DECLARATION
of 27 September 2017
amending Decree No. 401 / 2010 Coll., on the content requirements of the Transmission System Operation Rules, the Distribution System Operation Rules, the Transmission System Operator Order, the Distribution System Operator Order, the Underground Gas Storage Operator Order and the Market Operator Terms and Conditions
According to Section 98a (2) (b) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Performance of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 158 / 2009 Coll. and Act No. 211 / 2011 Coll.:
Decree No 401 / 2010 Coll., on the content requirements of the Transmission System Operation Rules, the Distribution System Operation Rules, the Transmission System Operator Order, the Distribution System Operator Order, the Underground Gas Storage Operator Order and the Market Operator Business Conditions, are amended as follows:
1. in the heading of the Decree, § 3 (m), § 4 (1) (k), § 5 including the title and in § 7 (f), the word "underground" shall be deleted;
2. In Article 1 (c) (5), the words "electricity transmission provided 'and" electricity transmission' are replaced by the words "transmission system service provision '.
3. In Article 2 (1) (b), the words "on both the supply and electricity side 'are inserted after the words" providing support services'.
4. in Article 2 (1) (c) and (d):
"(c) the conditions for the provision of a distribution system service, which are:
1. the method of determining the size of the distribution capacity for the operational security of the distribution system;
2. payment conditions for the provision of a distribution system service, including the setting of advance payments for the provision of a distribution system service;
(d) technical conditions for the connection of the power plant, other distribution system, electrical energy storage facility or demand facility, including a recharging station for electric vehicles,
1. the characteristics of the connection requirement;
2. technical requirements for connection point equipment and for installation of measuring equipment;
3. technical requirements for the connection of the power plant;
4. technical requirements for the connection of an electrical energy storage device;
5. technical requirements for connecting charging stations for electric vehicles;
6. technical requirements for dispatching control, ';
5. in Article 2 (1) (h) (11), the words "use of long-distance bulk" are replaced by the words "operation of technical means for."
6. in Article 3 (b), (i) and (k), the words "transport of gas," the words "transport of gas" and the words "transport of gas" shall be replaced by the words "supply of gas transport services."
7. in Article 3, the following points (c) and (d) are inserted after point (b), including footnote 3:
"(c) data relating to the transport capacity:
1. an indication of the internet address through which the transmission system operator publishes the amount of capacity;
2. information on the maximum amount of technical capacity following technical capacity at other interconnection points, dynamic access for each interconnection point;
3. the procedure for determining the dedicated transport capacity at each interconnection point;
4. establishing competitive capacity;
5. measures to maximise coordinated capacity by optimising technical capacity, a common method in accordance with a directly applicable European Union regulation governing capacity allocation mechanisms in gas transmission systems (3),
6. coordination of capacity calculations with neighbouring transmission system operators, procedure for non-compliance of transmission system operators,
7. the procedure for offering uncoordinated transport capacity;
8. the procedure for determining the size of the transmission capacity for the use of extractive and pulverising power offered by the gas storage tank operator;
(d) details concerning the auctions of transport capacity, which are:
1. an indication of the internet address through which the transmission system operator publishes the auction calendar;
2. the mechanism and conditions for establishing the coordinated capacity for each interconnection point and an indication of the internet address through which the transmission system operator publishes a specific level of coordinated capacity;
3. data on platforms at individual interconnection points through which the reservation of transmission capacities takes place;
3) Article 6 of Commission Regulation (EU) No 984 / 2013 of 14 October 2013 establishing a network code for capacity allocation mechanisms in gas transmission systems and supplementing Regulation (EC) No 715 / 2009. ';
Points (c) to (m) shall be renumbered as points (e) to (o).
8. In Article 3 (e), at the end of the text in point 1, the words "including the requirements for financial eligibility in the case of an auction for which no final price is known 'are added.
9. in Article 3 (f):
"(f) laying down conditions for taking over or refusing gas for transport,"
10. in Article 3, point (n) is deleted;
Point (o) shall be renumbered as point (n).
