amending Government Regulation No 76 / 2015 Coll., on the conditions for implementing organic farming measures, as amended, and Government Regulation No 74 / 2015 Coll., on the conditions for granting subsidies for animal welfare measures, as amended
The Government orders pursuant to § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll., and pursuant to § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act No. 179 / 2014 Coll. as amended by Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Amendment of the Government Regulation on the conditions for implementing organic farming measures
Government Regulation No. 76 / 2015 Coll., on the conditions for the implementation of organic farming measures, as amended by Government Regulation No. 113 / 2015 Coll., Government Regulation No. 64 / 2016 Coll., Government Regulation No. 236 / 2016 Coll., Government Regulation No. 18 / 2017 Coll., Government Regulation No. 49 / 2017 Coll., Government Regulation No. 29 / 2018 Coll., Government Regulation No. 43 / 2018 Coll. and Government Regulation No. 57 / 2019 Coll., are amended as follows:
1. Paragraph 2 (3) reads as follows:
"(3) The part of the soil block on which organic farming measures are not yet applied and not applied may be included in organic farming measures.
(a) follow-up measures for organic farming under Government Regulation No 331 / 2019 Coll., on the conditions for implementing the follow-up measure for organic farming,
(b) the measures provided for in Article 2 (a), (b) or (c) of Government Regulation No 75 / 2015 Coll., on the conditions for implementing agri-environmental climate measures and amending Government Regulation No 79 / 2007 Coll., or
(c) the measures provided for in Article 2 (a), (b) or (c) of Decree No. 330 / 2019 Coll., on the conditions for implementing the following agri-environmental climate measures. ';
2. In Article 2, the following paragraph 8 is added:
"(8) The application referred to in paragraphs 1 and 4 may not be submitted to the Fund for a period beginning in 2020 and thereafter. ';
3. In Article 3, the following paragraph 5 is added:
"(5) The application referred to in paragraph 1 may not be submitted to the Fund for a period beginning in 2020 and thereafter. ';
4. in Article 5 (4) (d), including footnote 5:
"(d) withdrawal or restriction of the right of ownership for construction or public interest measures (5),
5) For example, Act No. 183 / 2006 Coll., on Territorial Planning and Construction Regulations (Construction Act), as amended, Act No. 13 / 1997 Coll., on Road, as amended, Act No. 458 / 2000 Coll., on the Terms and Conditions of Entrepreneurship and the Enforcement of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended. "
5. In Article 11 (1) (a) of the final part of the provision, the words "or Articles 15 and 16 of the Government Regulation No 330 / 2019 Coll." shall be inserted after the words "Government Regulation No 75 / 2015 Coll.";
6. Paragraph 18 (3) and (4) read as follows:
"(3) The subsidy rate referred to in paragraph 1 (a) or paragraph 2 (a) shall be reduced by 32 EUR / 1 hectare if it is the proportion of the soil block located in the territory of the national park11), in the territory of the 1. protected landscape area zone (11), or in a vulnerable area in the territory defined under § 7 (11) of the first sentence of Government Regulation No 262 / 2012 Coll., on the determination of vulnerable areas and action programme; Where only part of the soil block is located in the territory of the national park (11) or, where appropriate, in the territory of the 1st protected landscape zone (11), the subsidy shall be reduced only on that part of the soil block. The reduction shall not apply in the territory of the national park where the applicant demonstrates that the part of the soil block is located in the built-up territory of the municipality or the stable area of the municipality.
(4) The subsidy provided for in Article 11, 12 or 13 shall not be granted if it is a part of a soil block, on which an application is also made for a subsidy under the measure of grubbing of arable land pursuant to Article 2 (e) of the Government Regulation No 75 / 2015 Coll., under the measure of grubbing up of the routes of concentrated effluent pursuant to Article 2 (h) of the Government Regulation No 75 / 2015 Coll., under the measure of maintenance of grubbed land block parts pursuant to Article 2 (e) of the Government Regulation No 330 / 2019 Coll. '
7. In Paragraph 18 (5), the words "point (c) (3) of Government Regulation No 79 / 2007 Coll. 'are replaced by the words" point (f) of Government Regulation No 330 / 2019 Coll.';
8. In Paragraph 18, the words "or pursuant to § 2 (g) of Decree No. 330 / 2019 Coll. 'shall be added at the end of paragraph 6.
9. In Paragraph 18, the following paragraph 9 is inserted after paragraph 8:
"(9) The subsidy provided for in paragraphs 1 and 2 shall not be granted for part of the part of the land block registered in the land use register for which the procedure under Section 3g (4) of the Agricultural Act has been applied. ';
Paragraphs 9 and 10 shall become paragraphs 10 and 11.
10. In paragraph 27, the following paragraph 2 is inserted after paragraph 1, including footnote 16:
"(2) If, during the duration of the commitment for the part of the soil block, agricultural management is prevented due to a change in the zonation of the national park16), the provisions on reductions, non-award or refund of the subsidy shall not apply.

Paragraphs 2 to 4 shall become paragraphs 3 to 5.
Transitional provision
Applications initiated under Government Regulation No. 76 / 2015 Coll., as effective before the date of entry into force of this Regulation, shall be completed under Government Regulation No. 76 / 2015 Coll., as effective before the date of entry into force of this Regulation.
Amendment of the Government Regulation on the conditions for granting subsidies on animal welfare measures
In Article 17 of the Introductory Part of Paragraph 14 of Government Regulation No 74 / 2015 Coll., on the conditions for granting subsidies on animal welfare measures, as amended by Government Regulation No 17 / 2017 Coll. and Government Regulation No 34 / 2018 Coll., the words "or, in the case of reporting for the last month of the commitment period, no later than 20 days after the end of the commitment period," are inserted after the words "commitment period,".
Transitional provision
The grant procedure initiated in 2018 and 2019 under Government Regulation No 74 / 2015 Coll., as effective before the date of entry into force of this Regulation, shall be completed under Government Regulation No 74 / 2015 Coll., as effective from the date of entry into force of this Regulation.
EFFECTIVE
This Regulation shall take effect on 1 January 2020.
