DECLARATION
of 22 November 2010
on emission limits and other conditions for the operation of other stationary sources of air pollution by emiting and consuming volatile organic substances and on how products containing volatile organic substances are handled
According to Article 55 (2) of Act No. 86 / 2002 Coll., on Air Protection and on the amendment of certain other laws (Act on Air Protection), as amended by Act No. 385 / 2005 Coll., Act No. 212 / 2006 Coll., Act No. 180 / 2007 Coll., Act No. 25 / 2008 Coll. and Act No. 483 / 2008 Coll., ("the Act ') for implementation of § 3 (11), § 4 (12), § 5 (12) and § 12 (5) Act:
Subject matter
This decree implements the relevant provisions of the European Community1) and provides for:
(a) the specific emission limits and conditions for the operation of other stationary sources of air pollution listed in Annexes 1 and 4 to this Ordinance on volatile organic substances in processes using these substances (hereinafter referred to as "the source"), the criteria determining the fulfilment of these conditions and the method of classifying resources into each category;
(b) the method of handling products containing volatile organic substances and the time limits for achieving these requirements;
(c) the principles and formalities for recording and balancing the consumption of volatile organic substances and the extent of the data monitored to balance the consumption of volatile organic substances; and
(d) the details and manner of processing of the reduction plan for volatile organic substances and the group of sources for which the plan is being processed.
Basic concepts
For the purposes of this decree:
(a) waste gas - the final gaseous waste containing pollutants collected into the air by a chimney, by fire or discharge from an emission control device;
(b) fugitive emissions - any emissions of volatile organic substances into air, soil and water not forming part of waste gases;
(c) total emissions - sum of fugitive emissions and emissions of volatile organic substances in waste gases;
(d) organic solvent - any volatile organic substance which is used alone or in a mixture with other substances without undergoing chemical change, for the dissolution of raw materials, products or waste, or which is used as a detergent for the dissolution of pollutants, as a lubricant, as a dispersant, as a device used to adjust viscosity or surface tension, as a plasticiser or as a protective agent;
(e) total organic carbon - carbon contained in volatile organic substances;
(f) halogenated volatile organic substance - volatile organic substance containing at least one atom of bromine, chlorine, fluorine or iodine in each molecule,
(g) consumption of organic solvents - the total input of organic solvents into the source for a calendar or current year, reduced by all organic solvents that have been regenerated for reuse as input in the operation of the source;
(h) the consumption of volatile organic substances - the total input of volatile organic substances into the source per calendar year or in the current year, reduced by all volatile organic substances that have been regenerated for reuse as input in the operation of the source;
(i) the consumption of powder plastics - the total input of powder plastics into the source for a calendar or current year, reduced by all powder plastics that have been regenerated for reuse as input in the operation of the source;
(j) planned consumption - the maximum consumption that can be achieved in the continuous operation of the resource under specified conditions and which, including the specified conditions, is listed in the project documentation of the construction on the basis of which opinions and permits have been issued pursuant to § 17 of the Act or integrated authorisation under the Integrated Prevention Act (2);
(k) balancing the consumption of volatile organic substances - determining the annual mass balance of volatile organic substances;
(l) gasoline - any petroleum product, with or without additives, which is intended for use as a motor vehicle fuel, excluding liquid propanbutane, and whose saturated vapours have a pressure equal to or greater than 1,32 kPa at 20 ° C;
m) mobile container - tank for the transport of petrol by road, rail or waterway from one terminal to another or from the terminal to the service station,
(n) terminal - equipment for storage and filling of petrol in mobile containers, including technological accessories on site,
(o) filling equipment - any equipment in the terminal for filling petrol in mobile containers,
(p) service stations - equipment for the issue of petrol from stationary storage tanks to fuel tanks of motor vehicles,
(q) coating - any mixture, including transparent varnishes and any organic solvents or mixtures containing organic solvents necessary for its correct use, to produce film with decorative, protective or other functional effect on a specific surface;
(r) a product with a limited content of volatile organic substances - the product listed in Part I of Annex 5 to this Decree,
(s) placing on the market - making the product available to third parties or importing the product into the Czech Republic.
Volatile organic substances
For the purposes of this Decree, volatile organic substances are divided into:
(a) volatile organic substances classified as carcinogenic, mutagenic and toxic for reproduction and assigned to the hazard statements H340, H350, H350i, H360D or H360F with the exception of petrol;
(b) volatile organic substances classified as carcinogenic, mutagenic and toxic for reproduction and assigned risk phrases R45, R46, R49, R60 or R61 with the exception of petrol;
(c) halogenated volatile organic substances assigned to the hazard statements H341 or H351;
(d) halogenated volatile organic substances to which risk phrases R40 or R68 are assigned;
(e) petrol and volatile organic substances not falling within points (a) to (d).
Source categorisation
(1) The source category set out in Annex 1 to this Decree is determined on the basis of the proposed consumption of organic solvents, unless otherwise specified.
(2) The source category referred to in point 9 of Annex 1 to this Decree is determined on the basis of the projected consumption of volatile organic substances.
(3) The category of source referred to in point 4.4 of Annex 1 to this Decree is determined on the basis of the intended consumption of powder plastics.
(4) The source listed in Annex 1 to this Decree, which uses volatile organic substances pursuant to § 3 (a), (b), (c) or (d), is a major source, with the exception of that referred to in point 2.1 (2) of Annex 1 thereto.
(5) The one-off activity referred to in points 2.2.1 (2) and 4.1.1. (4) of Annex 1 to this Decree is a small resource.
(6) The terminal is a major resource.
(7) Gas stations and their storage tanks are a medium source.
(8) For the purposes of categorisation and determination of emission limits, the proposed parameters determining the classification of the resource in the relevant category shall be added when the resources listed under the same point in Annex 1 to this Regulation are located in the same establishment (3). If the point is subdivided into subpoints, the point within the meaning of the previous sentence shall be each subpoint.
Emission limits and reduction plan for volatile organic substances
(1) The source set out in Annex 1 to this Decree fulfils:
