GOVERNMENT REGULATION
of 24 August 2005
on the adjustment of compensation for loss of earnings following the cessation of incapacity for work or invalidity resulting from an occupational accident or occupational disease of soldiers in the exercise of military essential or substitute service and military exercises and on the adjustment of compensation for loss of salary after the cessation of incapacity for service or invalidity arising from an occupational accident or occupational disease (adjustment of compensation for loss of earnings of soldiers)
The Government mandates pursuant to § 71 (3) of Act No. 220 / 1999 Coll., on the course of basic or alternative service and military exercises and on certain legal ratios of soldiers in reserve, and under § 127 (3) of Act No. 221 / 1999 Coll., on professional soldiers:
Compensation for loss of earnings after the cessation of incapacity for work or recognition of full invalidity or partial invalidity resulting from an accident or occupational disease and compensation for loss of wages after the cessation of incapacity for service or recognition of full invalidity or partial invalidity resulting from an accident or occupational disease (hereinafter referred to as "loss of earnings compensation '), belonging to a soldier under a special rule of law (1), shall be adjusted by increasing the average earnings payable for the loss of earnings.
(a) by 25,4% where a claim for compensation for loss of earnings is made between 1 December 1999 and 31 December 1999;
(b) by 19,4% where a claim for compensation for loss of earnings is made between 1 January 2000 and 31 December 2000;
(c) by 14,9% where a claim for compensation for loss of earnings is made between 1 January 2001 and 31 December 2001;
(d) by 7,9% where a claim is made for compensation for loss of earnings between 1 January 2002 and 31 December 2003;
(e) 5,4% where a claim for compensation for loss of earnings is made between 1 January 2004 and 31 December 2004.
The adjustment provided for in Article 1 shall be made without the request of the soldier; at the request of a soldier, shall be made in cases where he has not received compensation for loss of earnings only as a result of an increase in the invalidity or partial invalidity pension under the social security rules or an increase in the full invalidity or partial invalidity pension under the pension scheme.
Compensation for loss of earnings under this Regulation shall be due from 1 September 2005.
This Regulation shall enter into force on 1 September 2005.
