Constitutional Law
of 31 July 1956
on Slovak national authorities. *)
Based on social transformations that took place during socialist construction in Slovakia and throughout the Czechoslovak Republic, and on the principle of deepening socialist democratism in the state and social establishment of the Republic, and on further development of the initiative of the working people of Slovakia, the release of new resources reserves in the Slovak economy and further strengthening of brotherly relations between the Czech and Slovak peoples
The National Assembly of the Czechoslovak Republic decided on the following constitutional law:
Slovak National Council.
(1) The Slovak National Council is a national body of state authority in Slovakia.
(2) The seat of the Slovak National Council is Bratislava; temporarily the Slovak National Council may be convened elsewhere.
The Slovak National Council is primarily responsible for:
Resolve on the laws of the Slovak National Council,
appoint and dismiss the Board of Authors and its individual members, determine their number and determine which of them is managed by the delegates,
discuss and approve the National Economy Development Plan for Slovakia,
discuss and approve the budget of Slovakia,
discuss reports of the board of delegates and individual delegates on issues of socialist construction in Slovakia,
ensure in a spirit of equality favourable conditions for the economic and cultural life of citizens of Hungarian and Ukrainian nationality.
The Slovak National Council shall exercise its powers in matters of a national or regional nature if they require special arrangements to ensure the full economic and cultural development of Slovakia.
(1) Members of the Slovak National Council are elected in Slovakia for six years according to the constituencies, one Member of the Slovak National Council for 35,000 inhabitants. The term of office of the National Assembly and the Slovak National Council elected on 28 November 1954 will expire on 10 June 1960.
(2) Election to the Slovak National Council is regulated by the Slovak National Council Act. The election date shall be determined by the College of Authors no later than 60 days in advance.
(1) The Slovak National Council verifies the validity of the election of individual Members of the Slovak National Council and decides on the incompatibility of the position of Member of the Slovak National Council with another function.
(2) The verification shall be carried out within not more than six months of the establishment of the Slovak National Council or within three months of the date on which the Member elected by the supplementary choice makes a promise.
(1) In the first meeting of the Slovak National Council, to which the Member will attend, he will take the following oath: "Sľubujem, that we will be verný Czechoslovak Republic, jej ľuvododemokratikých zriadeniu and the legacy of Slovak navistania. We will maintain it by law and carry out our mandate under the best vedomia and svedomia on the prosper of judo and štát."
(2) Denying a promise or a promise, subject to reservation, shall in themselves result in the loss of a mandate.
(1) Members of the Slovak National Council shall exercise their mandate in person. They can give it up at any time.
(2) They are entitled to compensation for the duration of the mandate, the amount of which shall be laid down by the Slovak National Council.
(3) The provisions on Members of the Slovak National Council, their immunity and the right to refuse testimony, their entitlement to leave and the reimbursement of lost earnings apply mutatis mutandis (Sections 44 to 47 and 48 (1) and (3) of the Constitution).
(1) The Slovak National Council elects a Bureau of 11 members from among its members.
(2) The Bureau of the Slovak National Council shall consist of the President of the Slovak National Council, the Vice-Presidents and the other members.
(3) The President of the Slovak National Council shall be represented by one of the Vice-Presidents in accordance with the provisions of the Staff Regulations and the Rules of Procedure.
(1) The Bureau of the Slovak National Council shall be elected for one year each time. The election of the President and Vice-Presidents of the Slovak National Council shall take place by special vote.
(2) The first elections will take place as soon as the newly elected Slovak National Council is established. In subsequent elections, members of the Bureau shall hold their duties until a new Bureau is elected. If the election period of the Slovak National Council expires, members of the Bureau shall retain their duties until the new Slovak National Council elects its Bureau, and they shall continue to be subject to the provisions of Sections 43 to 47 and 48 (1) and (3) of the Constitution mutatis mutandis.
(3) If, for any reason, a member's seat is vacant before the Bureau's term of office expires, a supplementary election shall be held for the remainder of the term.
(4) The Slovak National Council may at any time withdraw its Bureau or its individual members.
(1) The Bureau of the Slovak National Council invites the Slovak National Council to a meeting and declares its session closed. It shall be convened at the first meeting no later than 4 weeks after the election date.
(2) The Bureau of the Slovak National Council shall convene the Slovak National Council at least twice a year.
(3) If, at a time when the Slovak National Council does not sit, the majority of the Slovak National Council members, stating the subject matter of the meeting, are requested to be convened by the Slovak National Council, the Bureau of the Slovak National Council shall be required to convene a meeting so that the Slovak National Council meets within 14 days of the date on which the request is submitted.
(1) At a time when the Slovak National Council does not sit for any reason, the Bureau of the Slovak National Council shall remain in office (§ 9 (2)).
(2) At this time, the Bureau of the Slovak National Council shall appoint and dismiss the College of Authors and its individual members and determine which of them shall be managed by the delegates.
(3) The relevant resolutions shall be submitted by the Bureau of the Slovak National Council to the next meeting of the Slovak National Council for consideration and approval.
(1) The basic principles of the Slovak National Council, its contacts with the board of delegates and on the outside at all, are governed by the Slovak National Council Act on the Rules of Procedure of the Slovak National Council. The Slovak National Council may adjust its internal circumstances and other rules on its conduct by its own resolution within the limits of this law.
(2) The meeting of the Slovak National Council is chaired by the President or one of the Vice-Presidents.
