DECLARATION
Ministry of Finance
of 14 September 2001
amending Decree No. 279 / 1997 Coll., implementing certain provisions of Act No. 151 / 1997 Coll., on the valuation of assets and amending certain laws (Law on the valuation of assets), as amended by Decree No. 127 / 1999 Coll. and Decree No. 173 / 2000 Coll.
According to § 33 (1) of Act No. 151 / 1997 Coll., on the valuation of assets and on the amendment of certain laws (the law on the valuation of assets), the Ministry of Finance provides:

Decree No. 279 / 1997 Coll., implementing certain provisions of Act No. 151 / 1997 Coll., on the valuation of assets and amending certain laws (the Law on the valuation of assets), as amended by Decree No. 127 / 1999 Coll. and Decree No. 173 / 2000 Coll., are amended as follows:
1. Paragraph 2 (j) reads as follows:
"(j) the population of the resident population of the respective municipality according to the condition published by the Czech Statistical Office in the Small lexicon of the municipalities of the Czech Republic, which is current in the period beginning on the first day of the second month after its issue. The first month shall be deemed to be the month following the date of issue. When changing the territorial structure in the period under consideration, the current population of the municipality is based on the valuation date. '
2. The heading of Part Two reads as follows: "VALUATION OF CONSTRUCTION BY COSTS AND VALUATION BY BUILDINGS AND OBSERVATIONS BY EXPORTS '.
3. The second heading of the title of Title II reads: "VALUATION OF THE PROCEEDS AND OBSERVATIONS OF THE EXPORTS '.
4. Paragraph 21 (1) to (3) reads as follows:
"(1) Where a building valued in accordance with § 3 or a set of buildings containing at least one building valued in accordance with § 3 is leased, which is owned by the same entity, including, where appropriate, land and permanent crops as a whole, without distinction of rent on individual buildings or land, it shall be valued in a yield manner.
(2) Where only a part of the construction or a part of a set of buildings and, where appropriate, land including permanent crops referred to in paragraph 1 is leased, the rent in non-leased buildings or parts thereof shall be set at the rate of the normal rent. If the contract does not separately specify rent for land, including permanent crops, it is assumed to be included in rent for buildings.
(3) Energy buildings such as boiler rooms, exchanger stations, trafostations are always considered to be the buildings valued in accordance with § 3, irrespective of their built-up area. "
5. In Article 22 (1), for the capitalisation rate in percentage p, the words "under Article 21 (3) 'are deleted.
6. In the third sentence of Paragraph 22 (2), the words "behind a rented floor 'are deleted.
7. In Paragraph 22 (3), the words "leased floor areas' are replaced by the words" leased real estate '.
8. Paragraph 22 (4) reads as follows:
"(4) The annual rent determined in accordance with paragraphs 2 and 3 shall be reduced by 20% and, where appropriate, by the annual rent paid on the land. The total amount of the deduction shall not exceed 70% of the annual rent determined in accordance with paragraphs 2 and 3. ';
9. Paragraph 22 (5) is deleted.
10.Paragraph 23 (1) reads as follows:
"(1) If the price of the building plot is not fixed in the price map, 10) the basic price per m2 of the building plot held in the cadastral is as a built-in area and courtyard or a plot already used for this purpose:
a) CZK 2,050 in the capital of Prague,
b) 350 CZK in the districts of Praha- east and Praha- west, whose cadastral territory is adjacent to one of the cadastral territories of the capital of Prague,
c) CZK 1,100 in Brno, Ostrava,
(d) 300 CZK in municipalities whose cadastral territory is adjacent to the cadastral territory of the city referred to under (c),
e) 800 CZK in Czech Budejovice, Pilsen, Karlovy Vary, Liberec, Ústí nad Labem, Hradec Kralove, Pardubice, in Jihlava, Olomouc, Opava, Zlín, Františkové Lazne, Mariánské Lazne,