(a) the emission limit for volatile organic substances in waste gas and the emission limit for fugitive emissions set out for the source in Annex 1 to this Decree, unless otherwise specified in Annex 1 to this Decree; or
(b) the emission limit of the total emissions or the specific production emission set out for the source in Annex 1 to this Regulation, unless otherwise specified in Annex 1 to this Regulation; or
(c) a reduction plan for volatile organic matter emissions as set out in Annex 2 to this Decree, if imposed by the regional authority's operator pursuant to § 5 (6) of the Act.
(2) The source set out in Annex 1 to this Decree meets the emission limit for solid pollutants set out in Annex 1 to this Decree.
(3) The source referred to in Annex 1 to this Ordinance emitting volatile organic substances referred to in § 3 (a) or (b) shall not exceed, at a total mass stream of emissions of these pollutants of more than 10 g / h, the total mass concentration of these pollutants of 2 mg / m3 at a pressure of 101,325 kPa and a temperature of 0 ° C ("normal conditions") in wet gas. This shall be determined by measuring the mass concentration of all individual volatile organic substances referred to in § 3 (a) or (b), the sum of the measured concentrations not exceeding the emission limit referred to in this paragraph.
(4) The source listed in Annex 1 to this Ordinance emitting volatile organic substances referred to in § 3 (c) or (d) shall not exceed a total mass stream of emissions of these pollutants of more than 100 g / h at a total mass concentration of 20 mg / m3 of these pollutants under normal wet gas conditions. This shall be determined by measuring the mass concentration of all individual volatile organic substances referred to in § 3 (c) or (d), the sum of the measured concentrations not exceeding the emission limit referred to in this paragraph. This emission limit shall not apply to the sources listed in point 3 of Annex 1 to this Decree.
(5) For a terminal whose storage facility is equipped with a stage I petrol vapour recovery system as set out in Annex 4 to this Decree, the emission limit of 150 mg / m3 determined as the mass concentration of volatile organic substances, excluding methane, expressed as total organic carbon in wet waste gas under normal conditions is determined on the basis of the design of the Stage I petrol vapour recovery system.
Conditions for the operation of resources
(1) Where two or more of the resources listed in Annex 1 to this Decree are located within one establishment for which this decree provides for the fulfilment of emission limits, the following shall be:
(a) for substances referred to in § 3 (a) to (d), the requirements set out in § 5 (3) and (4) for each individual source are met separately;
(b) for substances referred to in § 3 (e)
(i) the requirements referred to in Article 5 (1) are met separately for each individual source; or
(ii) total emissions from given sources below what would have to be observed if point (i) was applied.
(3) The medium and large source operator referred to in Annex 1 to this Regulation processes the annual mass balance of volatile organic substances referred to in Annex 3 to this Regulation, with the exception of the source referred to in point 4.4 of Annex 1 to this Regulation.
(4) The basis required for the purposes of Section 12 (1) (b) of the Act is the record of the consumption of organic solvents or volatile organic substances.
(5) The technical conditions for the operation of service stations replacing emission limits are set out in Annex 4 to this Decree.
(6) The source operator referred to in Annex 1 to this Decree, using volatile organic substances referred to in § 3 (a) or (b) or mixtures containing such substances, is permanently replacing those substances or mixtures containing less harmful substances or mixtures where technically and economically feasible.
Method of handling products containing volatile organic substances
(1) Products with a limited content of volatile organic substances may be placed on the market only if the content of volatile organic substances in these products does not exceed the values set out in Part II of Annex 5 to this Decree; This is without prejudice to paragraph 2.
(2) The maximum levels for the content of volatile organic substances in products with a limited content of volatile organic substances and the time limits for their fulfilment set out in Part II of Annex 5 to this Regulation shall not apply to products sold for exclusive use in the sources listed in Annex 1 to this Regulation which have been granted a permit to operate under Section 17 (1) (d) of the Act or an integrated authorisation under the Integrated Prevention Act and which are intended to meet emission limits or a plan to reduce emissions of volatile organic substances.
(3) When placed on the market, products with a limited content of volatile organic substances shall bear a label indicating:
(a) the product categories and sub-categories referred to in Part II of Annex 5 to this Regulation;
(b) the maximum levels for volatile organic matter content in g / l, as set out in Part II of Annex 5 to this Decree; and
(c) the maximum content of volatile organic substances in the product in ready-to-use state in g / l.
(4) For products with a limited content of volatile organic substances to which organic solvents are to be added for further use, the maximum levels for volatile organic matter content set out in Part II of Annex 5 to this Regulation apply to the product in its state of use. For products with a limited content of volatile organic substances, the weight of volatile organic substances which, during drying, react chemically as a protective film of coating is not considered to be part of the volatile organic matter content.
(5) Products containing more than 3% by weight of volatile organic substances which are used in the activities listed in Annex 1 shall, when placed on the market, bear the information necessary to maintain the annual mass balance of organic solvents referred to in point 1 of Annex 3 to this Regulation on the label or accompanying technical documentation.
Transitional provisions
Products with a limited content of volatile organic substances listed in category A of Part I of Annex No 5 to this Regulation which do not comply with the maximum permitted levels of volatile organic matter content listed in Table A of Part II of Annex No 5 to this Regulation and which have been produced before that date may be placed on the market until the end of 2010 at the latest.
Repeal
They shall be deleted:
1. Decree No. 355 / 2002 Coll., laying down emission limits and other conditions for the operation of other stationary sources of air pollution emitted by volatile organic substances from processes applying organic solvents and from the storage and distribution of petrol.
2. Decree No. 509 / 2005 Coll., amending Decree No. 355 / 2002 Coll., laying down emission limits and other conditions for the operation of other stationary sources of air pollution emitting volatile organic substances from processes applying organic solvents and from the storage and distribution of petrol.
Efficacy
This Decree shall take effect one month from the date of its publication, with the exception of the provisions of Paragraph 6 (2), which shall take effect 24 months from the date of its publication.

