on how to assess and evaluate the level of pollution, the extent of public information on the level of pollution and in smog situations
The Ministry of the Environment provides, pursuant to Sections 5 (6) and 30 (4) of Act No. 201 / 2012 Coll., on Air Protection ("the Act '):
Subject matter
This decree implements the relevant provisions of the European Union1) and provides for
(a) the manner and conditions for assessing and evaluating the level of pollution;
(b) the extent to which the public is informed of the level of pollution;
(c) the extent of information to be provided to the public when a smog situation arises; and
(d) the content of the protocol on measuring the level of pollution.
Method for assessing the level of pollution
(1) Assessment of the level of pollution is carried out
(a) measurements carried out in accordance with the data quality objectives set out in Part I of Annex No 1 to this Regulation at sites designated in accordance with the requirements of Annex 2 and Annex 3 to this Regulation (hereinafter referred to as "stationary measurements") in all agglomeration and in those zones where the level of pollution reaches or exceeds the upper limit for the assessment of the level of pollution and where, in the case of tropospheric ozone, the level of pollution exceeds the limit of imitation set out in point 4 of Annex 1 to the Act during the last 5 years;
(b) calculation by means of a model ("modelling") in zones where the level of pollution does not exceed the lower limit for the assessment of the level of pollution; or
(c) a combination of stationary measurements and measurements carried out in accordance with the data quality objectives of Part II of Annex 1 to this Regulation (hereinafter referred to as "indicative measurements") or a combination of stationary measurements and modelling in zones where the level of air pollution is below the upper limit for assessment.
(2) The upper and lower limits for the assessment of the level of pollution and the permitted number of overruns are set out in Annex 4 to this Regulation. The method of assessing the level of pollution in each zone and agglomeration shall be evaluated on the basis of the first sentence assessment limits at least every 5 years; in the case of significant changes in activities related to concentrations of sulphur dioxide, nitrogen dioxide or, where appropriate, oxides of nitrogen, PM10 particles, PM2,5 particles, lead, benzene and carbon monoxide in ambient air, this evaluation shall be carried out more frequently.
(3) The pollution level assessment limit shall be considered to be exceeded if it has been exceeded in at least 3 of the previous 5 calendar years. For pollutants with an average time of less than 1 calendar year, the limit shall be deemed to have been exceeded if it is exceeded more than the maximum number of overruns laid down in Annex 4 to this Regulation during one calendar year.
(4) Where data are available for a pollutant only for a period of less than 5 calendar years, the overrun of the upper and lower limits for assessing the level of pollution shall be determined on the basis of a combination of the results of short-term metering campaigns during the year and at places likely to be representative of the highest levels of pollution and of the results obtained from emission inventory and modelling data.
Conditions for assessing and evaluating the level of pollution
(1) The assessment and evaluation of the level of pollution shall be carried out for pollutants having a legal limit on the imitation and for the substances referred to in paragraph 2. In addition to the stationary measurement of benzo (a) pyrene, stationary measurements of benzo (a) anthracene, benzo (b) fluoranthene, benzo (j) fluoranthene, benzo (k) fluoranthene, indeno (1,2,3cd) pyrene and dibenz (a, h) anthracene shall be carried out on at least one measuring site in each zone or agglomeration.
(2) Assessment and evaluation of the fulfilment of the national exposure reduction target shall be carried out by means of an indicator of the average exposure of the population by PM2,5 particles, expressed as three years, of the average annual concentration of PM2,5 particles determined on the basis of measurements at sites located in accordance with Part A (1) of Annex 2 to this Regulation.
