DECLARATION
of 7 December 2015
amending Decree No. 104 / 1997 Coll., implementing the Road Law, as amended
The Ministry of Transport provides for the Act No. 13 / 1997 Coll., on Road, as amended by Act No. 102 / 2000 Coll., Act No. 80 / 2006 Coll., Act No. 186 / 2006 Coll., Act No. 97 / 2009 Coll., Act No. 347 / 2009 Coll., Act No. 152 / 2011 Coll., Act No. 196 / 2012 Coll., Act No. 64 / 2014 Coll. and Act No. 268 / 2015 Coll.:
Decree No. 104 / 1997 Coll., implementing the Road Act, as amended by Decree No. 300 / 1999 Coll., Decree No. 355 / 2000 Coll., Decree No. 367 / 2001 Coll., Decree No. 555 / 2002 Coll., Decree No. 490 / 2005 Coll., Decree No. 527 / 2006 Coll., Decree No. 317 / 2011 Coll., Decree No. 288 / 2012 Coll., Decree No. 26 / 2014 Coll. and Decree No. 9 / 2015 Coll., are amended as follows:
1. At the end of the opening sentence of the Decree, the words "and pursuant to § 194 (c) of Act No. 183 / 2006 Coll., on Territorial Planning and Construction Regulations (Construction Act) 'are added.
2. in Article 1 (1), the following point (d) is inserted after point (c):
"(d) a road for motor vehicles of the road or local road which is marked with the sign" Road for motor vehicles "in accordance with specific legislation, ';
Points (d) to (g) shall be renumbered as points (e) to (h).
3. in Article 1 (1) (e), the words "the express road" shall be replaced by the words "the road for motor vehicles."
4. Paragraph 2 (1) reads as follows:
"(1) The first-class motorways and roads shall be marked with numbers from 0 to 99; the letter" D "shall be entered in the register in front of the digit if they are on the motorway. Class II roads shall be numbered from 100 to 999. The III-class roads shall be marked only by four to five-digit numbers according to the nearest motorway, road I or II-class, possibly followed by a small letter. The shoulders of one-way roads shall be marked with a capital letter index. ';
5. Paragraph 2 (3) is deleted.
Paragraphs 4 to 6 shall become paragraphs 3 to 5.
6. in Article 2 (3), "1 to 3 'is replaced by" 1 and 2';
7. In Article 2 (6), the words "railway crossings," are deleted.
8. In Paragraph 3 (1), the words "speed local communication and 'are deleted.
9. In the heading of Part Two, "3 'is replaced by" 6'.
10. in Article 6 (2), the words "and express roads" and the words "others" shall be deleted;
11. in Article 7 (2), the words "at least once every 5 years, otherwise always" shall be inserted after the word "implemented."
12. in Article 9 (5), the word "its" shall be inserted after the word "its" and the words "its abrasive layers" shall be deleted;
13. In Article 12 (4), the words "or in order to improve operational safety 'shall be inserted after the words" works'.
14. in Paragraph 13 (1), the words "off-road speed," shall be deleted;
15. in Paragraph 14 (1) (d), the dot at the end of point 2 is replaced by a comma and the following point 3 is added:
"3.6 cm in the case of short transverse thresholds carried out in the form of a construction adjustment."
16. in Article 15 (1) (a), the word "negative" shall be inserted after the word "cannot."
17. in Paragraph 19 (1), the words "express roads" shall be replaced by the words "road for motor vehicles."
18. In Article 19 (2), the words "and descent 'shall be inserted after the words" climb'.
19. In Paragraph 19 (3), the words "off-road speed," shall be deleted.
20. In Article 19 (5), the words "express roads' are replaced by the words" road for motor vehicles'.
21. in Paragraph 19 (6), the word "bilateral" shall be replaced by "roof-shaped."
22. in Paragraph 24 (2):
"(2) The anti-dazzle screens shall be set up, if necessary, in the middle line of the sections of motorways and roads, between parallel roads, or between roads and the runway. ';
23. in Article 24 (4), the words "and express roads" shall be deleted;
24. In Article 26 (1), the words "express roads' are replaced by the words" road for motor vehicles'.
25. in Article 26 (2), the words "express roads" shall be replaced by the words "road for motor vehicles" and the words "people dependent on a wheelchair" shall be replaced by the words "persons with reduced mobility or orientation."
26. In Paragraph 29 (3), "60 km / h 'is replaced by" 50 km / h';
27. the following Article 36a is inserted after Article 36:
Exemptions from technical requirements
The technical requirements referred to in the second sentence of Article 11 (1), Article 12 (2), Article 13 (1) and Article 26 (1) may be exempted in accordance with the procedure laid down in the Construction Act. "
28. In Section 43, the words "and express roads' are deleted.
29. in Article 45 (3) (a), the words "and express roads" shall be deleted;
30. In Paragraph 50 (1), the words "speed roads and local speed communication" shall be deleted.
31. after § 51c, the following § 51d is inserted:
Weighing list
(1) The weighting note contains the information set out in § 51c (1) (a) to (g), (i), (j) and (l).
(2) The model of the instrument is set out in point 3 of Annex 10 to this Regulation. "
32. At the end of Annex 10, the following point 3 is inserted after point 2:
'3. Model of the high-speed control weighing instrument
"
Efficacy
This Decree shall take effect on 31 December 2015.
