on measures to ensure protection against the introduction and spread of potato cancer, potato nematode and yellowish pWN
According to Section 88 (2) of Act No. 326 / 2004 Coll., on Phytosanitary Care and on the Amendment of Certain Related Acts (hereinafter "the Act '), the Ministry of Agriculture provides for the implementation of § 71 (1) (i) of the Act:
§ 1
Subject matter
This decree, in accordance with the law of the European Communities (1), sets out the measures to be applied in the Czech Republic against the introduction and spread of potato cancer (Synchytrium endobioticum (Schilb.) Perc.]
§ 2
Terms
For the purposes of this decree:
(a) cause of cancer - fungus [Synchytrium endobioticum (Schilb.) Perc.],
(b) host plants - potatoes (Solanum tuberosum L.),
(c) a suspicion of the occurrence of a cancer agent - a condition following the detection of symptoms of its presence on the host plant or in the soil lasting until the occurrence is confirmed or refuted by an objective expert investigation;
(d) expert investigation - verification of the occurrence of cancer, including the verification of its pathogen, identification of the origin of the cancer, assessment of the possibilities for its spread and possible implementation of a demarcation survey;
(e) the occurrence of a cancer agent - the detection of at least one cancer agent of an infected plant or part of it or the detection of permanent zoosporangia of a cancer agent;
(f) an aggressive pathogen - a pathogen of a cancer agent capable of attacking and reproducing potato varieties resistant to or resistant to the cancer agent of a pathogen,
(g) potato variety resistant to a particular pathogen of the cancer agent - potato variety which reacts to the infestation of the populations of that pathogen of the cancer agent in such a way that there is no risk of secondary infection;
(h) contaminated land or object - the property or object on which or where the occurrence of the cancer agent has been detected and verified;
(i) land or object suspected of infestation - land or object likely to have spread or may spread to the cancer agent;
(j) a large catering centre - a mass catering facility in which the treatment of waste in accordance with point C (b) of Annex 6 to this Regulation is ensured when consuming table potatoes from the territory concerned by the exceptional plant health measures ordered because of the occurrence of the cancer agent.
§ 3
Preventive measures
(1) In accordance with Section 7 (1) of the Act, the possession of a cancer agent is prohibited, except for the retention for scientific, breeding or diagnostic purposes permitted by the plant health administration under Section 8 (1) of the Act, provided that the protection measures in the event of the occurrence of the cancer agent are not impaired or there is no risk of spreading them.
(2) The plant health authority or, where appropriate, the natural or legal person responsible for such activity by the Ministry pursuant to Article 71 (1) (b) of the Act or the plant health authority pursuant to Article 72 (5) (i) of the Act, confirms the resistance to pathogen 1 of the cancer agent, or to other pathogens of the cancer agent occurring in the territory of the Czech Republic, in the case of varieties and new breeding potato varieties for which resistance to those or properties close to the pathogens is declared by the breeder and which are registered in the trials of potato varieties carried out by the Central Control and Examination Institute of Agriculture (hereinafter referred to as the "Institute") under the Special Act. 4) The method of testing resistance is laid down by the Plant Health Administration in accordance with Section 72 (5) (h) of the Act and published in the Bulletin of the State Plant Health Administration ("Bulletin ').
(3) The data on the resistance of potato varieties to cancer agents (including their pathogens), which has been confirmed by testing in accordance with paragraph 2, shall be published by the Institute in the List of Varieties registered in the Czech National Plant Variety Book, issued under the Specific Act, 5) and communicated by the Plant Health Administration to the European Commission ("the Commission") by 1 January each year. The plant health administration shall publish, by 1 March each year, data on the reaction of potato varieties against the cancer agent (including their pathogens) in the Bulletin on the basis of the testing carried out in accordance with paragraph 2 and data received by the plant health authority from the Member States of the European Union (hereinafter referred to as the Member State).
