determining the series of nominal masses and nominal volumes permitted for certain types of pre-packaged goods
The Ministry of Industry and Trade provides pursuant to § 27 of Act No. 505 / 1990 Coll., on Metrology, as amended by Act No. 119 / 2000 Coll., ("the Act ') for the implementation of § 9a paragraphs 2 and 3 of the Act:
§ 1
(1) This Decree sets out the series of nominal quantities of contents and the admissible volumes of packaging containers for pre-packaged goods, which are listed in the Annexes to this Decree. This Order applies to pre-packaged goods, which are listed in the Annexes to this Order, which can be marked with the symbol "e 'and is intended for sale in constant unit nominal quantities, which
(a) are equal to the values previously determined by the packing centre;
(b) are expressed in units of mass or volume; and
(c) are not less than 5 g or 5 ml and greater than 10 kg or 10 l.
(2) This decree does not apply to pre-packaged goods intended for professional use and to those covered by specific legislation. 1) Where this corresponds to commercial practices, values different from those listed in Annexes 1, 2 and 3 to this Decree may be used.
§ 2
(1) For the purposes of this Decree, the following definitions shall apply:
(a) products sold by weight or volume, except those referred to in (b) and (c). Annex No 1 to this Decree sets out a number of nominal contents for each of these products for the product combinations and individual packaging into which the products are packed ("prepackages'),
(b) products sold by weight or by volume and placed in rigid containers listed in Annex 2 to this Regulation, except those listed in Annex 1 to this Regulation. Annex 2 to this Decree sets out a series of volumes for rigid containers for such products,
(c) products made as dispensers. Annex 3 to this Decree sets out the volumes of the liquid phase for such products and the volumes of the container for metal containers.
(2) If two or more individual prepackages are made up of multiple packs (multipack), then a series of values listed in Annexes 1, 2 and 3 to this Order shall apply to each package.
(3) If the finished package is made up of two or more individual packages which are not intended for sale individually, then the series of values listed in Annexes 1, 2 and 3 to this Decree shall apply to the finished pack.
§ 3
(1) In all cases, pre-packages shall bear an indication of the nominal weight or the nominal volume of the product content laid down by the specific legislation.2)
(2) In the cases referred to in Article 2 (b) and (c), the packaging containers must also indicate their nominal volume in accordance with the provisions laid down in Annex 2 to this Decree and in point 1 of Annex 3 to this Order, or, where practicable, a reference to the Czech technical standards listed in the Annexes, in such a way as not to result in any confusion with the above mentioned data.
§ 4
This Decree shall take effect on 1 July 2001.
