THE LAW
of 30 November 1999
on civil ID cards
Parliament has decided on this law of the Czech Republic:
BASIC PROVISIONS
(1) The Ministry of the Interior ("the Ministry '), the municipal authorities of the municipalities with extended competence and in the capital city of Prague, the authorities of the urban areas designated by the Statute of the Capital City of Prague (" the mandated office') and the Police of the Czech Republic ("the police ') use data from the basic population register to the extent
(a) surname;
(b) the name and, where appropriate, the names,
(c) the address of the place of stay,
(d) date, place and district of birth; the date, place and state of birth of the data subject born abroad;
(e) the date, place and district of death; if the death of the data subject is outside the territory of the Czech Republic, the date of death, the place and the State in whose territory the death occurred; if the court's decision on the declaration of death is given, the date indicated in the decision as the date of death or the date on which the data subject declared to be dead did not survive and the date on which the decision was acquired;
(f) citizenship and, where appropriate, multiple citizenship; and
(g) the data needed for electronic identification and authentication.
(2) The Ministry shall use all data from the information system for the registration of citizens' cards (hereinafter referred to as "the registration of citizens' cards') for the performance of the administration on the civil card section; the identification of the natural person's agenda identifier shall be used only for the purpose of ensuring the registration of data protection and the administration of the registration of civil cards. The competent authorities and the police shall use all data in the performance of the administration on the civil card registration section, except for the natural person's agent identifier for the civil card agenda and operational data.
(3) The Ministry, the competent authorities and the police from the population registration information system shall use data in order to perform the administration on the civil ID section.
(a) the name and, where appropriate, the names, surnames and, where appropriate, their change, surnames;
(b) the date of birth;
(c) sex and its change;
(d) the place and district of birth and, in the case of a citizen born abroad, the place and state of birth;
(e) the birth number and its change;
(f) citizenship;
(g) the address of the place of permanent residence, including the previous address of the place of permanent residence;
h) the beginning of the permanent residence or, where applicable, the date of cancellation of the permanent residence or the date of termination of the permanent residence in the Czech Republic;
(i) limitation of inefficiency;
(j) custody;
(k) the date on which the decision of the court to waive parental responsibility became final, the reference number of this decision and the designation of the court to waive parental responsibility and the date on which the decision to waive parental responsibility was annulled;
(l) the birth number of the father, mother or other legal representative, as appropriate; where one of the parents or other legal representative is not assigned a birth number, name or, where applicable, names, surname and date of birth;
(m) family status, date, place and district of marriage, where marriage has been concluded outside the territory of the Czech Republic, place and state, date of acquisition of legal power of the court's decision to declare marriage invalid, date of acquisition of legal power of the court's decision on the apparent marriage, date of termination of marriage by the death of one of the spouses, or date of acquisition of legal power of the court's decision to declare one of the spouses dead, and date of final decision of the court of death as the date of death, or date of acquisition of legal power of the court's decision to divorce of marriage;
(n) the date and place of the establishment of the partnership, the date on which the court of invalidity or the absence of a partnership, the date on which the partnership was terminated by the death of one of the partners, or the date on which the court's decision to declare one of the partners dead was taken, and the date on which the court of the court of death was designated as the date of death, or, where appropriate, the date on which the court of annulment of the partnership was acquired;
(o) date of death,
(p) the date indicated in the decision of the court on the declaration of the missing person as the date on which the publication of the missing person's declaration took effect and the date on which the decision of the court on the missing person's declaration was acquired;
(q) the date given in the court's decision on the death declaration as the day of death, or the day which he did not survive.
Data which are kept as references in the population base register shall be used from the population registration information system only if they are in the form preceding the current situation.
(4) The Ministry, the authorities and the police in charge of the travel document registration system shall use data to the extent of:
(a) the name and, where appropriate, the names, surnames and abbreviated forms of the name and, where applicable, names and surnames, if they are entered in the travel document;
(b) date, place and district of birth; for a citizen born abroad, only the State of birth,
(c) the number and type of travel document issued;
(d) the expiry date of the travel document;
(e) the number and type of travel document lost, stolen or invalid; and
(f) digital photography and signature processing.