§ 4
Detection and registration of cancer agent
(1) The incidence of cancer agent is detected by the plant health administration through targeted surveys in accordance with Section 10 (1) of the Act and by systematic plant health checks in accordance with Section 15 (2) of the Act, namely:
(a) by inspection of host plants and, in the case of the cancer agent, of potato tubers harvested,
(b) by sampling and analysis or biological testing of soil samples.
(2) The extent and manner of inspection of host plant crops, potato tubers and sampling of plants and soil and their methods of analysis or testing and the extent of application of these methods are determined by the plant health management, in accordance with Article 10 (1) of the Act, by official communication in the Bulletin on the basis of scientific and statistical principles and biology of the cancer agent, taking into account potato production systems and other host plants and the current situation in the occurrence or risk of the introduction of the cancer agent.
(3) The extent and results of the cancer agent survey are notified in writing to the other Member States and the Commission once a year in accordance with Section 10 (5) of the Act.
(4) The evidence of the occurrence of the cancer agent is kept by the plant health administration in accordance with Section 10 (4) of the Act under a specific legislation. 6)
§ 5
Measures to detect suspected occurrence of cancer agent
(1) In the event of the detection or notification of a suspected presence of a cancer agent, the plant health authority shall, in the context of the expert investigation referred to in Section 76 (2) of the Act, verify the presence by a method based on scientific and statistical principles and on the knowledge of the biology of these harmful organisms, in order to confirm or deny this suspicion.
(2) If there is a danger of delay, the plant health administration shall, pending any refutation of suspicion of occurrence or of the regulation of emergency plant health measures on the basis of the outcome of a professional investigation carried out pursuant to Article 6 (1), in accordance with Article 76 (2) of the Law,
(a) prohibit the movement of all lots of plants and soil coming from parcels or objects from which samples have been taken with a reasonable suspicion of the presence of the cancer agent, except for lots of plants which do not pose a identifiable risk of spreading such harmful organisms, or where appropriate subject to measures under the supervision of the plant health authority which excludes that risk; and
(b) order other appropriate measures corresponding to the estimated risk of further possible spread of the cancer agent in order to prevent such spread and ensure supervision of the movement of all other lots of host plants placed on the market.
§ 6
Measures after confirmation of cancer agent occurrence
(1) If, on the basis of the verification of the suspicion of the occurrence of a cancer agent referred to in Article 5 (1), the plant health authority confirms the presence of a cancer agent, it shall carry out, in accordance with Article 76 (2) of the Act and under the special legislature (7), a technical investigation to assess the facts set out in Annex 1, including the verification of the pathogen of the cancer agent by a method established on the basis of scientific and statistical principles and the biology of the cancer agent and published in the Bulletin, where appropriate, a demarcation survey of the occurrence of the cancer agent on other parcels or objects suspected of their occurrence.
(2) After completion of the expert investigation referred to in paragraph 1 and in accordance with its outcome and, where appropriate, on the basis of the result of the demarcation survey referred to in paragraph 1 (b). (c) the plant health administration shall designate the relevant potato batch or other host plants, land or object as infected by the cancer agent.
(3) If the verification referred to in paragraph 1 ascertains the presence of an aggressive pathogen of the cancer agent, the plant health authority shall test its virulence and identification by a method to be established in accordance with scientific and statistical principles and the biology of the cancer agent and published in the Bulletin. In the case of a cancer agent, if tests are to be carried out on an infested parcel or an infested object, the plant health authority shall order their execution in the context of exceptional plant health measures as referred to in the second indent of Section 7 (2) (d) (1).
(4) If the presence of a cancer agent is confirmed, the plant health administration shall define the territory in which it will include the infected parcel or object and if there is a risk of their spread outside that parcel or object, other parcels or objects (hereinafter referred to as quarantine territory) to a sufficient extent to prevent their spread outside that territory. In the quarantine area, the plant health authorities shall order exceptional plant health measures in accordance with Section 7.
