GOVERNMENT REGULATION
of 8 November 2023
amending Government Regulation No. 428 / 2021 Coll., on the permissible level of public support in the cohesion regions of the Czech Republic
The Government orders pursuant to § 6 (3) of Act No. 72 / 2000 Coll., on Investment Incentives and on the amendment of certain laws (Act on Investment Incentives), as amended by Act No. 19 / 2004 Coll. and Act No. 210 / 2019 Coll.:
Government Regulation No. 428 / 2021 Coll., on the permissible level of public support in the cohesion regions of the Czech Republic, is amended as follows:
1. In Article 2 (1), "EUR 50 000 000 'is replaced by" EUR 55 000 000' and "EUR 100 000 000 'is replaced by" EUR 110 000 000'.
2. Paragraph 3 (1) reads as follows:
"(1) If the eligible costs exceed EUR 110 000 000 and the maximum amount of public aid for an investment operation exceeds the amount
(a) EUR 33 000 000 000 in cohesion regions where the public aid intensity for an investment action referred to in Article 1 is 40%;
(b) EUR 24 750 000 in cohesion regions in which the public aid intensity for an investment operation referred to in Article 1 is 30%;
(c) EUR 20 630 000 in cohesion regions in which the public aid intensity for an investment action referred to in Article 1 is 25%;
(d) EUR 16 500 000 in cohesion regions in which the public aid intensity for an investment operation referred to in Article 1 is 20%; or
(e) EUR 12 380 000 in cohesion regions in which the public aid intensity for an investment operation referred to in Article 1 is 15%;
public support may be granted only after prior approval by the European Commission. ';
3. Paragraph 3 (2) is deleted.
Paragraph 3 shall become paragraph 2.
4. In Article 3 (2), the words "paragraphs 1 and 2 'are replaced by the words" paragraphs 1'.
5. In Article 5, the word "started 'is replaced by" related to the same or similar activity that has begun'.
6. At the end of § 5, the sentence "Same or similar activity means activities classified in the same class of Classification of Economic Activities (CZ- NACE)."
Efficacy
This Regulation shall take effect on 1 January 2024.