(3) Without prejudice to Paragraph 2 (1), at least one site on the territory of the Czech Republic shall be carried out where the level of pollution is apparent representative of the area without any clear influence of any source (the background measuring site), the assessment of the level of pollution
(a) indicative and stationary measurement of total deposition on arsenic, cadmium, fumes of elementary mercury and reactive gaseous mercury, nickel, benzo (a) pyrene, benzo (a) anthracene, benzo (b) fluoranthene, benzo (j) fluoranthene, benzo (k) fluoranthene, indeno (1,2,3cd) pyrene and dibenz (a, h) anthracene,
(b) stationary measurements for tropospheric ozone precursors listed in Annex 5 to this Decree and measurements of the total deposition of the pollutants listed in (a); and
(c) by stationary measurement of the mass concentration of particles PM2,5 and of the chemical constituents of the particles PM2,5, i.e. at least the concentration of total organic carbon, elementary carbon, magnesium, calcium, sodium, potassium and ammonium ions and sulphate, chloride and nitrate anions; This measurement shall be carried out in a rural background measuring location.
(4) Where the level of pollution is used to assess:
(a) stationary measurements, the sampling and analysis procedures set out in Part A of Annex 6 to this Regulation shall be followed; another procedure may be used for stationary measurements if the equivalence test can demonstrate that equivalent results can be obtained;
(b) the model calculation, the models set out in Part B of Annex 6 to this Regulation shall be used; other models may also be used to calculate the model if it can be shown that equivalent results can be achieved;
(c) a diffusion study in the cases referred to in Article 11 (9) of the Act, the reference models set out in Part C of Annex 6 to this Decree shall be used; other models may be used for the processing of the diffusion study under Section 11 (9) of the Act if it can be demonstrated that equivalent results can be achieved.
(5) The data obtained in assessing the level of pollution must meet the quality objectives set out in Annex 1 to this Regulation.
(6) The level of air pollution from diffuse sources of air pollution shall be assessed in the minimum number of measuring sites set out in Part A of Annex 2 to this Decree. The level of air pollution in the vicinity of one particular stationary source of air pollution shall be assessed in the number of measuring sites selected taking into account the level of pollution, the likely spatial distribution of concentrations of pollutants and their distribution in the air and the potential exposure of the population. The minimum number of measuring sites for the stationary measurement of the level of pollution by tropospheric ozone and its precursors is set out in Part B of Annex 2 to this Decree.
(7) The requirements for measuring sites and the location of sampling points for stationary measurements are set out in Annex 3 to this Decree.
(8) The assessment of the pollution levels for gaseous pollutants covers standard conditions, i.e. the volume of sampling converted to 293,15 K and the normal pressure of 101,325 kPa. For PM10, PM2,5 and pollutants analysed in PM10 particles, the sampling volume refers to the external conditions on the day of measurement. The arithmetic mean of the values found shall be used in the assessment of pollution levels.
(9) The content of the protocol on the measurement of the level of pollution is set out in Annex 7 to this Decree.
Scope of public information on the level of pollution
(1) The public must be informed by the competent air protection authorities of the overrun of the statutory limit of imitation and its effects on human health or on ecosystems and vegetation. Information on the level of pollution provided to the public shall be given as an average value for the relevant averaging period set out in Annex 1 to the Act.
(2) Information on levels of pollution by sulphur dioxide, nitrogen dioxide, PM10 particles, PM2,5, tropospheric ozone and carbon monoxide shall be updated every hour. Information on average quarterly levels of lead and benzene pollution shall be updated every 3 months.
Scope of information to be provided to the public in smog situations
(1) In the event of a smog situation, the Ministry shall provide the public with information on:
(a) the threshold values found to be exceeded in accordance with Annex 6 to the Act, the area of occurrence of the smog situation, the type of threshold being exceeded, the start and duration of the overrun, the highest hourly and daily concentration and, in the case of tropospheric ozone, the highest eight-hour average;
(b) forecasts for the following period, in particular the expected changes in the level of pollution and the reasons for such changes;
(c) vulnerable population groups such as children, elderly people or sick people, possible health effects, recommended preventive measures to be taken by the inhabitants concerned and a reference to sources of further detailed information.
(2) When a smog situation arises, the regional authorities provide information to the public in accordance with Section 30 (2) of the Act on:
(a) the facts referred to in paragraph 1, on the basis of supporting documents provided by the Ministry or the legal person established by it;
(b) a list of the resources to which specific operating conditions have been established in the event of the regulatory thresholds being exceeded pursuant to Section 12 (4) (g) of the Act;
(c) recommended transport measures and stationary sources other than those referred to in (b).