(3) The Slovak National Council meetings are generally public. Meetings may be held only in cases provided for in the Staff Regulations and the Rules of Procedure.
(4) The Slovak National Council is competent to act if at least half the Members are present. The agreement of the majority present shall be required for the validity of the resolution.
(1) The President and the other members of the Board of Authors shall have the right to attend any meetings of the Slovak National Council or its Committees at any time. Give them the floor whenever they ask.
(2) If the Slovak National Council, its Bureau or any of its committees so request, a member of the Board of Authors shall be obliged to attend the meeting in person.
The Slovak National Council shall have the power to interpolate both the President and the other members of the Board of Authors in their matters of competence. The President and the other members of the Board of Authors shall be obliged to reply to the interviews of Members of the Slovak National Council.
(1) Proposals for the laws of the Slovak National Council may be drawn up under conditions laid down in the Conditions of Employment and Rules of Procedure either by the College of Authors or by members of the Slovak National Council.
(2) Each draft law of the Slovak National Council shall be accompanied by a budget on the financial scope of the outline and a proposal for the reimbursement of the required cargo, in accordance with the Budget Act.
The laws of the Slovak National Council shall be signed by the Chairman of the Slovak National Council, the Chairman of the College of Authors and the delegate to whom implementation is required.
(1) The Law of the Slovak National Council requires it to be declared in the manner laid down by the Law of the Slovak National Council.
(2) The laws of the Slovak National Council are hereby published as follows: "Slovenská národná rada sa uzniesla na toho zákon."
The laws of the Slovak National Council, if they contravene the Constitution or the Constitutional Law or exceed its legislative powers, shall be void. Invalidity shall be decided by the Bureau of the National Assembly.
The board of delegates.
(1) The Assembly of Authors is a national authority of government and executive in Slovakia.
(2) The Assembly of Authorisers is responsible for all sectors and sections of government administration in Slovakia, with the exception of matters governed by the Government directly throughout the country, such as foreign affairs, foreign trade, national defence and rail and air transport. In this direct procedure, the government relies on cooperation with the board of delegates.
(3) The Assembly of Authors is called upon to ensure that the tasks of economic and cultural construction are carried out in Slovakia.
It is primarily responsible for:
develop a draft plan for the development and implementation of the national economy of Slovakia;
draw up and implement the draft budget of Slovakia;
hold, within the framework of the tasks identified by the State Plan, the material and financial resources needed for the economic implementation of the National Economy Development Plan of Slovakia;
manage and unify the work of the delegateofficers,
manage and unify the work of the National Committees in Slovakia and the work of their Councils with the right to review and amend or revoke the resolutions and measures of the National Committees and their Councils,
manage the development and implementation of local development plans and local budgets,
ensuring public order, the protection of citizens' rights and the interests of the state,
submit draft laws of the Slovak National Council to the Slovak National Council (§ 15) and reports of the board of directors on fundamental issues of socialist construction in Slovakia,
issue regulations to the College of Authors (Section 25),
appoint and withdraw staff within its responsibility and make appropriate proposals to the Government as regards the appointments made by the President of the Republic,
monitor and control the work of undertakings and establishments managed in Slovakia directly by the ministries and assist in the performance of their tasks.
(1) The Board of Authors shall consist of the President, the Vice-Presidents and the other members (delegates).
(2) Bratislava is the regular seat of the Board of Authors.
(3) The mandates are established and repealed by law or by government decree issued under Constitutional Law No. 47 / 1950 Coll.
(4) The Board of Authors shall decide in the College which shall be able to act if at least half of the members are present.
The Board of Authors and its individual members shall appoint and dismiss the Slovak National Council; She also determines which one of them controls which delegates.
The members of the board of delegates take the following oath in the hands of the President of the Slovak National Council: "Sľubujem, that we will be verný Czechoslovak Republic, jej ľudodemocratic zriadeniu and the legacy of Slovak navistania. We will do our duty to keep you alive and alive and in the interest of the woman and the stad. We will maintain constitutional and iné laws, as well as nariadenia and the government."
The Board of Directors and its members shall be accountable to the Slovak National Council and shall be obliged to account for its entire activities.
(1) Both the Board of Authors and its members are in their activities governed by the essential guidelines of the Government. Individual delegates also follow the guidelines of the relevant ministers.
(2) The Government will define a range of questions for which the State plan will only determine the main tasks and identify the basic indicators; in such cases, subject to the fulfilment of the main tasks and basic indicators, the Board of Authors and Authorisations shall act definitively and with responsibility towards the Slovak National Council. In particular, questions will be raised on the sectors of education and culture, health, agriculture and forestry, the local economy, the food industry and the purchase of agricultural products and water.
(3) If the resolution of the College of Authors or the measure of the delegate is contrary to the law or the essential directives of the Government, the Government shall be entitled to revoke such resolution or measure.
(1) In order to implement the laws of the Slovak National Council, the Assembly of Authors (delegates) issues a regulation.
(2) The provisions of Paragraph 90 of the Constitution apply mutatis mutandis to the extent of the powers of the Board of Authors and the method of signing the Regulation.
Provisions common and final.
Government and ministerial regulations issued for the implementation of laws (§ 90 of the Constitution) are valid throughout the country.
This constitutional act replaces the provisions of the fifth chapter of the Constitution. All other provisions of the Constitution and of the Constitutional Law shall also be replaced if they govern matters by way of derogation from this Constitutional Law.
This constitutional law shall take effect on the day of its publication; it shall be carried out by all members of the Government.
