amending Decree No. 129 / 2012 Coll., on details of the marketing of seed and planting plants, as amended
The Ministry of Agriculture shall determine pursuant to § 3 (14), § 3a (11), § 3b (7), § 5 (8), § 7 (6), § 7a (5), § 15 (6), § 16 (12), § 17 (16), § 19 (17) and § 19a (6) of Act No. 219 / 2003 Coll., on the putting into circulation of seeds and propagating plants and on the amendment of certain laws (Act on the circulation of seeds and propagating plants), as amended by Act No. 178 / 2006 Coll., Act No. 96 / 2009 Coll., Act No. 223 / 2009 Coll., Act No. 331 / 2010 Coll., Act No. 54 / 2012 Coll., and Act No. 295 / 2017 Coll.:
Decree No. 129 / 2012 Coll., on the details of the marketing of seeds and propagating plants, as amended by Decree No. 409 / 2013 Coll. and Decree No. 368 / 2015 Coll., is amended as follows:
1. In footnote 1, the sentence "Commission Directive 2010 / 21 / EU of 12 March 2010 amending Annex I to Council Directive 91 / 414 / EEC as regards specific provisions concerning clothianidin, thiamethoxam, fipronil and imidacloprid. 'is deleted and the words" Commission Implementing Directive (EU) 2016 / 11 of 5 January 2016 amending Annex II to Council Directive 2002 / 57 / EC on the marketing of seed of oil and fibre plants are added to the separate lines. Commission Implementing Directive (EU) 2016 / 317 of 3 March 2016 amending Council Directives 66 / 401 / EEC, 66 / 402 / EEC, 2002 / 54 / EC, 2002 / 55 / EC, 2002 / 56 / EC and 2002 / 57 / EC as regards the official label of seed packages. Commission Implementing Directive (EU) 2016 / 2109 of 1 December 2016 amending Council Directive 66 / 401 / EEC as regards the inclusion of new species and the botanical name of Lolium x boucheanum Kunth.'
2. in Paragraph 10 (1) (b):
"(b) the name of the species and the name of the variety, in the case of beet, the indication whether it is fodder beet or sugar beet; the name of the species shall be indicated in the case of cereal seed, oil seeds, fibre plants, grasses, legumes, clover plants and other fodder crops, at least by the botanical name of the species, where appropriate in short and without the authors' names, in the case of sugar beet, fodder beet and vegetables, sufficient to indicate the name of the species by the Czech name, ';
3. In Article 10, at the end of paragraph 1, the dot is replaced by a comma and the following point (j) is added:
"(j) the serial number of the seed declaration with an uncompleted certification."
4. In the text under the group heading "Vegetable seedlings' above Section 19, the words" Sections 15 (6) and 19 (15) 'are replaced by the words "Sections 3 (14) (f), 15 (6) and 19 (17)'.
5. In Article 19, at the end of paragraph 1, the sentence "The requirements and procedures for the production, recognition, packaging, labelling and putting into circulation of garlic seed are set out in Annex 22 to this Decree."
6. Paragraph 24 (7), including footnote 3, reads:
"(7) The labelling requirements for seed packaging with information on the plant protection product used are laid down in other legislationm3).
(3) Regulation (EC) No 1107 / 2009 of the European Parliament and of the Council of 21 October 2009 concerning the placing of plant protection products on the market and repealing Council Directives 79 / 117 / EEC and 91 / 414 / EEC. ';
7. In Article 25 (5), at the end of the text in point (h), the dot is replaced by a comma and the following point (i) is inserted:
"(i) the serial number of the label.";
8. In Article 25, paragraph 6 is added:
"(6) On official labels of cereal seed, oil seeds, fibre plants, grasses, clover, leguminous vegetables, other fodder crops and seed potatoes, with the exception of official labels of mixtures of cereals, grasses, leguminous plants, clover plants and other fodder crops, the name of the species shall be given at least by the botanical name of the species, where appropriate in short and without the names of the authors. On the labels of sugar beet, fodder beet and vegetables and on the labels of the supplier of the crops referred to in the first sentence of this paragraph, it is sufficient to indicate the name of the species by the Czech name. '
9. In Annex No 2, Part I, Table 1, column "Latin name 'in the row" Hybrid ryegrass' is replaced by "Lolium x hybridum Hausskn '.
10. In Annex 5, Part III, Section 3, Subsection 4, points 2 and 3:
'2. For seed of hybrid varieties of rape of category E produced using pollen sterility, the minimum varietal purity of the parent component is 99,0% and the paternity component 99,9% respectively.
3. The minimum varietal purity of hybrid varieties (% hybrids) of seed of category C rape produced using pollen sterility is 90,0% for winter varieties and 85,0% for spring varieties. It shall be checked on official samples taken by official post-vegetation examination or by appropriate biochemical methods. ';
11. In Annex 7, the underlined names of Parts I, II and III are deleted.
12. In Annex 7, Part II, Section 1, the title of Section 1 and Table 2 are as follows:

