DECLARATION
of 17 September 2003
on the information system of the State Veterinary Administration
The Ministry of Agriculture provides pursuant to Section 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., ("the Act ') for the implementation of Section 48 (2) of the Act:
§ 1
Subject matter
This decree, in accordance with the law of the European Communities (1), regulates:
(a) the method of establishing, operating and using the information system of the State Veterinary Administration (hereinafter referred to as the Information System);
(b) registers created directly in the information system and the way in which registers are taken from other information systems used for the exercise of public administration, 2)
(c) the principles of computer records of veterinary activities;
(d) the link between the information system and the information systems of the European Union (the Union) in the field of veterinary care.
§ 2
Definition of terms
For the purposes of this decree:
(a) by interfaces between the information system and other public administrations - a set of measures which determine the way data are exchanged through the data network within the scope of the Ministry of Agriculture;
(b) the interface of the information system to the public - the website of the State Veterinary Administration providing public information in the field of veterinary care,
(c) information system standard ("standard") - set of rules for the performance of professional activities related to the creation, use and development of the information system, 3)
(d) data element - a data unit which is considered to be indivisible in a given context and is clearly defined .4)
§ 3
(1) The rights and obligations of persons when processing personal data are governed by a special law. 5)
(2) In the operation of the information system, the State Veterinary Administration shall comply with binding standards and ensure the protection and safety of information within the information system operated. The protection and security of information stored in the information system shall be governed by specific legislation. 6)
How to create an information system
§ 4
State Veterinary Administration is an information system administrator, 7) which consists of:
(a) a register of holdings and other bodies subject to national veterinary supervision;
(b) the animal register,
(c) the register of approved veterinary medicinal products and veterinary medicinal products;
(d) register of public administration contact points for the veterinary care agenda;
(e) a register of diseases and diseases communicable from animals to humans;
(f) the register of veterinary laboratories.
§ 5
(1) The register of holdings contains standard identification data such as the registration number and address of the holding, the name and surname or the name of the breeder, the birth number, the date of birth or the identification number of the breeder, the permanent residence or registered place of residence of the breeder (register of economic operators, 8) of the population, 9) of the territorial identification register of addresses), as well as other data necessary for the performance of the national veterinary surveillance tasks, collected by regional veterinary authorities by region.
(2) The register of other bodies subject to national veterinary supervision contains standard identification data, such as the name and surname or name of the body, the birth number or, if there is no birth number, the date of birth or the entity's identification number, permanent residence or registered office (the register of economic operators, the population register, the geographical identification register of addresses), details of the undertaking, establishment and, where appropriate, of any other establishment of each body and of its activities, as well as other data needed for the performance of the national veterinary supervision tasks.
(3) The register of holdings consists of data taken from the Ministry of Agriculture from the system of labelling and registration of livestock under the specific legislation10) and data from regional veterinary administrations. The register of other bodies subject to national veterinary supervision shall be maintained by the Regional Veterinary Administration and the Municipal Veterinary Administration in Prague (hereinafter referred to as the Regional Veterinary Administration) by region according to § 49 (1) (h).
§ 6
(1) The animal register shall contain the information specified in accordance with specific legislation. 10)
(2) The register of animals consists of data received from the Ministry of Agriculture and data from regional veterinary administrations.
§ 7
(1) The register of approved veterinary medicinal products and veterinary products contains, on the one hand, standard data for identification (the register of economic operators, the territorial identification register of addresses) and, on the other, other data resulting from law and specific legislation. 11)
(2) The register of approved veterinary medicinal products and veterinary medicinal products is kept by the Institute for State Control of Veterinary Bioprafts and Medicines. 11)
§ 8
The register of public administration contact points for the veterinary care agenda contains standard data for identification (register of economic operators, territorial identification register of addresses); it is kept by the State Veterinary Administration.
§ 9
The register of diseases and diseases communicable from animals to humans shall be taken from the records of diseases of the International Office of Disease (OIE) and from the disease reporting system in the Union; shall be based on their scope and structure. It may be extended and more detailed for the purpose of carrying out veterinary care tasks.
§ 10
The veterinary laboratory register shall contain, on the one hand, standard data for identification (economic operator register, geographical identification register of addresses) and, on the other hand, data concerning the authorisation of laboratory diagnostic activities and accreditation; the register of veterinary laboratories is kept by the State Veterinary Administration pursuant to § 48 (1) (j) (6) of the Act.
