On 7 June 2016, the Constitutional Court decided under sp. zn. Pl. ÚS 4 / 16 in plenary composed of the President of the Court of Paul Rychetský and the Judges Louis David, Jaroslav Fenyk, Josef Fiale, Jan Filip, Jaromír Jirsy, Tomáš Lichovník, Jan Musil, Vladimir Sládeček, Radovan Suchánek, Kateřina Šimáková (Judge of the Rapporteur), Vojtětěch Šimíček, Milady Tomková, David Uhír and Jiří Zemánek, on the proposal of the Ministry of the Ministry of the Interior for the abolition of the peace of the city of the shorter duration, and they define the activities which could distort the public policy in the municipality, including the limitation of local public policy,
as follows:
Article 2 (2) (e) of the generally binding Order of the City of Hrastav No 2 / 2014 to safeguard local public order matters in public areas setting out a shorter time of night rest, exceptional cases in which the decision may define a shorter time of night rest and define activities likely to disturb public order in the municipality, including restrictions on such activities, shall be deleted from the date of the publication of this finding in the Collection of Laws.