(f) 250 CZK in municipalities whose cadastral territory is adjacent to the cadastral territory of at least one of the cities referred to in (e);
g) 500 CZK in Český Krumlov, Kladno, Havířov, Most, Jáchymov, Karviné, Luhačovice, Poděbrady and Teplice,
(h) 150 CZK in municipalities whose cadastral territory is adjacent to the cadastral territory of at least one of the cities referred to in (g),
(i) 400 CZK in district cities not referred to under (e) and (g),
j) 150 CZK in municipalities whose cadastral territory is adjacent to the cadastral territory of at least one of the cities referred to under (i);
k) 35 CZK in municipalities with population up to 1 thousand inhabitants,
(l) in other municipalities not referred to in (a) to (k), the amount calculated according to the formula
Cp = 35 + (a - 1000) x 0,007414,
where
Cp... land price in CZK / m2 (rounded to two decimal places)
and... population in the village.
This price shall be adjusted by the increases and reductions referred to in Annex 15 to Table 1 with the justification and the coefficients Ki from Annex 32 and Kp from Annex 33. ';
11. in the third sentence of Article 23 (2), the words "or, where appropriate, by decision on the location of the construction," shall be inserted after the words "by special regulation."
12. In Article 23, the following paragraph 13 is added:
"(13) The price determined in accordance with paragraphs 1 to 11 shall not be lower than the price determined in accordance with Paragraph 26 (4). ';
13. in Article 23a (2), the words "in A4 format" shall be inserted after the words "Text Part."
14. in Article 23a (3), the words "composed in A4 format" shall be inserted after the words "Graphic part."
15. in Article 24, the following paragraph 5 is added:
"(5) The basic price determined in accordance with paragraphs 2 and 4 shall not be lower than the price established in accordance with Paragraph 26 (3). ';
16. In Paragraph 25, the following sentence is added at the end of paragraph 3: "This price may not be lower than the price determined in accordance with Paragraph 26 (3). '.
17. in Article 27 (4), "KR1 to KR9" is replaced by "KR1, KR2, KR4 to KR9";
18. in Article 27 (4) (a), the coefficient "KR3" shall be deleted;
19. in Article 27 (4) (b), "KR3" is deleted;
20. in the second sentence of Article 27 (4), "KR1 to KR9" is replaced by "KR1, KR2, KR4 to KR9";
21. In Paragraph 27 (6), a colon is inserted after the word "does," and the words "3 Kč" are replaced by the words:
"(a) 5% of the price to be recorded from the basic price of the building plot referred to in Article 23 (1) (a) to (l), if these parcels are located in a built-up part of the municipality or if any point is at their border (air line) up to 200 m from the continuously built part of the municipality,
(b) 3% of the price to be determined from the base price of the building plot pursuant to Article 23 (1) (a) to (l) in other cases. "
22. in Paragraph 27 (7), the words "CZK 0,70 per m2" are replaced by the words "2% of the basic price of the building plot referred to in § 23 (1) (a) to (l), in the case of land held in the land register as swamps and swamps up to and including the price referred to in Article 26 (4)."
23. In Paragraph 30, the following paragraph 2 is inserted after paragraph 1:
"(2) Where the age of the wood group evaluated is lower than its washing, its basic price shall be reduced by a coefficient calculated as the difference between the washing and the age of the wood group evaluated multiplied by 0,004 / year. ';
Paragraph 2 shall become paragraph 3.
24. in Paragraph 33 (1) (b):
"(b) for vines including vineyard establishments in Annex 29, Part I for intensive planting and Part II for extensive planting,"
25. in Paragraph 34, the words "knowledge" and "property rights which are the content of copyright rights, with the exception of the rights of performers, and the property rights of the procuring entities of the database," shall be inserted after the words "knowledge";
26. The following Sections 41a and 41b are inserted in Part Eight before Paragraph 42:

