amending Decree No. 12 / 1999 of the National Security Office Coll., on ensuring the technical security of classified information and certification of technical means
According to Articles 50 (4) and 53 (3) of Act No. 148 / 1998 Coll., on the protection of classified information and on the amendment of certain laws, as amended by Act No. 164 / 1999 Coll.:
Decree No. 12 / 1999 Coll., on ensuring the technical security of classified information and certification of technical means, is amended as follows:

Subject matter
This Decree lays down the method of using technical means to protect classified information, certification of technical means and the formalities for certificates. ';
2. paragraphs 2 and 3, including footnote 1, shall be deleted;
3. Article 4, including the title and footnotes No 1a) and (1b) shall read as follows:
Certification of technical means
(1) Certification of technical means is a process of verifying the conformity of technical means intended to protect classified information with the Office's safety standards. The definition and different types of technical means are laid down in specific legislation. (1a)
(2) For the certification of a technical device, the applicant shall submit the following documents:
(a) an application for certification of a technical device bearing a list of documents;
(b) specification of technical means and user environment;
(c) an indication of the required category of technical means under Section 5 of this Decree;
(d) a declaration of the safety or conformity of the technical device;
(e) a declaration of the same composition and implementation of the technical means;
(f) an opinion issued by the designated organisation. (1b)
(3) With the documents referred to in paragraph 2, the applicant shall also provide the technical means to be certified if the Office so requests.
(4) The technical device certificate, the model of which is set out in the Annex, contains:
(a) the identification number of the technical device certificate;
(b) the unique type of identification of the device;
(c) details of the manufacturer of the technical device;
(d) details of the holder of the technical device certificate;
(e) the classification level for which the competence of a technical device has been approved pursuant to Article 5 of this Decree;
(f) the period of validity of the technical device certificate;
(g) the date of issue of the technical device certificate.
(5) The Office may be requested to issue a new certificate of technical means at least 30 days before its expiry.

4. In Article 5 (1), the words "the importance of an object of protected interest 'are replaced by the words" the classification of classified information used to protect it';
5. in Article 5 (1) (a), the designation of category "D" is replaced by "V."
6. in Article 5 (1) (b), "C" is replaced by "D"; "
7. In Article 5 (1) (c), "B 'is replaced by" T'.
8. in Article 5 (1) (d), the designation of category "A" is replaced by "PT."
9. In Article 5 (2), the words "shall be published 'shall be replaced by the words" shall be published on an ongoing basis'; the sentence shall be deleted after the words "technical means' and the remainder shall be deleted.
10.
The use of different categories of technical means in ensuring the protection of objects and secure areas within the scope of object security shall be laid down in a specific regulation. 1a) '.
Article 11 (7) and (8) shall be deleted.
12. In the Annex, under the heading of the model certificate, the words "THE NATIONAL SECURITY AUTHORITY OF THE CZECH REPUBLIC 'are replaced by the words" THE NATIONAL SECURITY AUTHORITY'.
This decree shall take effect on the day of its publication.