Records of operations
§ 11
(1) The selection of computerised veterinary care operations is based on the needs and results of national veterinary supervision.
(2) In particular, data on:
(a) monitoring and the state of counter-prevention;
(b) outbreaks of diseases,
(c) the protection and wellbeing of animals;
(d) veterinary checks;
(e) inspections of animals for slaughter and meat and veterinary examinations of wild game meat (hereinafter referred to as game),
(f) the veterinary certificates issued accompanying the animals moved and the animal products transported (hereinafter referred to as the veterinary certificates issued);
(g) compulsory assessments and approved procedures and facilities for heat treatment of milk issued;
(h) the entry into the territory of the Czech Republic of imported and accompanying consignments of veterinary goods (hereinafter referred to as "registration of entry of imported and accompanying consignments");
(i) the results of the laboratory examination of the samples.
§ 12
(1) The surveillance and condition records for anti-cancer prevention include standard data to identify the person checked (link to the register of economic operators, territorial identification register of addresses and those registers). In particular, data relating to the identity of the veterinarian, the species, the date and time of the operation, the persons checked, the animals checked, the cooperation with a private veterinarian, the samples taken, the results of their examination and, where appropriate, the measures taken shall be recorded.
(2) The records of monitoring data and the state of the anti-dumping prevention shall be kept by region; the relevant data shall be recorded by veterinary inspectors.
§ 13
(1) The records of outbreak data contain standard data for the identification of the person checked (link to the register of economic operators, territorial identification register of addresses and those registers). In particular, data concerning the identity of the veterinary inspector, the type of disease, the animals (species, number) concerned, the person concerned, the procedure for the eradication of the outbreak, the samples taken and the results of their examination shall be recorded.
(2) The records of outbreak data are kept by region; the relevant data shall be recorded by veterinary inspectors.
(3) The State Veterinary Administration ensures:
(a) data transfer from this database to the relevant Union Information System (ADNS);
(b) exchange of data from this database with the Integrated Rescue System Information System (Integrated Rescue System Operational and Information Centre). 12)
§ 14
(1) The records of data on the protection and well-being of animals contain standard data for the identification of the checked person (link to the register of economic operators, territorial identification register of addresses and those registers). In particular, data relating to the identity of the veterinary inspector, the species, the date and time of the operation, the person checked, the animals checked and, where appropriate, the action taken shall be recorded.
(2) The records of data on the protection and well-being of animals are kept by region; the relevant data shall be recorded by veterinary inspectors.
§ 15
(1) The records of veterinary checks data contain standard data for the identification of the person checked (link to the register of economic operators, the territorial identification register of addresses and those registers). In particular, data relating to the identity of the veterinary inspector, the dates and times of the inspection, the persons checked, the subject of the inspection, the result of the inspection, including the measures taken and the penalties granted, the samples taken and the results of their examination shall be recorded.
(2) The controls are mainly aimed at:
(a) primary agricultural production;
(b) the production of foodstuffs of animal origin,
(c) the treatment of foodstuffs of animal origin,
(d) processing of technical raw materials of animal origin;
(e) the disposal and further processing of confiscates of animal origin;
(f) consignments of imported veterinary goods at their destination.
(3) The records of veterinary checks data are kept by region. the relevant data shall be recorded by veterinary inspectors.
§ 16
(1) The records of animal and meat inspections and animal health tests contain standard data for the identification of the person checked (link to the register of economic operators, territorial identification register of addresses and those registers). In particular, data relating to the identity of the veterinarian, the identification of the slaughterhouse or game processing undertaking, the identification of the breeder, the farm and the animal slaughter animal, or the chase and its user, the dates and hours of slaughter or capture, the result of the inspection of the slaughter animals and the meat or veterinary testing of the game, the samples taken, the results of their examination and disposal of the specified risk material shall be recorded for each animal (group of animals) or wild game caught.
(2) The records of checks on slaughter animals and meat and animal health checks on game shall be kept by region; the relevant data shall be recorded by veterinary inspectors.
§ 17
(1) The records of data on veterinary certificates issued contain standard data for the identification of interested parties (link to the register of economic operators, territorial identification register of addresses and those registers). In particular, data relating to the identity of the veterinary inspector, the species and number of animals, or the species and quantities of animal products, the consignor and the consignee of the animals or animal products and the date of dispatch shall be recorded.
