adjusting the use of surface water for navigation by motor vessels
The Ministry of Forestry and Water Management of the Slovak Socialist Republic, in agreement with the Federal Ministry of Transport and the competent central authorities of the state administration of the Republic, provides, pursuant to Article 6 (4) of Act No. 138 / 1973 Coll., on Water (Water Act):
This Decree regulates the use of certain surface water for the purpose of protecting the purity of water and ensuring the care of mass recreation by motor vessels with combustion engines (hereinafter referred to as "motor vessels').
Prohibition on the sailing of motor vessels
The voyage of motor vessels on watercourses, (1) on watercourses and on water tanks situated in protection zones, (2) on water tanks built after 31 December 1975 and on surface waters listed in the Annex to this Regulation shall be prohibited.
(1) Paragraph 2 does not apply to the sailing of motor vessels
(a) the Federal Ministry of National Defence, the Federal Ministry of Interior, the Ministry of Interior of the Slovak Socialist Republic, the State Navigation Administration, fire protection and watercourses managers, if used for service purposes;
(b) used in connection with the maintenance of watercourses, the construction, repair and maintenance of watercourses, including watercourses and watercourses;
(c) used to provide health and rescue services and to prepare and implement flood protection.
(2) Paragraph 2 does not apply with the exception of watercourses, sections of flows and tanks situated in the protection zones for navigation
(a) public shipping vessels including ferry vessels, 3)
(b) vessels used in the extraction and transport of sand and gravel;
(c) vessels used in public supply;
(d) State fishing vessels used in the performance of the tasks arising from the economic plan;
(e) swimmers' vessels when carrying out surveillance at places reserved for water recreation;
(f) vessels moved pursuant to Article 4 (3);
(g) vessels crashed and transported to a place where they can be repaired and secured.
Motor vessel stations
(1) Motor vessels may only have their stations in designated locations. The station and the maximum allowable number of motorboats shall be determined by the State Navigation Administration, in cooperation with the water watermanager (4) and the relevant district national committee. Authorised habitats shall be marked with navigational signs. 5)
(2) Motor vessels at stations must be safely unloaded. It shall be prohibited to tie motor vessels behind trees, to damage shore crops, banks and their fortifications. The method of untying shall be determined by the State Navigation Administration for each site. The construction of fixed bridges and floating buoys outside designated stations and the landing of motor vessels on shore intended for mass recreation shall be prohibited. 5)
(3) For the period from 1 November to 31 March, all motor vessels shall be removed from the water level and taken ashore above the top of the air or moved to a place suitable for overwintering.
(1) The District National Committee, in agreement with the Regional National Committee or the Regional National Committee in its competence, may authorise exemptions from the provisions of this Decree for water skiing and water motorism, for organised body, sports and defence events, or for other serious reasons, in the areas and periods provided for in the Agreement with the State Navigation Administration and Water Management; may also, in particular justified cases, but not later than 31 December 1977, maintain the existing arrangements for the use of surface water for navigation by motor vessels.
(2) The exemptions provided for in paragraph 1 may not be authorised for navigation on watercourses, streams and water tanks situated in protection zones and on water tanks built after 31 December 1975.
The provisions of this decree are without prejudice to provisions on the protection of waters and, where appropriate, to the care of the health of the people.
This decree shall take effect on the day of its publication.