Use of sales coefficients
(1) For constructions valued in accordance with Sections 7, 9, 10 or 11, if they form accessories for constructions valued in accordance with Sections 3, 4, 5, 6 and 8, the divestment coefficients of these constructions shall be applied from Annex 33. If buildings valued according to § 7, 9, 10 or 11 constitute accessories of several buildings valued according to § 3, 4, 5, 6 and 8, without distinction, the lowest Kp of these buildings shall be used. If the buildings valued in accordance with § 4 fulfil the function of outdoor modifications or accessories to the buildings valued in accordance with § 3, 5, 6 and 8, the sales coefficients of these buildings shall also apply. If more structures are used without distinction, proceed according to the previous sentence. Where constructions valued pursuant to Sections 7, 9, 10 or 11, as the case may be, do not constitute accessories of any construction valued under Sections 3, 4, 5, 6 and 8, the divestiture coefficient of the construction valued under Section 4 shall apply.
(2) If the buildings valued in accordance with § 7, 9, 10 or 11 constitute accessories for the apartments valued in accordance with § 13, the coefficient of sale of the flats shall apply. Where constructions valued in accordance with Sections 7, 9, 10 or 11 constitute accessories for non-residential spaces valued in accordance with Section 13, the divestment coefficient of the type of construction in which the rated non-residential space is located shall apply to them.
(3) The property shall be subject to the marketability coefficient of the building which does not form accessories of another building. Where more than one type of construction is located on one plot valued in accordance with Sections 3, 4, 5, 6 and 8, the lowest sales coefficient applicable to the buildings valued in accordance with Sections 3, 5 and 6 shall be used for the valuation of the plot, which shall not constitute accessories of other structures. The same applies if there are also buildings valued in accordance with § 7, 9 and 10, or § 11. If there are on one plot of a building valued in accordance with Sections 4 and 8 and, where appropriate, the buildings valued in accordance with Sections 7, 9, 10 and 11, the lowest coefficient applicable to the buildings valued in accordance with Sections 4 and 8 shall apply. If only buildings valued in accordance with § 7, 9, 10 or 11 or there is no construction on the land and no territorial decision on the location of the construction or use of the territory has been taken, a coefficient shall be applied from column 11 of Annex No 33. For the valuation of land in the functional unit - garden, other area - the sales coefficient shall be applied to the same as for the type of land built and courtyard. If there are more parcels in the functional unit in the type of area and courtyard built, the same principles shall apply.
(4) If a territorial decision on the location of the construction is taken on the land, the divestment coefficient of the future construction shall apply. Where a land use decision is issued, the sales coefficient shall be applied from column 9 of Annex No 33. In the event of reasonable doubts as to the determination of the future construction, the divestibility coefficient from column 11 of Annex No 33 shall apply.
(5) If the plot is intended to be built in accordance with a valid urban plan or regulatory plan, the divestment coefficient shall be applied according to the expected functional use of the area.
(6) In the case of land belonging to an apartment valued in accordance with Paragraph 13, the coefficient of sale of the apartment shall be applied. In the case of land belonging to a non-residential area valued in accordance with § 13, the sales coefficient of the type of construction in which the non-residential area is situated shall be applied.
(7) The sales coefficient set out in Annex No 33 may be reduced or increased by up to 10% of the value of the coefficient, in justified cases, supported in particular by photo-documentation or map material. The reason for the adjustment is the deviation from the normal conditions in the rated location, broken down according to Annex 33, in amenities, transport connections, historical importance of the area and in exceptional climatic conditions in relation to the valued property. Moral wear can also be taken into account. The relevant divestment coefficient set out in Annex 33 and the method for adjusting the divestment coefficient, including a proper justification, shall be included in the valuation.
§ 41b
In the valuation of real estate, the price determined shall be reduced by the cost of the material burden on real estate. ';
27. In Annex 2, point 3 is added after the table of basic prices per m3 of occupied space:
'3. The basic prices per m3 of occupied space do not include the cost of land use. '
28. In Annex 3, the following sentence is added after the table of basic prices per m3 of occupied space: "The basic prices per m3 of occupied space do not include the cost of land use."
29. In Annex No 5, entry No 21, "SKP 46.21.31.2 'is replaced by" SKP 46.21.42.3'.
30. In Annex No 5, entry No 22, "SKP 46.21.31.2 'is replaced by" SKP 46.21.42.3'.
31. In Annex 5, entry No 23, the words "SKP 46.21.42.3 'are inserted after the name of the entry.
32. In Annex 6, Part I, in the first table in the first column, the word "inclined 'is replaced by the words" inclined or steep'.
33. In Annex 7, Part II, entry 9, the words "not applicable 'in columns B, D, F are replaced by the words" any other than ladder'.
34. In Annex 14, point 3, first sentence, the words "side buildings, garages' are deleted.
35. In Annex 14, point 5, "4 'is replaced by" 6' and "5 'is replaced by" 7'.
36. In Annex No 14, the following Tables 5 and 6 are inserted after Table 4:

