptional compensation provided for in Articles 1 and 2 shall be in addition to claims under the rules on compensation for accidents at work.
§ 4
This Regulation shall enter into force on 1 July 1986.
