GOVERNMENT REGULATION
of 2 December 2015
amending Government Regulation No. 416 / 2002 Coll., laying down the amount of the levy and the way it is paid to the source of radioactive waste to the nuclear account and the annual amount of the contribution and the rules governing its provision to municipalities, as amended
The Government mandates pursuant to § 27 (4) (a) and § 27 (7) and 11 of Act No. 18 / 1997 Coll., on the Peaceful Use of Nuclear Energy and Ionizing Radiation (Atomic Act) and on the amendment and addition of certain laws, as amended by Act No. 13 / 2002 Coll. and Act No. 250 / 2011 Coll.:
Government Decree No. 416 / 2002 Coll., establishing the amount of the levy and the way it is paid to the producer of radioactive waste to the nuclear account and the annual amount of the contribution and the provision of it to municipalities, as amended by Government Decree No. 46 / 2005 Coll., Government Decree No. 341 / 2009 Coll. and Government Decree No. 461 / 2011 Coll., is amended as follows:
1. In Paragraph 2 (2) (a), "CZK 15 360" is replaced by "CZK 30 906."
2. in § 2 (2) (b), "17 140 CZK" is replaced by "34 488 CZK."
3. Paragraph 2 (3) reads as follows:
"(3) The amounts of the levy referred to in paragraph 2 (a) and (b) shall, as from 1 January 2016, be increased by 2% each calendar year compared to the year immediately preceding. ';
4. In Paragraph 4 (1) of the Introductory Part of the provision, the amount "CZK 3 000 000 'is replaced by" CZK 4 000 000'.
5. In Article 4 (4), the second sentence is replaced by the following: "The first contribution to the municipality shall be transferred by the Administration to its account no later than 120 days after the date of the decision; However, if the court has given the action against the administrative authority's decision a suspensive effect, the administration shall transfer the first contribution to the municipality's account no later than 30 days after the date of the end of the proceedings, unless the administrative authority's decision is annulled by the court. ';
Transitional provisions
1. For the contribution to the nuclear account paid to the producer of small amounts of radioactive waste pursuant to Government Decree No. 416 / 2002 Coll., as effective before the date of entry into force of this Regulation, incurred before the date of entry into force of this Regulation, as well as for the rights and obligations related thereto, Government Decree No. 416 / 2002 Coll., as effective before the date of entry into force of this Regulation shall apply.
2. The contribution provided for in Paragraph 4 (1) of Decree No 416 / 2002 Coll., as effective from the date of entry into force of this Regulation, belongs to the municipality for the first time for 2016. Municipality that has been transferred for 2015 pursuant to § 4 (1) of Decree No. 416 / 2002 Coll., as effective before the date of entry into force of this Regulation, shall transfer by 31 December 2015 an amount corresponding to the difference between the amount of the contribution referred to in § 4 (1) of Decree No. 416 / 2002 Coll., as effective before the date of entry into force of this Regulation, and the amount of the contribution referred to in § 4 (1) of Decree No. 416 / 2002 Coll., as effective from the date of entry into force of this Regulation.
3. The management of radioactive waste storage sites shall inform the municipality of the adjusted amount of the contribution within 1 month of the date of entry into force of this Regulation, which is to be granted a contribution from the nuclear account pursuant to Article 4 (1) of Decree-Law No 416 / 2002 Coll., as effective from the date of entry into force of this Regulation.
Efficacy
This Regulation shall take effect on 20 December 2015.
