GOVERNMENT REGULATION
of 10 July 2002
fixing the additional duty on imports of certain agricultural products for the calendar year 2002
The Government mandates pursuant to Section 40 of Act No. 62 / 2000 Coll., on certain arrangements for the export or import of products and on licensing procedures and amending certain laws:
§ 1
(1) For goods covered by the Customs Tariff (1) under subheading 0207 11 - Uncut, fresh or chilled, 0207 12 - Uncut, frozen, 0207 13 - Cuts and offal, fresh or chilled (except subheading 0207 13 91 - Livers) and 0207 14 - Cuts and offal, frozen (except subheading 0207 14 91 - Livers), the volume of imports exceeding the trigger level laid down by the special legislature2) shall be subject to the rate of import duty fixed by the Customs Tariff (1) or by the international Treaty (3) increased by 14,3.
(2) For goods covered by the customs tariff (1) under subheading 0405 10 - Butter, 0405 90 - Other and subheading 0405 20 90 - With a fat content exceeding 75% by weight but less than 80% by weight, the volume of imports exceeding the trigger level laid down by the special legislation2) the rate of import duty fixed by the Customs Tariff (1) or the international contract (3) shall apply plus 22,6.
(3) The rates of import duty referred to in paragraphs 1 and 2 shall not apply to goods whose import does not exceed the volume of preferential tariff quotas provided for in a specific legislation or international contract. 4)
§ 1a
(1) For goods covered by the Customs Tariff (1) under subheading 1105 10 00 - Flour, groats and powder, the volume of which has exceeded the trigger level laid down by the special legislature2), the rate of import duty fixed by the Customs Tariff (1) or the international contract (3) shall be applied plus 5,3.
(2) For goods covered by the Customs Tariff (1) under subheading 1105 20 00 - Flakes, granules and pellets whose import volume has exceeded the trigger level laid down by the special legislature2), the rate of import duty fixed by the Customs Tariff (1) or the international contract (3) increased by 1,3 shall apply.
§ 1b
(1) For goods covered by the Customs Tariff (1) under subheadings 1902 11 00 - Containing eggs, 1902 19 10 - Not containing flour or meal of common wheat, 1902 19 90 - Others whose import volume exceeds the trigger level laid down by the special legislation2), the rate of import duty fixed by the Customs Tariff (1) or the international Treaty (3) shall be applied plus 6,4.
(2) For goods covered by the Customs Tariff (1) under subheading 1902 20 10 - Containing more than 20% by weight of fish, crustaceans, molluscs and other aquatic invertebrates, the volume of imports exceeding the trigger level laid down by the special legislature2), the rate of import duty fixed by the Customs Tariff (1) or the international contract (3) increased by 4,8 shall apply.
(3) For goods covered by the Customs Tariff (1) under subheadings 1902 20 30 - Containing more than 20% by weight of sausages and similar smoked products, of meat and offal of any kind, including fats and tallow of any kind or origin, 1902 20 91 - Cooked, 1902 20 99 - Other, 1902 30 10 - Dried, 1902 30 90 - Other whose import volume has exceeded the trigger level laid down by the specific legislation2), the rate of import duty fixed by the customs tariff (1) or international contract (3) increased by 6,3 shall apply.
(4) For the cases referred to in paragraphs 1 to 3, Paragraph 1 (3) shall apply mutatis mutandis.
§ 1c
(1) For goods covered by the Customs Tariff (1) under heading 0203 - Meat of swine, fresh, chilled or frozen, the volume of which has exceeded the trigger level laid down by the special legislature2), the rate of import duty fixed by the Customs Tariff (1) or the international contract (3) shall be applied plus 12,8.
(2) Paragraph 1 (3) shall apply mutatis mutandis to the case referred to in paragraph 1.
§ 1d
For goods covered by the Customs Tariff (1) under subheading 1514 19 90 - Other, 1514 99 90 - Other whose import volume has exceeded the trigger level laid down by the special legislature2), the rate of import duty fixed by the Customs Tariff (1) or the international contract (3) shall be applied plus 8,6.
§ 2
(1) This Regulation shall enter into force on the second working day following its publication.
(2) This Regulation shall expire on 31 December 2002.

1) Decree of the Government No 480 / 2001 Coll., on the issue of customs duties and fixing the rates of import duty applicable to goods originating in developing and least developed countries and the conditions for their application (tariff rate).
2) Government Regulation No 273 / 2002 Coll., establishing trigger levels of import volumes for each agricultural product and group of agricultural products for the calendar year 2002.
3) For example, the Central European Free Trade Agreement concluded between the Czech Republic, the Republic of Hungary, the Republic of Poland and the Slovak Republic, published under No 54 / 1995 Coll., as amended, the Treaty establishing a Customs Union between the Czech Republic and the Slovak Republic, published under No 237 / 1993 Coll.
4) For example, the Europe Agreement establishing an Association between the Czech Republic, of the one part, and the European Communities and their Member States, of the other part, published under No 7 / 1995 Coll., as amended.