Efficacy
This Decree shall take effect on 15 October 2012.

Notes:

3) In agglomeration and other urban areas with a population of more than 100 000, at least 1 measurement site per million inhabitants for stationary PM2,5 particle measurement shall be established to calculate the average exposure indicator and assess compliance with the national exposure reduction target. These sampling points may be identical to those referred to in Part A (1).

At least one station in the zone and the agglomeration shall be located in areas where the population may be exposed to the highest concentration of tropospheric ozone. At least 50% of the stationary measurements shall be placed in suburban locations in conurbations.
2. Stationary measurement of nitrogen oxides shall be carried out at least 50% of the stationary measurement for tropospheric ozone. Stationary measurement of nitrogen oxides is continuous, except for rural background sites on which other measurement methods may be used.
3. The minimum number of measuring sites in zones and conurbations where the imitation limits for tropospheric ozone set out in point 4 of Annex 1 to the Law are reached, combined with other means of assessing the level of pollution, such as modelling and simultaneous measurement of the concentration of nitrogen dioxide, shall be sufficient to evaluate the trend of the tropospheric ozone pollution level and to check compliance with the limit values set out in point 4 of Annex 1 to the Law.

Requirements for measuring sites and location of sampling points for stationary measurements
Measurement sites and sampling points for stationary measurement of pollution levels by pollutants except tropospheric ozone
1. Requirements for measuring sites
1.1. Measurements for the protection of human health
1.1.1. Measurement sites aimed at protecting human health are selected to provide data on:
(a) areas within zones and conurbations where the highest levels of pollution are present, likely to be exposed directly or indirectly to the population for a significant period of time in relation to the averaged period of the limit;
(b) levels of pollution in other zones and conurbations which are representative of the population exposure in general.
1.1.2. The measuring sites are usually selected to avoid measuring very small microenvironment in their immediate vicinity. This means that the measuring site is selected in such a way that air samples are, as far as possible, representative of a section of communication of at least 100 m in length for transport sites, for 1000 m in suburban sites and for areas of at least 250 m x 250 m in size for industrial sites.
1.1.3. Urban background sites shall be selected in such a way that all sources placed against the wind from the measuring site are applied to the level of pollution in those sites. The level of pollution should mainly not cause only one source of pollution, unless such a situation is typical of a wider urban area. The measuring site should be representative of the area of several km2.
1.1.4. If the objective is to detect background pollution levels, the measuring site shall not be affected by conurbations or industrial zones situated closer than within a radius of 5 kilometres.
1.1.5. If the contribution from industrial sources of pollution is to be assessed, at least one measuring site shall be selected along the prevailing wind direction from the source of pollution in the nearest residential area. If the background pollution level is not known, one measuring site shall also be selected on the wind side of the stationary source (taking into account the prevailing wind direction).
1.1.6. As a general rule, measuring sites shall be selected in such a way that the levels of pollution measured are also representative of similar areas which are not in their immediate vicinity.
1.1.7. Stationary measurements of tropospheric ozone precursors are carried out mainly in urban and suburban locations.
1.2. Measurement sites aimed at protecting ecosystems and vegetation
Measurements for the protection of vegetation shall be selected at a distance of more than 20 km from the conurbations or more than 5 km from other built-up areas, stationary sources or motorways or major roads with a load of more than 50 000 vehicles per day. The measuring site shall be selected in such a way that the air pollution levels measured are representative of the area of at least 1 000 km2.
