DECLARATION
of 8 September 2009
amending Decree No. 149 / 2006 Coll., implementing Act No. 676 / 2004 Coll., on compulsory alcohol labelling and amending Act No. 586 / 1992 Coll., on Income Tax, as amended, as amended, Act No. 545 / 2005 Coll.
According to Section 32 of Act No. 676 / 2004 Coll., on the compulsory marking of alcohol and on the amendment of Act No. 586 / 1992 Coll., on income taxes, as amended, for the implementation of Sections 5 (5), 6 (2), 7 (9) and 11 (6) of the Act:
Decree No. 149 / 2006 Coll., implementing Act No. 676 / 2004 Coll., on the compulsory marking of alcohol and amending Act No. 586 / 1992 Coll., on Income Tax, as amended, as amended, as amended by Act No. 545 / 2005 Coll., is hereby amended as follows:
1. In Article 2, the words "content requirements'," orders' are replaced by "application for allocation ', the words" content' are replaced by the words "volume concentration 'and the words" and settlement' are deleted.
2. Article 3, including the title, reads:
Model, dimensions, accessories and safety features of the tape
(1) Control tapes are manufactured in three dimensions specified in millimetres
(a) 90 x 16,
(b) 150 x 16,
(c) 210 x 16.
(2) The control tape shall show the 10-digit control tape entry code comprising the four-digit registration sampling number, the application code for the control tapes and the classification code by volume concentration level of ethanol.
(3) The control tape is made of a price paper with an original continuous watermark. The price paper is free of its own fluorescence in the UV spectrum area at 366 nm and is secured by one kind of invisible fibres shining in the UV spectrum area at 366 nm. The tape is printed with offset and liner copper. The offset is printed with specific line subprinting frames containing iris transitions covering the entire area of the control tape and the words "Czech Republic."
(4) All the texts and the control tape registration code are placed parallel to the longer side of the control tape. The guilloche containing micropismo is printed with a liner rotogravure. The protective holographic strip is parallel to the shorter side of the control tape.
(5) The model of the surveillance tape is set out in Annex 1 to this Regulation. "
3. Paragraph 4 (1) reads as follows:
"(1) The control tape shall be applied to the consumer packaging of the alcohol by the face side up through the consumer packaging closure so that the middle part of the tape is on the top of the cap and that the right and left parts of the tape are glued along the neck of the consumer packaging of the alcohol, unless otherwise specified. If the shape of the consumer package so permits, the check tape shall be applied in the form of a letter U; if this is not possible in view of the atypical shape of the consumer package, the tape shall be glued in the form of a letter L. The check tape shall not be folded or overlaid in a way which would not allow it to be checked without infringing it. '
4. In Section 6, the word "orders' is replaced by" applications for allocation '.
5. In Paragraph 6 (1), the word "order 'is replaced by" application for allocation'.
6. In Paragraph 6 (1) (d), "volume 'is replaced by" content'.
7. in Article 6 (1) (e), "content" is replaced by "volume concentrations" and "(§ 6)" is replaced by "(§ 7)."
8. In Paragraph 6 (2), the word "orders' is replaced by" applications for allocation '.
9. In the title and the introductory part of Section 7, the word "content 'is replaced by" volume concentrations'.
10. in Paragraph 8 (1), the word "orders" is replaced by the words "requests for the allocation of control tapes" and the word "content" is replaced by "volume concentration."
11. in Paragraph 8 (2), the word "order" shall be replaced by the words "request for the allocation of surveillance tapes" and the word "order" shall be replaced by "request for allocation."
12. In Section 9, the words "and settlement 'are deleted.
13. in Paragraph 9 (2):
"(2) Damaged or contaminated control tapes shall be returned by the registered person to the customs office at which the control tapes were taken, improved on loose sheets; where justified, the customs office may allow another method. ';
14. in Article 9, paragraphs 4 and 5 are deleted;
15. in Paragraph 10 (1), the word "destroyed" shall be inserted after the word "issued."
16. In Paragraph 10 (2), the words "and the accounting document certifying the payment of the surveillance tapes to the customs office 'are deleted.
17. In Annex 2, the words "and, where appropriate, the electronic address and telephone number 'shall be inserted after the words" Address of permanent residence'.
18. In Annex 3, the words "and, where appropriate, the electronic address and telephone number 'shall be inserted after the words" Seat'.
19. In the title of Annex 6, the word "orders' is replaced by the words" applications for allocation '.
20. In Annex 6, "ORDER 'is replaced by" APPLICATION FOR ALLOCATION' and "Volume 'is replaced by" Content'.
21. In Annex 7, the words "Name, surname or business name, tax identification number and address of the entity carrying out the alcohol marking on the basis of a contractual relationship with a registered person2 'are replaced by the words" Name, surname or business name and address of the foreign supplier (Section 12 of the Act) 2'.
22. In Annex No 7, explanatory note 2, the words "the body to carry out the alcohol marking by the control tape 'are replaced by the words" and foreign supplier'.
23. In Annex 7, explanatory note 3, the word "order 'is replaced by" application'.
24. Annex 8 shall read as follows:

25. In Annex 9, the words "Contracting us4) 'are replaced by the words" Destruction4)'.
26. In Annex 9 to Explanatory Note 4, the following text is added: "The quantity of pieces of control tape which have been destroyed or in connection with the labelling of the consumer packaging of alcohol. '
Efficacy
This Decree shall take effect on 1 October 2009.