11. in Article 3, at the end of point (n), the dot is replaced by a comma and the following points (o) to (r) are added:
"(o) the mechanism for controlling gas flows at each interconnection point;
(p) rules ensuring consistency between the allocated quantities of gas on both sides of each interconnection point;
(q) the nomination reconciliation procedure for each interconnection point;
(r) the form and particulars of the application for the transport of gas in test operations. ';
12. in Article 4 (1) (b), (g) and (h), the words "gas distribution" shall be replaced by the words "security of the distribution system service."
13. in Article 4 (1), the following point 4 is added at the end of point (c):
"4th termination and termination of the reservation of distribution capacity,"
14. in Article 4 (1) (d):
"(d) the conditions for taking over or refusing gas for distribution,"
15. in Article 4 (1) (h), the words "gas distribution" are replaced by the words "security of the distribution system service."
16. in Article 4 (1), point (i) is deleted;
Points (j) and (k) shall be renumbered as points (i) and (j).
17. in Paragraph 4 (2):
"(2) The content elements of the Order of the distribution system operator which is not directly connected to the transmission system shall be those referred to in points (a) to (d), (g), (h) and (j) of paragraph 1. ';
18. in Article 5, the words "the description of the products offered and the method of determining the price of the daily products" shall be added at the end of the text in point (b).
19. in Article 5, the following point 5 shall be added at the end of point (c):
"5. the formalities and conditions for the conclusion of the contract for the auction of storage capacity, ';
20. in Article 5 (e):
'(e) the procedure applied by the gas storage tank operator for the insertion or extraction of gas between the pumping and extraction periods;';
21. in Sections 6 and 7, the following point 3 shall be added at the end of point (a):
"3. methodologies and resources used, including their Internet addresses, ';
22. in Article 6, the following points 4 and 5 are added at the end of point (d):
"4. the commencement or termination of the supply of electricity by the supplier of the last instance;
5. determination of the national energy mix, '.
23. in § 6 (f) (6) and § 7 (f) (5), the words "with continuous measurements" shall be deleted;
24. in Article 6, the following points 8 to 12 are added at the end of point (f):
"8. method of indicating the replacement values in the event of failure of the measuring equipment;
9. Method of informing the market operator of the zero value of electricity collection at the point of collection;
10. method of establishing the coefficient of residual diagram and temperature coefficient,
11. procedure for assessing differences between consumption readings and consumption estimates by type diagrams;
12. the procedure for determining losses, the residual load diagram and the determination of the values of the consumption of electricity of customers with type C measurement in local distribution systems, '.
25. in Article 6, the following point 5 is added at the end of point (h), including footnote 4:
"5. the procedure for recording, providing and reporting trade data on short-term electricity markets (4);
4) Regulation (EU) No 1227 / 2011 of the European Parliament and of the Council of 25 October 2011 on the integrity and transparency of wholesale energy markets. '.
26. in Article 6, the following point 4 is added at the end of point (j) and 7 at the end of point (i):
"4. the procedure for the financial settlement of derogations and dates for each stage. ';
27. In Section 7 of the introductory part of the provision, the words "commercial conditions' shall be inserted after the words" formalities'.
28. in Article 7, the following point 4 is added at the end of point (d):
"4. the start or termination of the supply of gas by the supplier of the last instance; ';
29. in Article 7, the following points 7 and 8 are added at the end of point (f):
'7. procedure for assessing differences between readings and consumption values on the basis of the supply type diagrams;
8. the procedure for assessing the differences between the planned and the actual value of losses in the distribution system; ';
30. in Article 7 (h) (4), "tolerance" is replaced by "flexibility."
31. the following point 6 shall be added at the end of point (h) of Section 7:
"6. the procedure for recording, providing and reporting trade data on short-term gas markets (4); ';
Efficacy
This Decision shall enter into force on 1 January 2018.