(5) Where, on the basis of the outcome of the expert investigation referred to in paragraph 1, the plant health authority finds that:
(a) host plants of the cancer agent or plants intended to be transplanted into other parcels, grown on an infested parcel or in an infested object, shall not be placed on the market;
(b) the contaminated parcel or object is not or will not be used for the cultivation of host plants by the cancer agent or plants intended to be transplanted into other parcels, possibly used for storage in contaminated soil, with the intention of placing those plants on the market; and
(c) there may be no further spread of the cancer agent from the infected area or object;
the quarantine area shall not be delimited and the regulations on emergency plant health measures shall be waived in accordance with Section 76 (6) (b) of the Act.
(6) Following the negative outcome of the examination of the occurrence of cancer agent on all contaminated parcels and in all contaminated objects in the quarantine area pursuant to § 8 (2) and (3), the plant health authorities shall, in accordance with § 76 (4) (b) of the Act, withdraw the exceptional plant health measures, indicating the facts underlying this Decision.
§ 7
Exceptional plant health measures against the spread of cancer agent
(1) After confirmation of the occurrence of the cancer agent, the plant health administration shall, in accordance with Article 11 (1) of the Act, order in the quarantine territory appropriate exceptional plant health measures under Article 76 (2) (a) of the Act referred to in paragraphs 2 to 11.
(2) On contaminated land, possibly in contaminated premises in quarantine territory
(a) in the year of the detection of a cancer agent on this parcel, or where appropriate, plants or parts thereof with cancer tumours must be disposed of in accordance with Part C of Annex No 2 [Paragraph 76 (1) (b) to the Law], except for samples intended to test virulence and identify the pathogen of the cancer agent or to retain the cancer agent for scientific, breeding or diagnostic purposes authorised by the plant health authority pursuant to Section 8 (1) of the Act;
(b) wild host plants must be sought and disposed of [Paragraph 76 (1) (a) of the Act];
(c) host plants [except in the cases referred to in (d)] and plants intended for planting on other parcels (nurseries, vegetable seed, bulbs of flowers, seedlings, etc.) shall not be grown or kept in such a way as to allow their contact with contaminated soil (§ 76 (1) (a) of the Law);
(d) may be grown:
1. seed potatoes for the purpose of:
1.1. The eradication of cancer agent according to Annex 3 (§ 76 (1) (a) of the Act), or
1.2. Testing the virulence of the aggressive pathogens of the cancer agent according to § 6 (3) [§ 76 (1) (d) of the Act], or
1.3. Maintaining the cancer agent for scientific, breeding or diagnostic purposes, on the basis of a decision of the plant health authority under Section 8 (1) of the Act.
(3) The plant health management shall, in the context of the emergency plant health measures ordered, allow potato cultivation on the contaminated parcel or in the contaminated object referred to in paragraph 2 (d) only if the identifiable risk of spreading the cancer agent is excluded, in particular by ensuring that the conditions for the possible transport and use of harvested potatoes listed in Annex 4 are met.
(4) On other parcels or other premises in the quarantine area, as appropriate
(a) in the year following the year of detection of the cancer agent, potato propagating material3) must not be produced; in subsequent years, this material may only be produced under the conditions set out in paragraph 8;
(b) only potato varieties resistant to locally occurring cancer agent pathogens may be grown on the same parcel not more frequently than once every 4 years [Paragraph 76 (1) (a) of the Act].
(5) A potato lot, identified as infected by a cancer agent pursuant to Article 6 (2) or originating from contaminated parcels or objects, may be used with the exception of tubers visibly infected with cancer:
(a) after cooking or mating in a steam facility at a temperature of at least 80 ° C for at least 15 minutes for feeding or consumption in the holding or household of the owner of the land, or in another holding or household in the same quarantine territory [Paragraph 76 (1) (a) of the Act];
(b) for industrial processing [Paragraph 76 (1) (a) of the Act] in processing plants which are equipped with sedimentation sinks for the installation of solid particles from floating and washing waters, equipped with a foam and light particles leak-proof device (submersible wall),
(c) for consumption in large food centres, unless they come from a parcel infested with an aggressive pathogen [Paragraph 76 (1) (a) of the Act];
(d) for consumption by packaging prepared for direct delivery to the place of consumption and use without repackaging as table potatoes, but only if the early potatoes are resistant to the cancer agent, delivered by 15.8.2008 and not coming from a parcel contaminated with an aggressive pathogen [§ 76 (1) (a) of the Act].