14. In Annex No 8, Part V, Section 3, Subsection 1, Table 5.3, the column "Harmful organism 'in the row" Fazle' is replaced by the following:

15. In Annex 9, in the model form referred to in point (b), the words "pursuant to Section 13 of Act No. 326 / 2004 Coll., on Phytosanitary Care and on the amendment of certain related acts, as amended," shall be inserted after the words "Checks."
16. in Annex 9, the model form referred to in point (f) of the record of the result of the potato crop inspection shall be:
"'.
17. In Annex 9, in the model form referred to in point (n), the words "for non-final consumers' shall be added to the application for registration of persons after the words" putting propagating material into circulation '.
18. In Annex 10, the title of the Annex reads: "Model documents issued by the authorised person 'and the names and models of documents referred to in points (a), (c), (d), (f), (g), (h), (i), (j), (k) and (l) are deleted. Points (b), (e) and (m) shall be renumbered as points (a) to (c) and the words" (for the delegate)' shall be deleted.
19. In Annex No 10, the "model statement of seed with an uncompleted certification 'is:

21. In Annex No 17, the words "Applicant: 'shall be replaced by the words" Applicant (name, surname and place of permanent residence) in the "Applications for authorisation to carry out seed shows and to issue documents for crops' in the first row of the table. '
22. In Annex 18, in the "Applications for sampling authorisations', in the first row of the table, the word" Applicant: 'is replaced by "Applicant (name, surname and place of residence):'.
23. In Annex No 20, point 2 is deleted.

Crop health
1. Harmful organisms which are prohibited from being introduced and spread within the territory of the European Community1) shall not be present.
2. Material showing visible signs of infection at harvest shall be treated or disposed of in an appropriate manner.
3. The propagation crop shall be visually free from the harmful organisms listed in the table below and shall not show symptoms of infestation by such organisms.

Label
The official label of garlic seed category breeding material, pre-stage propagating material, basic propagating material or certified propagating material shall include the following:
1. marking "EU Quality"
2. the designation of the Constitution and the Czech Republic or their abbreviations
3. the supplier's designation and registration number
4. the batch number of garlic seed put into circulation
5. categories and generations
6. date of issue of the label
7. name of species
8. name of variety
9th Latin name of genus and vegetable species, if the label is also a plant passport under the Plant Health Act
10. net weight or number of pieces
11. on imports from third countries, indication of the country of origin
12. label number
13. data on possible additional planting adjustment
The label of the supplier of garlic seed category standard seed shall contain the following information:
1. marking "EU Quality"
2. the supplier's designation and registration number
3. the batch number of garlic seed put into circulation

8. Latin name of genus and vegetable species, if the label is also a plant passport under the Plant Health Act

Small pack
Maximum authorised size of small package of garlic seed
The maximum authorised size of a small package of garlic is 1 kg or 35 onions of garlic.
Labelling of small packages
The supplier's label or the packaging printing on a small package of garlic seed contains the following information:
(a) name of species
(b) variety denomination
(c) category and generation designation
(d) lot number
(e) supplier's designation and registration number
(f) net weight or number of pieces
(g) details of any additional modification of the seed '.
Technical Regulation
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
Efficacy
This Decree shall take effect on 1 November 2017, with the exception of Article I (9) as regards Annex 2, which shall take effect on 1 January 2018.
