DECLARATION
of 24 October 2022
on guarantees of origin for energy
The Ministry of Industry and Trade, pursuant to § 53 (1) (f) and (ac) of Act No. 165 / 2012 Coll., on Supported Energy Sources and on the Amendment of Certain Acts, as amended by Act No. 131 / 2015 Coll. and Act No. 382 / 2021 Coll., ("the Act '):
Subject matter
This decree provides
(a) the registration of an electricity plant, a biomethane plant, a heat plant, a heat plant from a nuclear installation and a hydrogen plant (hereinafter referred to as the "power plant") in the market operator's system for issuing a guarantee of origin;
(b) the extent of the transmitted data to the market operator from the transmission system operator, transmission system operator, distribution system operator, gas producer, gas station operator or supply unit directly connected to the biomethane factory, hydrogen producer and distribution heat equipment operator for the issue of the guarantee of origin;
(c) measured or calculated values of the amount of electricity, biomethane, hydrogen or heat produced;
(d) procedures, deadlines and conditions for issuing and transferring;
(e) the particulars of the application for guarantees of origin and the transfer of guarantees of origin;
(f) the way in which the guarantee of origin is transferred electronically;
(g) rules on the transfer of guarantees of origin for advanced biomethane; and
(h) the method of determining the share of gas suppliers in the total supply of natural gas and biomethane.
Registration of the energy plant for the issue of the guarantee of energy origin
(1) The energy producer shall register the energy production in the market operator system for the purpose of issuing the guarantee of origin of energy within the scope of the information listed in Annex 1 to this Decree.
(2) If the data referred to in paragraph 1 are changed, the energy producer in the market operator's system shall update the data for the purpose of issuing the guarantee of origin without delay after the change.
Scope of the data transmitted to the market operator for the issue and verification of the guarantee of origin of energy
The energy producer shall transmit to the market operator, through the market operator system, the data necessary for the issue of the energy origin guarantee for the preceding calendar month by the twelfth day of the following calendar month.
Procedures, dates and conditions for the issue and transfer of the guarantee of origin and particulars of the request for the issue and transfer of the guarantee of origin
(1) The issue of a guarantee of the origin of energy, its transfer, recognition and application is only possible after the account has been opened in the register of guarantees of origin.
(2) The energy producer requests the guarantee of origin from the market operator electronically on the basis of the information in Annex 2 to this Decree. The energy producer may request the market operator to issue the maximum available amount of guarantees of origin for the energy production for a given period or to automatically transfer automatically issued guarantees of origin to an account other than that of the energy producer. The requirement for automatic issuance or automatic transfer of guarantees of origin may be terminated at any time by the energy manufacturer in the register of guarantees of origin.
(3) The guarantee of the origin of electricity or the guarantee of the origin of biomethane shall be issued by the market operator at the earliest after the end of the monthly settlement of the derogations under the Decree governing the rules of the electricity market or the rules of the gas market.
(4) The transfer of the guarantee of origin shall be carried out by the market operator by means of a register of guarantees of origin, on the basis of an application by the account holder for the transfer of the guarantee of origin of energy, containing the information set out in Annex 3 to this Decree.
(5) The guarantee of the origin of energy contains:
(a) the designation, name and location of the energy plant;
(b) whether the guarantee of origin of energy relates to electricity, biomethane, advanced biomethane, heat, heat from nuclear installations or hydrogen;
(c) primary energy source and type of energy production plant;
(d) the installed or power output of the power plant;
(e) the date on which the energy plant is operational;
(f) information on the use of investment aid or other forms of aid, the determination of the type of aid scheme and the extent of such aid;
(g) the time period of energy production covered by the energy origin guarantee issued;
(h) the date and country of issue of the guarantee of origin of the energy;
(i) the unique identification number issued by the guarantee of origin of energy;
(j) the quantity of energy covered by the energy origin guarantee; and
(k) an indication of the document demonstrating compliance with the sustainability criteria and greenhouse gas emission savings under the law.
Rules on the transfer of guarantees of origin of advanced biomethane
(1) The gas supplier shall submit to the market operator in the register of guarantees of origin a request for the transfer of the guarantee of the origin of advanced biomethane pursuant to Article 45c (3) and (4) of the Act, in accordance with the model set out in Annex 3 to this Decree, by the end of the calendar month in which it was issued. The application shall include a declaration from the gas supplier containing information on its total supply of natural gas and biomethane, which does not include liquefied natural gas or liquefied biomethane, to gas stations or dispensers in the Czech Republic for the calendar month of energy production for which the guarantee of the origin of advanced biomethane has been issued. The quantity of guarantees of origin of advanced biomethane which the gas supplier requests to be transferred under this paragraph shall not exceed the amount of its total supply of natural gas and biomethane declared in the second sentence.
(2) The transfer of guarantees of origin of advanced biomethane shall be carried out by a market operator pursuant to Article 45c (3) and (4) of the Act by means of a register of guarantees of origin following an application for the transfer of a guarantee of origin of advanced biomethane received under paragraph 1.
Method for determining the share of gas suppliers in the total supply of natural gas and biomethane
The market operator shall determine the share of the supply of natural gas and biomethane of individual gas suppliers on the total supply of natural gas and biomethane for consumption to service stations or storage units in the Czech Republic. The share referred to in the first sentence shall be determined by the market operator in the calendar month as the ratio of the total supply of natural gas and biomethane of the individual gas supplier indicated in the request for the transfer of the guarantee of origin pursuant to Article 5 and the sum of the total supply of natural gas and biomethane from all requests for the transfer of the guarantee of origin referred to in Article 5 from all gas suppliers.
Repeal
They shall be deleted:
1. Decree No. 403 / 2015 Coll., on guarantees of origin of electricity from renewable energy sources and electricity from high-efficiency cogeneration.
2. Decree No. 360 / 2019 Coll., amending Decree No. 403 / 2015 Coll., on guarantees of origin of electricity from renewable energy sources and electricity from high-efficiency cogeneration.
Efficacy
This Decree shall take effect on 1 January 2023.