2. Requirements for location of sampling points for stationary measurements
2.1. The air flow around the inlet opening of the sampling probe shall not be restricted (shall be free in a sector of at least 270 ° or 180 ° for the sampling points in the housing line) and shall not be in the vicinity of any obstacle affecting the air flow (the sampling facilities shall, as a rule, be more than twice the number of metres of the obstacle which exceeds the sampling facility, at least 0,5 m from the nearest building for sampling points representing the level of pollution in the housing line),
2.2. The inlet opening of the sampling probe shall normally be located between 1,5 m (respiratory zone) and 4 m above the ground, a higher position (up to 8 m) may be required under certain circumstances, a higher location may also be appropriate if the stations are representative of a large area and any deviations are properly documented,
2.3. The inlet opening of the sampling probe shall not be located in the immediate vicinity of the sources in order to prevent the direct influence of emissions not mixed with ambient air,
2.4. The outlet opening of the sampling device shall be located in such a way as to prevent leakage of the collected air from entering the inlet of the sampling device;
2.5. For transport-oriented sampling devices:
(a) the sampling points should be at least 25 m from the edge of the major intersections and at least 4 m from the centre of the nearest lane; a large intersection is meant, for the purposes of this provision, a junction which distorts the continuity of traffic and where emissions different from other parts of the road arise,
(b) the sampling points for the measurement of nitrogen dioxide and carbon monoxide should be no further than 5 m from the side of the road;
(c) the sampling points should be located in such a way that the measurements are representative of the level of air pollution near the residential line, but not further than 10 m from the road edge.
2.6. The sampling points shall be positioned so as to take account of the following factors:
(a) disruptive sources;
(b) security, in particular public security and operational personnel;
(c) accessibility;
(d) availability of electricity and telephone connections;
(e) visibility of the site in its vicinity;
(f) the appropriateness of merging sampling points for different pollutants;
(g) zoning requirements.
3. Documentation and review of the selection of seats
3.1. The procedures for the selection of sites and the location of all measuring points in the network shall be documented, including the acquisition of a photograph of the area surrounding the measuring site in the main world pages, and detailed maps. In the case of indicative measurement or modelling, the documentation shall contain detailed information on these methods and on compliance with the requirements set out in Annex 1 to this Decree.
3.2. The suitability of the selection of measuring sites and the location of sampling points shall be reviewed regularly at least every 5 years and new documentation shall be taken to demonstrate the continuous validity of the selection criteria, network design and measuring points.

2. Requirements for location of sampling points for stationary measurements
To be treated appropriately according to Part A point 2 of this Annex shall be ensured that the input probe is located at a sufficient distance from stationary sources such as blast furnaces and incinerators, so that measurements are not significantly affected by them, and more than 10 m from the nearest road, with this distance increasing in proportion to the traffic intensity.
3. Documentation and review of the selection of seats
Follow-up A point (3) of this Annex shall apply, with the correct examination and interpretation of monitoring data in the context of meteorological and photochemical processes affecting the level of air pollution by tropospheric ozone at specific locations.

Reference air quality monitoring methods
Procedures for sampling and analysis of stationary measurements
1.1. For stationary measurement of sulphur dioxide, the reference method according to Czech technical standard ČSN EN 14212 "Air quality - Standard method for determination of sulphur dioxide by ultraviolet fluorescence 'shall be used.
1.2. For stationary measurement of nitrogen dioxide and nitrogen oxides, the reference method according to Czech technical standard ČSN EN 14211 "Air quality - Standard method for determination of nitrogen dioxide and nitric oxide by chemiluminescence 'shall be used.
1.3. The reference method referred to in point 1.4 of this Annex shall be used for the sampling of lead, arsenic, cadmium and nickel. For stationary measurements of lead, arsenic, cadmium and nickel, the reference method according to Czech technical standard ČSN EN 14902 "Air quality - Standard method for determination of Pb, Cd, As and Ni in the PM10 fraction of aerosol particles' shall be used.
1.4. For sampling and stationary measurement of PM10 and PM25, the reference method according to Czech technical standard ČSN EN 12341 "Air quality - Reference gravimetric method for determination of mass concentrations of aerosol particles PM10 and PM2,5 '.
1.5. For sampling and stationary measurement of benzene, the reference method according to Parts 1, 2 and 3 of the Czech Technical Standard ČSN EN 14662 "Air quality - Standard method of determination of benzene 'shall be used.
1.6. For stationary measurement of carbon monoxide the reference method according to Czech technical standard ČSN EN 14626 "Air quality - Standard method for determination of carbon monoxide by non-dispersive infrared spectrometry 'shall be used.