(6) Plants intended for planting on other parcels (nurseries, vegetable crops, bulbs of flowers, seedlings, etc.) coming from contaminated parcels or objects may not be placed on the market except for their direct supply and planting on land from which there is no risk of further spread of the cancer agent. The land to be planted with such plants shall be approved in advance by the plant health authorities. These plants cannot be procured by plant passports pursuant to Section 14 (1) of the Act [Section 76 (1) (a) of the Act].
(7) Potatoes originating from other parcels or objects in the quarantine area with an aggressive pathogen may be used:
(a) in the same quarantine area or in another quarantine area with the presence of the same pathogen of the cancer agent for any purpose, except for use as seed [Paragraph 76 (1) (a) of the Act];
(b) industrial processing [Paragraph 76 (1) (a) of the Act];
(c) for consumption in large food centres [Paragraph 76 (1) (a) of the Act]; or
(d) to be consumed by packing prepared for direct delivery to the place of consumption and used without repackaging as table potatoes [Paragraph 76 (1) (a) of the Act].
(8) If a new occurrence of a cancer agent near the site where propagating material3 is produced is found to be included in the quarantine area, the breeding material3) of the potato may be placed on the market only after examination by the plant health authority of its ininfestation by collecting and analysing soil samples from the site concerned and, in the case of the cancer agent, by examining the tubers harvested for the occurrence of the symptoms of the cancer agent [§ 76 (1) (a) of the law].
(9) Potatoes, plants intended for planting on other parcels may be moved from the quarantine area in the course of marketing, on contaminated parcels grown by plants or plant products with clinging soil (onions, bulevines, root vegetables etc.), soil, manure and compost only on the basis of the authorisation of the plant health administration, issued at the request of the legal or natural person concerned and the conditions laid down therein. The plant health administration shall only approve such sites and uses of the transferred material and shall lay down the conditions set out in Annex 4 in order to avoid the identifiable risk of spreading the cancer agent [Paragraph 76 (1) (a) of the Act].
(10) Machinery, means of transport, tools and footwear or other articles used
(a) on the contaminated parcel or in the contaminated object, the soil must be cleaned of, or cleaned of, the premises before being moved from that parcel, and, before being used on another parcel or object, washed with water in the quarantine area, at a place where the cancer agent cannot be expanded; if it is a plot with an aggressive pathogen, it must be disinfected in accordance with Annex 2 (§ 76 (1) (a) of the Act),
(b) on other grounds and in other objects in the quarantine territory, they must be cleansed from the impure soil before being moved outside that territory [Paragraph 76 (1) (a) of the Law].
The measures referred to in points (a) and (b) shall be taken by the user of the land or object concerned.
(11) The measures referred to in paragraphs 5 to 10 shall apply mutatis mutandis to potatoes, other host plants of the cancer agent and plants intended for planting on other parcels not originating in the quarantine territory which have been stored or otherwise handled in the quarantine territory in a manner which may have had contact with soil from contaminated land or objects.
(12) The plant health service may, pursuant to Article 11 (1) of the Act, order further measures to prevent the spread of cancer agent than those referred to in paragraphs 2 to 11.
§ 8
Review of contaminated land and objects
(1) The examination of the infestation of the property or of an object designated as infected by the cancer agent shall be carried out by the plant health authority in accordance with Section 76 (4) (b) of the Act.
(a) not earlier than 10 years after the last finding of a cancer agent on this property or in this building, or
(b) at the request of the owner or user of the contaminated parcel or object, not earlier than 5 years after the last finding of occurrence on that parcel or in that object, if the presence in conditions not favourable for the development of the cancer agent or if it has been applied to the contaminated parcel under the supervision of the plant health authority under the supervision of the plant health control method of the eradication method referred to in Annex 3, or if its rendering has been carried out in the infected object under the supervision of the infected parcel or in that object used by the soil.
