DECLARATION
State Arbitration of the Czechoslovak Socialist Republic
of 27 February 1979
on the transitional arrangements for certain economic obligations for the supply and collection of electricity
According to § 395 (b) of the Economic Code No. 109 / 1964 Coll., in the version published under No. 37 / 1971 Coll. and on the basis of the Order of the Bureau of the Government of the Czechoslovak Socialist Republic of 22 February 1979 No 56, the State Arbitration of the Czechoslovak Socialist Republic provides for the direction of the consumption of electricity by large customers of a non-productive nature, medium-sized customers and retail customers - socialist organisations:
(1) If the wholesale customer exceeds 1) of a non-productive nature and the medium-sized customer with an agreed technical maximum of 150 kW and more 2) the contracted quantity of electricity in the quarter and the medium-sized customer with an agreed technical maximum of less than 150 kW 3) the contracted quantity of electricity per year is obliged to pay a penalty of 4 Kns for each kWh exceeded.
(2) Paragraphs 15 (1) (c) and 7 of Decree No 175 / 1973 Coll., which issue the basic conditions for the supply of electricity and heat, as amended by Decree No 107 / 1977 Coll., do not apply in the cases referred to in paragraph 1.
(1) If the retail customer exceeds (4) the specified limit on electricity consumption for the deduction period (5), he is obliged to calculate and pay a penalty of 4 Kns for each kWh exceeded within 30 days of receipt of the electricity supply invoice. The limit on electricity consumption for the deduction period (5) is determined from the consumption reported in the next comparable deduction period before 1 March 1979.
(2) If the retail customer does not pay the periodic penalty payment referred to in paragraph 1 in due time, the periodic penalty payment shall be increased by 0,1% for each day of delay in payment.
(3) The period for exercising the right to payment of periodic penalty payments referred to in paragraphs 1 and 2 shall be 2 years.
(4) The provisions of paragraphs 1 to 3 shall not apply to cases where electricity is collected in those premises and residential housing facilities serving the common use of their inhabitants and in other buildings and facilities where the costs of electricity collection are subsequently allocated to the population.
The decree shall take effect on the date of its publication and shall expire on 31 December 1980.