(5) From the data referred to in paragraphs 1 to 4, only such data as are necessary to fulfil the task may be used in a particular case.
(6) The Ministry and the municipal authorities of the municipalities with extended competence are using a special application programme for the purposes of issuing the civil certificates referred to in Article 2 (2) (a), which ensures the collection of data in the municipal authorities of the municipalities with extended scope for the needs of the manufacturer to personalise the documents, to hand over the documents to the holders and to claim them.
USE OF DATA FROM PUBLIC MANAGEMENT INFORMATION SYSTEMS
Use of data from public administration information systems
(1) The administration of basic registers uses data to the extent that, in the exercise of its competence in the field of civil certificates from the basic population register,
(a) surname;
(b) the name and, where appropriate, the names,
(c) the address of the place of stay and, where applicable, the address to which the documents are to be served under another legislation;
(d) date, place and district of birth; for a natural person who was born abroad, the date, place and state of birth;
(e) the date, place and district of death; if there is a death outside the territory of the Czech Republic, the date of death, the place and the State in whose territory the death occurred; if the court's decision on the declaration of death is given, the date indicated in the decision as the date of death or the date on which the natural person did not survive and the date on which the decision became final,
(f) citizenship and, where appropriate, multiple citizenship.
(2) The administration of basic registers uses data to the extent that, in the exercise of its competence in the area of civil certificates from the population information system,
(a) the name and / or the names, surnames and surnames,
(b) date, place and district of birth; for a citizen born abroad, the date, place and state where he was born,
(c) sex;
(d) citizenship and, where appropriate, multiple citizenship;
(e) the address of the place of permanent residence and, where applicable, the address to which the documents are to be served under another legislation;
(f) the name and, where applicable, the name, surname and surname of the father, mother, husband, partner of the holder or, where appropriate, the name, surname, surname and birth number of the child of the holder; the data are used by the Administration of the basic registers only to verify the identity of the holder requesting the blocking of the authentication function of the holder;
(g) date, place and district of death; if there is a death outside the territory of the Czech Republic, the date, place and state on whose territory the death occurred,
(h) the date indicated in the court's decision on the death declaration as the date of death or the date on which the data subject declared dead did not survive.
(3) The administration of the basic registers makes use, in the exercise of its powers, of data in the civil registration section
(a) the name and, where appropriate, the names, surnames and abbreviated form of the second or composite surnames, provided that they appear on the identity card;
(b) sex,
(c) citizenship;
(d) date of birth;
(e) place and district of birth; the person who was born abroad, the place and state where he was born,
(f) the address of the place of permanent residence, including the indication of this information as the address of the Office, if so indicated in the population registration information system, the beginning of the permanent residence, or the date of cancellation of the residence or the date of termination of the permanent residence in the Czech Republic;
(g) family status or registered partnership information, provided that they are included in the identity card;
(h) birth number,
(i) the date of death, or, if the court's decision on the death declaration is given, the date on which the decision is mentioned as the day of death, or, where appropriate, as the day on which the person declared dead did not survive, and the date on which the decision was acquired;
(j) the number or series of identity cards, where applicable;
(k) the date of issue of the identity card;
(l) the date of receipt of the identity card;
(m) the expiry date of the identity card;
(n) the date of invalidation of an invalid identity card and its retention or surrender,
(o) an indication of the administrative authority which issued the identity card;
(p) data on the data medium;
(q) the number and, where applicable, the series and date of effective expiry of the invalid identity card;
(r) the registration number; and
(s) an application for an identity card in electronic form.
(4) Data which are kept as references in the population base register shall be used from the population registration information system only if they are in the form preceding the current situation.
(5) From the data referred to in paragraphs 1 to 3, only such data as are necessary to fulfil the task may be used in a particular case.