Annex No 1 to Decree No 337 / 2010 Coll.
Category, emission limits and technical conditions of operation of resources
(a) TOC - total organic carbon.
(b) VOC - volatile organic substance.
(c) TZL - solid pollutants.
(d) The TOC emission limit set out in this Annex shall mean the mass concentration of volatile organic substances expressed as total organic carbon in wet waste gas under normal conditions.
(e) The VOC emission limit set out in this Annex shall mean the mass concentration of volatile organic substances in wet waste gas under normal conditions.
(f) The TZL emission limit set out in this Annex shall mean the mass concentration of solid pollutants in wet waste gas under normal conditions.
(g) The emission limit of the fugitive emissions set out in this Annex is expressed as a percentage of the mass of the fugitive emissions and the mass of the input organic solvents.
(h) The emission limit for total emissions as set out in this Annex shall be expressed as a percentage of the total emissions and mass of input organic solvents.
(f) The term "activity" used in this Annex also includes cleaning of process equipment and cleaning of work spaces, but does not include cleaning of products, unless otherwise specified.
1. Polygraphy
The printing activities in sub-paragraphs 1.1 - 1.4 include the processes and operations of reproduction of text or image using a printing form of image or text and where printing colours are transferred to any type of surface. These activities also include related processes, the production of the printing form and its transmission, laminating, painting and painting.
Printing ink means a mixture, including all organic solvents or mixtures containing organic solvents necessary for their correct use, which is used to print text or image on a specific surface.