(2) If the presence of a cancer agent is not detected during the examination of the parcel referred to in paragraph 1, the tested parcel shall continue to be considered as suspected of infestation and subject to exceptional plant health measures imposed on other parcels in the quarantine area pursuant to Article 7 (7). The complete abolition of the emergency plant health measures referred to in Article 6 (6) for the original contaminated parcel shall be possible only after the negative result of the re-examination carried out in accordance with paragraph 1.
(3) If the presence of a cancer agent is not detected during the examination of the object, the subject under examination shall be considered as uninfected and the plant health administration shall abolish the exceptional plant health measures ordered in accordance with Article 6 (6).
(4) If the infested land has been permanently grazed or afforested, it is not necessary to review it in order to abolish exceptional plant health measures.
(5) The examination referred to in paragraph 1 shall be carried out by a method to be determined by the plant health administration in accordance with scientific and statistical principles and the biology of the cancer agent and published in the Bulletin. The results of the examinations are part of the cancer agent's occurrence record, conducted in accordance with § 4 (4).
§ 9
Efficacy
This decree shall take effect on the day of its publication.

Contents of professional investigation after confirmation of cancer agent occurrence
The expert investigation referred to in Article 6 (1) (a) shall aim at:
(a) the delimitation of the contaminated parcel or object and the assessment if there is a risk of spreading the cancer agent;
(b) the identification of the data needed for the registration of the occurrence referred to in Article 4 (3) and the assessment of whether the reporting obligation under Article 9 of the Act and Article 6 of the Decree have been fulfilled;
(c) the identification of the actual or probable origin of the occurrence, in particular with regard to the possibility of transmission of infection from another contaminated parcel or object by propagating material of potato or other plants, by means of mechanisation, instruments, water or wind erosion, the possibility of transmission of manure, sediments from treatment and other plants' waters and in relation to the history of use of the parcel or object, including an assessment of the frequency of cultivation of host plants;
(d) an assessment of the current potential for the spread of the cancer agent from the contaminated parcel or object, taking into account:
- the intensity of the infestation and, where appropriate, the terrain or other isolation from the surrounding area of the infested plot,
- the places and ways of storing and utilizing the harvest of host plants and plants intended to be transferred to other parcels,
- mechanising devices and tools used on contaminated parcels (in contaminated objects) and their use on other parcels (in other objects);
(e) an assessment of the effectiveness and the possibility of eradicating the cancer agent, taking into account the results of the investigations referred to in (a) and (d) and the ecological and hygienic aspects of the possible use of chemical agents.

Assemination and disposal of material contaminated with or from cancer

Before sanitation, contaminated objects and spaces must be disposed of from plant residues and soil (mechanically or by washing water, vacuum-vacuuming, blowing out inaccessible places of machinery and equipment by compressed air, etc.).
Self-sanitation is performed by soaking in the appropriate solution or by spraying at a dose of 0,5 - 1 litre per m2 to perfectly soak the treated article. If the spray is rapidly dried on the treated object (in the sun and wind), the spray should be repeated once more. After rendering, treated articles, especially after the use of hypochlorite preparations and soda lye, are washed with warm water.
The appropriate hygiene and safety measures on the labels of the products used must be complied with during rendering.
B. Asana with hot water and steam
The treatment with hot water shall be carried out by soaking the articles for at least 30 minutes at a water temperature of 65 ° C or 15 minutes at 80 ° C.
Stable or portable steam generators are used to apply steam. The vapour temperature shall be at least 80 ° C and exposure for at least 30 minutes. At temperatures above 100 ° C, exposure can be reduced to up to 15 minutes. In the case of peat bags, the temperature shall not exceed 85 ° C. The waste material shall be slightly moist.
