GOVERNMENT REGULATION
of 11 September 2013
on the scope and method of providing data to the Salary Information System
The Government orders pursuant to § 137 (3) of Act No. 262 / 2006 Coll., Labour Code:
Subject matter
This Regulation sets out the scope of data on salary and on on-call remuneration, on average earnings and on the personal data of employees affecting the level of pay and the ways in which they are provided by the employer to the Salary Information System.
Scope of the data provided
(1) The employer, with the exception of the employer referred to in paragraph 2, shall provide to the Information System on salaries the data on the staff member to the extent and breakdown referred to in Annex 1 to this Regulation and other data on the employer to the extent and breakdown referred to in Annex 2 to this Regulation.
(2) Employees in intelligence services (1) are provided by the employer with data which are classified under another legislature2) to the extent and breakdowns set out in Annex 3 to this Regulation.
Method of providing data
(1) The data is provided by the employer in electronic form in a secure way using an internet application that is part of the Salary Information System.
(2) The employer, with the exception of the territorial unit, the contribution organisation set up by the local authority, the organisational components of the local authority unit and the State fund, shall, for the first calendar year and for the whole calendar year ("reference period"), provide the data by the last day of the calendar month following the end of the reference period according to:
(a) Article 2 (1) of the administrator of the State Budget Chapter (hereinafter referred to as the "Chapter Administrator");
(b) Paragraph 2 (2) of Section 2 of the Ministry of Finance in a regime corresponding to the appropriate level of secrecy laid down by other legislationsm2).
(3) The employer, which is a contribution organisation set up by a local authority and an organisational component of a local authority, shall provide the data referred to in Article 2 (1) for the reference period to the authority by the last day of the calendar month following the end of the reference period.
(4) The employer who is a State Fund will provide the data referred to in Article 2 (1) for the reference period to the Ministry of Finance by the last day of the calendar month following the end of the reference period.
(5) The administrator of the chapter and the local authority shall provide the data referred to in Article 2 (1) for the reference period for all employers and employees under its responsibility to the Ministry of Finance by the fifth day of the second calendar month following the end of the reference period.
Common provisions
(1) The employer who provides incorrect data shall provide corrected data to the Ministry of Finance within 2 working days of the date on which the error was detected or was brought to the attention of the employer.
(2) The Ministry of Finance shall keep the data provided under Paragraph 3 (2) (b) under a regime appropriate to the appropriate classification level.
Transitional provisions
(1) The Information System on salaries also includes data provided by the employer under Government Decree No. 289 / 2002 Coll., as amended by Government Decree No. 514 / 2004 Coll.
(2) The data for 2013 are provided by employers according to Government Decree No. 289 / 2002 Coll., as amended by Government Decree No. 514 / 2004 Coll.
Efficacy
This Regulation shall take effect on 1 January 2014.
