GOVERNMENT REGULATION
of 14 June 2006
on the conditions for providing special prices for publicly available telephone services
The Government orders pursuant to Sections 38 (4) and 43 (5) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (Act on Electronic Communications), as amended by Act No. 310 / 2006 Coll., hereinafter referred to as "the Act ':
Low income and special social needs
A person with low income and a person with special social needs shall be a participant or a user (1) who has been continuously for at least 6 months or for a total period of at least 6 months during the 12 months preceding the date on which the certificate referred to in Article 2 was issued, and is still the recipient of the social welfare benefit provided for social needs or the person assessed jointly (2) for the purpose of granting the social welfare benefit.
Documents to be provided by a low-income person and a person with special social needs
(1) A low-income person and a person with special social needs shall be shown to the universal service provider by submitting a certificate issued by an authorised municipal authority which is not more than one month old. The universal service provider may obtain a copy of this certificate.
(2) The certificate issued by the entrusted municipal authority referred to in paragraph 1 shall cease to be valid one year from the date on which it was issued and the date on which the facts which are evidenced by this certificate change.
(3) The model of the certificate referred to in paragraph 1 shall be as set out in the Annex to this Regulation.
Documents to be provided by a natural person to a universal disability service provider
The natural person shall demonstrate the disability under Paragraph 43 (4) of the Act by the following documents, which he submits to the universal service provider for inspection:
(a) in the case referred to in Section 43 (4) (a) of the Law, by means of a ZTP3 licence and by decision of the municipal authority of the municipality with extended scope for granting the exceptional advantages of Class II under the special legislature4) because of complete or practical deafness;
(b) in the case referred to in Section 43 (4) (b) of the Act, by means of a ZTP / P licence and by decision of the municipal authority of the municipality with extended scope for granting exceptional advantages at level III (5);
(c) in the case referred to in Article 43 (4) (c) of the Act, by decision granting an increase in the pension for helplessness; If a minor is involved, the participant in whose personal care the minor is a minor shall provide proof that he is the parent of that person or the decision of the competent authority on the basis of which he personally looks after that person (6),
(d) in the case referred to in Article 43 (4) (d) of the Act, the documents referred to in (a) or (b) issued to a minor who is raised or personally cared for by a participant; the participant in whose personal care the minor is present proof that he is the parent of that person or the decision of the competent authority on the basis of which he or she nurtures or personally looks after that person (6).
The special price for persons referred to in § 38 (3) of the Act shall be such that the loss incurred by the provider by this special price and attributable to the person referred to in § 1 who is a participant and the month shall not exceed CZK 200. If that person demonstrates more than one reason, he shall be entitled to only one discount and only one universal service provider.
The universal service provider, which provides special prices pursuant to § 38 (3) of the Act, keeps for the purposes of checking the drawing of a price advantage a list of persons who have claimed a discount, a list of persons to whom the discount was granted, including the amount of the discount granted and the period during which the discount was granted.
Efficacy
This Regulation shall enter into force on 1 July 2006.

Confirmation for a person with low income and a person with special social needs to award a special prize pursuant to § 2 of Government Decree No. 336 / 2006 Coll., on the conditions for providing special prices for publicly available telephone services
1) § 2 (a) and (b) of Act No. 127 / 2005 Coll., on electronic communications and on the amendment of certain laws (Act on electronic communications), as amended.
2) Article 4 of Act No. 463 / 1991 Coll., on Life Minimum, as amended.
3) Section 86 of Act No. 100 / 1988 Coll., on Social Security, as amended. § 31 of Decree No. 182 / 1991 Coll., implementing the Act on Social Security and the Act of the Czech National Council on the jurisdiction of the institutions of the Czech Republic in Social Security, as amended.
4) Point 2 (i) of Annex No 2 to Decree No. 182 / 1991 Coll., implementing the Act on Social Security and the Act of the Czech National Council on the competence of the institutions of the Czech Republic in Social Security, as amended.
5) Point 3 of Annex 2 to Decree No. 182 / 1991 Coll., implementing the Act on Social Security and the Act of the Czech National Council on the competence of the Czech authorities in Social Security, as amended.
6) Paragraph 7 (12) (a), (b), (d) or (e) of Act No. 117 / 1995 Coll., on State Social Aid, as amended.