C. Removal of contaminated or suspected material
Plant residues, packaging, soil residues, warehouse debris, etc., infested or suspected of being infested by cancer agents, may be:
(a) burn;
(b) deposit in a controlled landfill (1) where there is no risk of spreading the cancer agent, or in a pre-dug pit and include at least a 50 cm high layer of soil; For safer disposal, it is appropriate to pre-recover the material according to Part A. or B. of this methodology or to sprinkle chlorine lime or burnt lime in 5 kg / m3 before the soil is included.
The method and place of disposal of the material contaminated by the cancer agent or from such contamination of the suspect shall be approved by the geographical authority responsible for the plant health administration.

Reduction of cancer agent in contaminated soil
1. The killing of the cancer agent shall be carried out after the agreement and under the supervision of the territorial authority responsible for the plant health administration, to which the owner or user of the contaminated parcel or object shall give prior notification of the date of implementation of the individual interventions and measures.
2. The selection of methods of destruction and their optimal combination depends on local conditions (intensity of soil infestation, size of land, risk of further spread of infection, ecological situation, economic possibilities of growers etc.). The basis is soil rendering by chemical means and using resistant potato varieties. The methods of cancer agent eradication are published by the Plant Health Administration in the Bulletin.
3. The effectiveness of the destruction shall be verified by checking the infestation of the land or object according to § 8.
4. The evidence of cancer agent eradication is conducted by a protocol plant health administration. The protocol shall contain a description and date of all the work carried out and shall be entered in the cancer agent register.

Transport and utilization of potatoes and other material from quarantine territory and rendering of deposits in sedimentation jars and storage deponics of processing plants
A. Conditions for transporting and utilizing potatoes and other material from quarantine territory
1. Potatoes shall be transported in means of transport from which the content cannot fall and whose storage space can be well cleaned or disinfected, without intermediate storage and re-packaging directly to the place of consumption.
2. When the potatoes are unloaded, the storage area of the means of transport used and the reference pallets or similar packaging used shall be mechanically cleaned and if the potatoes come from an infested parcel or quarantine area with an aggressive pathogen, washed with water at a place where the cancer agent cannot spread. Potatoes from land infested with an aggressive pathogen shall be disinfected after mechanical cleaning and washing with water according to Annex 2, Part A. The places of unloading and storage of potatoes shall be cleaned and disinfected accordingly. The soil and tubers shall be transported to a controlled waste landfill (1) approved for the protection against the spread of the cancer agent by the competent plant health service.
3. Sacks used to transport potatoes from contaminated parcels and quarantine areas with presence of an aggressive pathogen shall be burned or assimilated in accordance with Annex 2.
4. Sediments from sedimentation wells of processing plants shall be exported to places approved by the competent plant health service. Their continued use shall be possible only on the authorisation of the plant health administration and subject to the conditions laid down therein.
5. The seedlings referred to in point 4 may be used on arable land only after their rendering or verification of their ininfested status by the cancer agent referred to in Part B. of this Annex, only on parcels on which potatoes will not be grown for more than 2 years.
6. The supplier of plants, plant products and other materials referred to in Section 7 (9) shall inform the consignee in writing of the conditions of transport laid down by the plant health administration and agree with him on the arrangements for ensuring the appropriate measures.
The measures referred to in points 1 to 6 shall be laid down mutatis mutandis and to the appropriate extent for the transport and use of other material which may be transmitted by the cancer agent.
B. Assemination of deposits in sedimentation sinks and storage deponics of processing plants
1. At the end of the campaign, the sediment in the sink shall be kept completely below the water level until at least 31 March.
2. After the water has been released from the pit, the walls of the pit above the sediment shall be washed with water from vertical concrete or panel walls up to the highest water level.
3. Before desiccating the surface of the sediment, by 30 April at the latest, the entire sedimentation tank shall be covered with a black film which shall be fixed so that no sediments shall be exposed.
4. The black foil shall be removed not earlier than 1 August.
5. Where sedimentation sinks must be emptied during the campaign, black foil may also be used in accordance with points 3 and 4 to cover their piles at the place where they were moved.
