GOVERNMENT REGULATION
of 8 November 2023
on the adjustment of compensation for loss of earnings following the cessation of incapacity for work accident or occupational diseases and the adjustment of the reimbursement of maintenance costs of survivors under labour law (Regulation on compensation arrangements)
The Government orders pursuant to § 271u (2) of Act No. 262 / 2006 Coll., Labour Code, as amended by Act No. 205 / 2015 Coll.:
The compensation for the loss of earnings after the cessation of incapacity for work caused by accidents at work or occupational diseases (hereinafter referred to as "compensation for loss of earnings') to employees under Act No. 262 / 2006 Coll., the Labour Code, or under Act No. 65 / 1965 Coll., the Labour Code is adjusted so that the average earnings applicable to the calculation of compensation for loss of earnings or increased under the implementing legislation issued for the implementation of Act No. 262 / 2006 Coll. and Act No. 65 / 1965 Coll., and under Act No. 297 / 1991 Coll., on the adjustment of compensation for loss of earnings after the cessation of incapacity arising from work accident at work or occupational diseases are increased by CZK 360.
Compensation for the maintenance costs of survivors belonging to survivors under Act No. 262 / 2006 Coll. or under Act No. 65 / 1965 Coll. is regulated by the provision that the average profit for the calculation of the reimbursement of the costs of maintenance of survivors or increased under the implementing legislation issued for the implementation of Act No. 262 / 2006 Coll. and Act No. 65 / 1965 Coll. is increased by CZK 360.
(1) The compensation for loss of earnings and the payment of the maintenance costs of survivors who are entitled after 31 December 2023 shall not be adjusted in accordance with paragraphs 1 and 2.
(2) The adjustment provided for in Articles 1 and 2 shall be made without the application of a staff member or survivors, unless otherwise specified.
(3) The adjustment provided for in Article 1 shall be made at the request of the staff member if he has not received compensation for loss of earnings.
(a) only as a result of an increase in disability pension under social security legislation or pension insurance; or
(b) because it did not allow for the provision of § 195 (2) of Act No. 65 / 1965 Coll., as it was effective before 1 June 1994.
For compensation for loss of earnings and after adjustment for loss made pursuant to Paragraph 1, the provisions of Article 1 shall apply. In Act No. 160 / 1993 Coll., amending and supplementing the Act of the Czech National Council No. 589 / 1992 Coll., on Social Security Insurance and Contribution to State Employment Policy, as amended by the Act of the Czech National Council No. 10 / 1993 Coll., and some other laws.
The compensation for loss of earnings and the payment of the maintenance costs of the survivors, as provided for in paragraphs 1 and 2, shall be due from 1 January 2024, provided that the right to such compensation was incurred before that date.
This Regulation shall take effect on 1 January 2024.
