DECLARATION
of 25 August 2008
amending Decree No. 330 / 2001 of the Ministry of Justice Coll., on the remuneration and compensation of the bailiff, on the remuneration and reimbursement of the expenses incurred by the trustee and on the conditions of liability insurance for damage caused by the executor, as amended
According to § 131 (a) of Act No. 120 / 2001 Coll., on judicial executors and enforcement activities (execution order) and amending other laws:
Decree No. 330 / 2001 Coll., on the remuneration and compensation of the court executor, on the remuneration and reimbursement of the final expenses of the manager and on the conditions for liability insurance for damage caused by the executor, as amended by Decree No. 233 / 2004 Coll., Decree No. 291 / 2006 Coll. and Decree No. 94 / 2007 Coll., are amended as follows:
1. in Paragraph 11 (1) (a):
"(a) at the rate of 50% of the remuneration provided for in Article 6 (1) and (2), if the execution is imposed on the payment of the sum of money,"
2. in Article 11 (2) (a), the words "and to cover the costs of execution" shall be inserted after the words "Enforcement title,";
3. In Paragraph 11 (2) (b), "adequate 'is replaced by" 15 days'.
4. In Paragraph 11, the following paragraph 3 is inserted after paragraph 2:
"(3) In the invitation referred to in paragraph 2 (a), the executor shall instruct the debtor that, if the obligation imposed by the Enforcement Order is fulfilled within the time limit referred to in paragraph 2 (b) and the execution costs shall be reimbursed within the same time limit, the executor shall be remunerated under the execution costs referred to in paragraph 1. In the invitation, the executor shall also inform the debtor of the conditions under which the remuneration referred to in paragraph 2 belongs. ';
Paragraphs 3 to 6 shall be renumbered paragraphs 4 to 7.
5. In Paragraph 11 (5), "3 'is replaced by" 4';
6. In Paragraph 11 (7), "5 'is replaced by" 6'.
7. In the first sentence of Article 12 (2), "30 'is replaced by" 50'.
8. Paragraph 13 (5) is deleted.
Transitional provision
Enforcement proceedings initiated and pending by the date of entry into force of this Order shall be completed in accordance with Decree No. 330 / 2001 Coll., as effective by the date of entry into force of this Order.
Efficacy
This Decree shall take effect on 1 November 2008.