(2) The records of the veterinary certificates issued shall be kept by region. the relevant data shall be recorded by veterinary inspectors.
(3) In specified cases, regional veterinary administrations shall ensure the generation of and dispatch to the central server of the relevant Union information system (ANIMO computer network).
§ 18
(1) The records of data on the mandatory assessments issued and the approved procedures and facilities for the heat treatment of milk contain standard data to identify interested parties (link to the register of economic operators, the territorial identification register of addresses and those registers). In particular, data relating to the construction plant and its activity, construction or other equipment, and its identification, identification of the treatment undertaking or processing undertaking, where appropriate, the relevant technological process, type and type of equipment, date of issue of the assessment or approval of the process or plant shall be recorded.
(2) The veterinary authorities which issue the opinions and approvals shall keep records of the data on the compulsory assessments issued and the approved procedures and facilities for the heat treatment of milk.
§ 19
(1) The records of entry data for imported and accompanying consignments contain standard data for the identification of the consignment, the importer and the transporter (link to the register of economic operators, the territorial identification register of addresses and those registers). In particular, data relating to the identity of the veterinary inspector, the type of consignment and quantities, the carrier and the transporter, the country of origin and the State of consignor, the consignee, the dates and hours of entry into the Czech Republic, the fulfilment of import conditions, the outcome of the border veterinary inspection, the re-dispatch of the consignment and its reasons and, where appropriate, the action taken.
(2) The database of entry data for imported and accompanying consignments also contains import conditions for animals and animal products, lists of third countries and, where appropriate, parts thereof as well as approved establishments and other establishments from which animals and animal products may be imported and models of the veterinary certificates used.
(3) Registration of entry data for imported and accompanying consignments is carried out at the border veterinary station. It shall be managed by veterinary inspectors carrying out border veterinary checks by means of a special software tool.
(4) Regional veterinary administrations ensure the generation of and dispatch to the central server of the relevant Union information system (ANIMO computer network).
§ 20
(1) The records of the results of the laboratory examination of samples contain standard data for the identification of the checked person (link to the register of economic operators, the territorial identification register of addresses and those registers) as well as the results of the laboratory examination of samples carried out in connection with the performance of national veterinary surveillance, the monitoring plan for certain substances and residues in animals and animal products, the monitoring of selected diseases and diseases communicable from animals to humans, etc. Data relating to the identity of the veterinarian, the person responsible for the examination, the owner of the sample, the date and hours of sampling, the identification of the laboratory, the laboratory method used, the established laboratory parameter and the result of the examination shall be recorded for each sample and the result.
(2) The records of the results of the laboratory examination of samples are kept by the State Veterinary Institute, the Institute for State Control of Veterinary Bioprafts and Medicines and by the laboratories which have been issued for the relevant examination of the accreditation certificate and which have been authorised by the State Veterinary Administration to carry out veterinary laboratory diagnostic activities. The data recorded by the relevant institute or laboratory shall be transferred in the information system to the computer of the relevant regional veterinary administration, where the special software tool allows them to be accepted and processed.
Information system interface
§ 21
(1) The State Veterinary Administration establishes an interface in its information system through which it obtains data from other information systems and provides data to other information systems.
(2) The following agendas and registers are the sources of data:
(a) the register of economic operators (Czech Statistical Office),
(b) population records (Ministry of the Interior),
(c) the territorial identification register of addresses (Ministry of Labour and Social Affairs),
(d) registers of holdings, breeders and animals (Ministry of Agriculture);
(e) National Radiation Monitoring Network13) (National Nuclear Safety Authority).
(3) The exchange of data from registers and records of operations takes place in particular with the relevant administrations and Union information systems.
(4) The codes of the regions of the Czech Republic correspond to the classification of the territorial statistical units CZ-NUTS. The codes of the Member States and certain associated countries of the Union are set out in the Annex hereto.
§ 22
The State Veterinary Administration establishes and operates an interface to the public in its information system, which consists of an Internet presentation of selected information intended for the public via a website.
Provisions common and final
§ 23
An integral part of the information system is the communication system that connects veterinary authorities and serves to transmit digitised data. It is built in accordance with the applicable standards of the Ministry of Informatics, (2) an approved strategy to build a communication infrastructure and the requirements of the Union to build and operate a computer network linking veterinary authorities.
§ 24
Efficacy
This decree shall take effect on the day of its publication.
