DECLARATION
Energy Regulatory Authority
of 31 August 2001
laying down the conditions for connection and supply of gas to protected customers
Pursuant to Article 98 (8) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of State Administration in the Energy Sector, and on the amendment of certain laws (hereinafter referred to as "the Act"), the Energy Regulatory Authority shall determine the implementation of § 17 (7) (a) and (d) of the Act and taking into account Article 51 (2) of the Act:
Subject matter
This decree sets out the method of ensuring the supply of gas to protected customers of the required quality and the share of the protected customer in the effectively incurred costs of the distribution system operator associated with the connection and the provision of the required supply of gas. Some other conditions of connection, gas supply and measurement of gas consumption for protected customers include special legislation. 1)
Gas supply quality
(1) The qualitative parameters of the gas are set out in the gas supply contract between the distribution system operator (Section 59 of the Act) and the protected customer.
(2) From the point of view of the safe use of natural gas, it is necessary to supply gas of a quality which complies with the requirements of the interchangeability of the different types of ground gases laid down by the relevant technical regulation. 2)
(3) The change in gas pressure is made after prior notification of the protected customer by the distribution system operator at least 15 days in advance to the protected customer
(a) the supply of gas for cooking and for the preparation of hot water for use between 1 May and 30 September is not interrupted for more than 1 week;
(b) the supply of cooking gas, the preparation of hot commercial water and the heating from 1 October to 30 April of the following year shall not be interrupted for more than 48 hours.
(4) If the distribution system operator fails to deduct the amount of gas collected when the price is changed in accordance with the Energy Regulatory Authority price decision, the method of distribution of the gas supply set out in Annex No 1 shall be followed.
Distribution of protected customers
Protected customers whose gas demand facility is connected to the distribution system shall be classified in the following categories:
(a) household category - a natural person to whom gas is supplied to satisfy his or her personal and household needs;
(b) category of retail - natural person to whom the gas is supplied for business purposes and legal person with an annual collection of up to 630 000 kWh;
(c) category of medium customer - natural person to whom the gas is supplied for business purposes and legal person with an annual take-off of more than 630 000 kWh up to 4 200 000 kWh;
(d) category of wholesale - natural person to whom the gas is supplied for business purposes and legal person with an annual collection of over 4 200 000 kWh.
The share of the protected customer in the purposefully incurred costs of the distribution system operator associated with the connection and securing the required gas supply
(1) The share of the protected customer in the effectively incurred costs of the distribution system operator associated with the connection and the provision of the required gas supply means the financial reimbursement of part of the costs incurred by the distribution system operator to connect a particular demand point to the distribution system and to ensure the supply of gas required by the protected customer.
(2) The share of the protected customer in the effectively incurred costs of the distribution system operator associated with the connection shall be negotiated separately for each case in accordance with the specific legislationm3) and may not exceed 60% of those costs.
(3) The efficient costs incurred by the distribution system operator associated with the provision of the required supply are those incurred by the distribution system operator to build new or increase the performance of existing distribution facilities directly related to that supply.
(4) The method of calculating the efficiently incurred costs of the distribution system operator associated with the provision of the required supply shall be determined by the calculation set out in Annex 2.
(5) The share of the protected customer in the cost-effectively incurred by the distribution system operator associated with the provision of the required supply may not exceed 50% of the calculated costs as set out in Annex 2.
Repeal
Paragraph 4 and Annex No 1 to Decree No. 196 / 1995 Coll., which sets out in more detail the conditions of gas supply and the method of calculating the damage caused by unauthorised gas collection, are hereby repealed.
Efficacy
This decree shall take effect on the day of its publication.

Method of distribution of gas supply for the protected customer within each month of the deduction period
In order to determine the amount of gas supply to protected customers, the following percentage distribution of monthly deliveries shall be used, with the application of a proportion for less than months:
(a) protected customers with a supply above 9450 kWh / year using gas for heating or heating in combination with hot water heating and cooking

Method for calculating the efficiently incurred costs incurred by the distribution system operator associated with ensuring the required gas supply
The amount of the effectively incurred costs incurred by the distribution system operator associated with securing the required gas supply to a particular protected customer shall be determined as follows:
UND = NI.P / k (CZK),
where:
UND = efficiently incurred costs of the distribution system operator associated with the provision of the required supply corresponding to a particular protected customer (CZK),
Ni = investment costs incurred by the distribution system operator on distribution system equipment directly related to the supply (CZK),
P = required hourly power input of the protected customer (kW),
k = installed hourly capacity of distribution system facilities directly related to the gas supply (kW).
