GOVERNMENT REGULATION
of 21 September 2016
amending Government Regulation No 304 / 2014 Coll., on the remuneration of civil servants, as amended by Government Regulation No 279 / 2015 Coll.
The Government orders pursuant to § 145 (1) and § 148 (1) of Act No. 234 / 2014 Coll., on Civil Service, and pursuant to § 129 (2) of Act No. 262 / 2006 Coll., Labour Code, as amended by Act No. 362 / 2007 Coll.:
Government Regulation No 304 / 2014 Coll., on the remuneration of civil servants, as amended by Government Regulation No 279 / 2015 Coll., is amended as follows:
1. In Article 1, paragraphs 3 and 4 are added:
"(3) A public servant who is classified or appointed to a post for which a grade of at least 12 is fixed, which is designated as key in the Staff Regulations of the Service Authority and for which a branch of the Civil Service (hereinafter referred to as" the Service ') referred to in Annex 1 to this Regulation is designated, may determine a fee of up to twice the salary of the highest grade in the level specified for the post to which the staff member is assigned or appointed. The precondition for the procedure under the first sentence is that a civil servant performs the most complex, responsible and burdensome tasks at the place of service, the performance of which is indispensable for the service office to ensure the proper exercise of its competence and requires the highest level of knowledge, skills and experience in the relevant field of service. The Staff Authority may designate not more than 5% of the posts in the Staff Office as key in the Staff Regulations.
(4) The salary fare referred to in paragraph 3 may be fixed to the public servant for a maximum period of one year, repeatedly. ';
2. In Paragraph 2 (1), "1 'is replaced by" 2';
3. In Paragraph 2 (2), "2 'is replaced by" 3'.
4. In Article 3 (1), "paragraph 2 'is replaced by" paragraphs 2 and 3';
5. in Article 3 (2) (a) (1), the word "State" and the words "(hereinafter referred to as" Service ") shall be deleted;
6. In Article 3, the following paragraphs 3 and 4 are inserted after paragraph 2:
"(3) To the periods referred to in paragraph 2, a five-year period shall be added to the staff member if, according to the conclusions of the two successive service evaluations referred to in the first sentence of Section 155 (2) of the Civil Service Act, he has achieved excellent results in the service and the result of the calculation provided for in Section 5 of the Government Regulation governing the details of the service evaluation of civil servants was 6,1.
(4) For the repeated procedure referred to in paragraph 3, the service evaluation for the fourth calendar year following the last procedure referred to in paragraph 3 may be used first. ';
Paragraph 3 shall become paragraph 5.
7. In Article 3, the following paragraph 6 is added:
"(6) In the course of the procedure referred to in paragraph 3, the national staff member shall be entitled to a higher level of pay from the first day of the second calendar month following the performance of the professional evaluations. ';
8. In the second sentence of Article 6 (1), "3 'is replaced by" 4'.
9. The following Annex 1 is inserted:
"Annex No 1 to Government Regulation 304 / 2014 Coll.

1. Medical Assessment Service
2. Legislation and Legal Activities
3. Information and communication technologies'.
Annexes 1 to 3 to date shall be renumbered Annexes 2 to 4.

11. In Annex 4, in Group I, the following point 9 is added:
'9. Activities requiring individual access to individual cases or decision-making when choosing from multiple options, consisting of continuous direct personal contact with citizens in the performance of the assessment service.
The amount of the special supplement shall be determined by the service authority according to the neuropsychological burden given by the increased likelihood of creating and dealing with conflicting or emotionally tense situations, with limited time and spatial disposition, the performance of service outside the workplace in the natural environment of persons or in other unknown and risky environments and with a risk resulting from the unpredictability of behaviour of persons. ';
Transitional provision
For the purposes of the procedure referred to in Article 3 (3) of Decree-Law No 304 / 2014 Coll., as effective from the date of entry into force of this Regulation, the service evaluation carried out for the calendar year 2016 shall be used as the first service evaluation.
Efficacy
This Regulation shall be binding in its entirety and directly applicable in all Member States.