2. Finishing and cleaning of surfaces
Any process in which organic solvents are used to remove pollution from the surface of materials, to de-lubricate or clean production semi-finished products, to remove coatings, to de-paint and other coating shall be included under the activities under sub-points 2.1 and 2.2.
These activities shall not apply to the chemical treatment listed as a separate activity in point 3. Furthermore, these activities do not apply to cleaning of work premises and cleaning of processing equipment which falls under the activity in which such cleaning is carried out.
2.1. Lubricating and cleaning of surfaces by products containing volatile organic substances pursuant to § 3 (a), (b), (c) or (d)
Such activities shall not be carried out outside installations equipped with a vapour capture system with the recycling of organic solvents.

Removing and cleaning of surfaces may be carried out in specified areas, in particular using descaling tables or similar equipment where technically possible. The organic solvents used are collected, stored and transmitted for further use or disposal.
2.2.1. Disposable descaling and cleaning activities which are carried out outside the premises of desalination or paint shops due to excessive size of the treated surfaces
Disposable de-lubrication and cleaning activities which, due to excessive size of de-lubricated surfaces, are carried out outside the premises of defrosting plants or varnishes and whose consumption of organic solvents is higher than 0,1 tonnes are categorised as a small source.
The following operating conditions must be complied with: the average content of organic solvents in all cleaning products used never exceeds 30% by weight where technically possible and the organic solvents containing volatile organic substances referred to in § 3 (a), (b), (c) or (d) of this Decree are not used. The organic solvents used are collected, stored and transmitted for further use or disposal.
3. Chemical cleaning
Activities using organic solvents in equipment for cleaning clothing, furniture and small consumables, excluding manual removal of stains and contaminated sites in the textile and clothing industries, which are classified under the activities referred to in points 2.1 and 2.2 of this Annex.
These devices shall be equipped with a vapour capture system with complete recycling of organic solvents.

4. Application of coatings
Any activity involving simple or multiple application of continuous film coatings to different types of surfaces.
Where the application of coatings involves an operation in which the same product is printed by any printing technology, that printing operation shall be considered as part of the coating. However, separate printing activities are not included in those activities.
4.1. Application of coatings, including cataphoretic coating, unless they fall under the activities referred to in points 4.2 to 4.7.

(2) If the specific production emissions cannot be technically and economically achieved or if the size of the treated surface cannot be technically determined, the TOC emission limit of 50 mg / m3 shall not be exceeded in any of the effluents for waste gas from individual spaces - application, extraction, drying, burning.
(3) The emission limit for fugitive emissions shall also apply in the case of compliance with a specific production emission.
4) Applies to waste gas ventilated from the application, extraction, drying or burning area.
4.1.1. Disposable application activities of paint coating that are carried out outside the paint shop premises due to excessive size of coated surfaces
Disposable activities of coating applications such as painting of large parts outside the factory premises or painting on indoor or outdoor surfaces, in particular on buildings, structures, mast, etc., whose consumption of organic solvents is higher than 0,1 tonne, are categorised as a small source.
The following operating conditions must be complied with in these activities: the emission of volatile organic substances should be reduced by using coatings with reduced organic solvents. Paints are usually applied by rolling or brush. When coating is applied by spraying, the spray should be reduced by applying an appropriate spray technology with a transfer efficiency greater than 50%.

4.3. Spraying of vehicles - repair
Any activity involving the single or multiple application of continuous film and related de-lubrication operations
(a) the coating of road and rail vehicles or parts thereof carried out as part of the repair, preservation or decoration of the vehicle outside the original production facility;
(b) the application of original coatings to road and rail vehicles or parts thereof, using products intended for spraying vehicles which are carried out outside the original production facility;
(c) painting of trailers (including semi-trailers),
(d) paints in the manufacture of new road and rail vehicles designed for the consumption of organic solvents of less than 15 tonnes per year.

4.7. Paintings for the manufacture of new road and rail vehicles
The coating surface size is defined as:
(a) the surface area, calculated as the sum of the total size of the surface with an electrophoretically applied coating layer and the size of the surfaces of all parts connected to the product at the subsequent stages of production which are coated with the same coating system; or
(b) the total size of the surface of the product coated with coatings in the installation.
The size of the surface provided with an electrophoretically applied coating layer is calculated from the relation:
[2 x bodywork weight] / [average sheet thickness x sheet material density]
This method can also be used for other sheet metal products. Software systems or other equivalent methods may also be used to calculate the total surface size of the product provided with a coating layer on the device. The unit for calculating the surface size is m2.