Definition of terms
The BPEJ expresses the five-digit code of the main soil and climatic conditions affecting the production capacity of the agricultural land and its economic evaluation. 24)
The first digit of the code indicates the affiliation to the climate region (0 - 9), the second and third digits define the affiliation to a particular main soil unit (01 - 78), the fourth digit determines the combination of the lattice and the exposure of the land to the world parties, and the fifth digit determines the combination of the depth of the soil profile and its sceleticity.
42. In Annex No 17, entry No 1.7.2, "the territory of neighbouring municipalities' is replaced by" the neighbouring cadastral territory '.

On the basis of the annual depreciation rate of 2% and the age of the pond (A) in years, KR1 is calculated according to the relationship
KR1 = 1 - 0,02 x A.
The minimum value of KR1 before adjustment according to this relationship is 0,20.
In addition, the KR1 coefficient shall be adjusted according to the state of the pond objects (rounded to a hundredth) as follows:
For ponds older than 25 years, KR1 will increase by up to a maximum of

If KR1 is released after modifications, i.e. all pond objects are in emergency condition, the pond is no longer considered to be a construction and is assessed as other water tanks that are not construction. "
50. in Annex No 20, item 2), the coefficient of water economic importance of KR2 shall be as follows:

In cases where hydrological data are not available, the annual flow rate (Z1) shall be determined from the river basin area to the pond dam (W) [km2] [can be deducted from the water management map at the scale of 1: 50 000 with an accuracy of 10% of the area and from the average specific outflow (O0) in 1000 m3 / km2 / year based on an altitude determination of 10 m and an interpolation of the average data referred to in the table below] and the relationship

1. The price of the vineyard can be reduced by up to 60% if the vines are shown to be disproportionately weak in size, damaged or ill.
2. The price of an intensive type of vineyard with planting of European varieties (headings 1 and 2) from proven healed viral seedlings may be increased by up to 20% with justification.
3. The price of an intensive type of vineyard with the planting of wine grape varieties not authorised in the wine-growing region (Annexes 1 and 2 to the Decree of the Ministry of Agriculture No 298 / 2000 Coll., as amended by Decree No 228 / 2001 Coll.) for the production of wine-growing wines with an addition [§ 6 (c) and § 9 of Act No. 115 / 1995 Coll.] can be reduced by up to 20%, with justification.
4. If the vineyard with the planting of the stock-growing stock at the date of the valuation does not have a supporting structure, its price shall be reduced by 20%.
5. The price of the rootstock planted from proven recovering viral seedlings can be increased by up to 20%.
6. The lowest price is 5 CZK / m2 for intensive type of vineyard, or 20 CZK / shrub for extensive (garden) type of vine planting. Under these limits, the price of the vineyard adjusted under points 1 to 5 above shall not fall. ';
55. In Annex No 31, point 4, under entry No 2, the words "in built-up parts of the municipality 'are added.
56. In Annex 31, point 4, entry 3 reads as follows:
"Other public greenery in built-up parts of cities and other municipalities'.
57. In Annex No 31, point 4, the following entry No 4a is inserted after entry No 4:
