GOVERNMENT REGULATION
of 26 September 2012
amending Government Regulation No 112 / 2008 Coll., laying down certain conditions for granting national additional payments to direct aid, as amended
The Government mandates pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll.:
Government Regulation No. 112 / 2008 Coll., on certain conditions for granting national additional payments to direct aid, as amended by Government Regulation No. 480 / 2009 Coll., Government Regulation No. 86 / 2010 Coll. and Government Regulation No. 107 / 2012 Coll., are amended as follows:
1. In Articles 1 and 13 (4), the words "the European Communities' are replaced by the words" the European Union '.
2. In Paragraph 2 (2), "15 May 'is replaced by" 1 November'.
3. Paragraph 2 (3) is deleted.
4. In footnote 5, "Article 124 (1) 'is replaced by" Article 122 (1)'.
5. In Article 5 (2), the word "list 'is replaced by" total area' and the words "including the indication of their area 'are deleted.
6. in Article 6 (3) and (4) (a), the words "or, where appropriate, the dates of registration in the central register," shall be inserted after the word "birth."
7. In Articles 7 (1) and 8 (1), "1 to 31 July 'is replaced by" 1 to 31 December'.
8. In Articles 7 (1) and 8 (1), the words "kept under breeding law 'are deleted.
9. Paragraph 7 (2) reads as follows:
"(2) The applicant shall demonstrate to the Fund by 28 February of the following calendar year a document from the central register showing the condition of the ovine or caprine animals kept by the applicant for at least 1 to 31 December of the relevant calendar year, including the identification numbers and birth dates and, where appropriate, the dates of entry into the central register according to the data from the central register and the calculation of livestock units. ';
10.Paragraph 8 (2) reads as follows:
"(2) The applicant shall demonstrate to the Fund by 28 February of the following calendar year a document from the central register showing the state of suckler cows kept by the applicant for at least the period from 1 to 31 December of the relevant calendar year, including the identification numbers and dates of birth and, where appropriate, the dates of entry in the central register according to data from the central register and the calculation of livestock units. ';
11. footnote 20 reads:
"20) Government Decree No. 60 / 2012 Coll., laying down certain conditions for granting specific support to farmers."

Payment on agricultural land
(1) The applicant for payment on agricultural land may be the natural or legal person who made an application for a single area payment in the relevant calendar year pursuant to Article 3 of Government Regulation No 47 / 2007 Coll., laying down certain conditions for the granting of the single area payment for agricultural land and certain conditions for the provision of information on the processing of agricultural products originating in the land placed at rest.
(2) The Fund provides the applicant with a payment for agricultural land for which the applicant has requested and fulfilled the conditions for granting the single area payment for agricultural land in accordance with Article 4 of Government Regulation No 47 / 2007 Coll., laying down certain conditions for granting the single area payment for agricultural land and certain conditions for providing information on the processing of agricultural products originating in the land placed at rest. '
13. in Article 10 (1) and (2), "marketing year 2007 / 2008" is replaced by "marketing year 2011 / 2012";
14. in Paragraph 10 (1), "31 March 2007" is replaced by "31 March 2011."
15. in Article 10 (2), the word "copy" is replaced by the word "copy."
16. In Article 11, the words "by 30 November of the relevant Member State 'are replaced by the words" by 30 April of the following' and the words "by a regulation of the European Communities' are replaced by the words" directly applicable European Union regulation '.
17. In Article 12, paragraphs 3 to 5 are deleted.
Paragraphs 6 to 10 shall become paragraphs 3 to 7.
18. in Paragraph 12 (3) and (4), "31 July" is replaced by "at least for the period from 1 to 31 December."
19. In Section 12, the following paragraph 8 is added:
"(8) If the total amount of payments pursuant to § 5 to 10 to be granted to the applicant on the basis of his application is less than 500 CZK after a reduction under the European Union21 Code, the Fund shall not grant payment to the applicant.
21) Article 7, 10, 132 (2) (a) and (5) of Council Regulation (EC) No 73 / 2009, as amended. '
Efficacy
This Regulation shall enter into force on 15 October 2012.
