laying down the characteristics of adequate connection requirements at a fixed point to the public communications network and access at a fixed point to a publicly available telephone service and the conditions for access to the Internet within the universal service
The Ministry of Informatics provides pursuant to Section 150 (2) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (the Act on Electronic Communications) ("the Act ') for the implementation of Section 40 (7) of the Act:
Characteristics of the appropriate connection requirement in a fixed place to the public communications network
(1) An adequate requirement for connection at a fixed point to a public communications network within the universal service (hereinafter referred to as the "connection") is a requirement for the establishment of a single local connection circuit (1) (hereinafter referred to as the "connection circuit"), ending at the end of the network point of the place of residence, if the user is a non-commercial natural person, or at the place of business, if the user is a legal person. The universal service provider, to which an obligation under Paragraph 38 (2) (a) of the Act has been imposed, establishes this circuit through a public communications network operated by it or another operator's public communications network.
(2) A reasonable requirement under paragraph 1 shall not be the requirement of a user to whom a trailer circuit has already been established. This does not apply to connection in a fixed location for disabled persons under Section 43 (4) of the Act.
(3) Furthermore, the proportionate requirement referred to in paragraph 1 shall not be a requirement for connection in a fixed location with difficult availability or a fixed location in which the setting-up of the connection would entail costs significantly above the normal level, provided that a signal of at least one public mobile telephone network is available at that location. Signal availability means the level of received signal at a fixed point of the user that is not worse than the reference level specified in ETSI EN 300 910 V8.5.1
Characteristics of adequate access requirement at a fixed location to a publicly available telephone service
(1) An adequate requirement for access in a fixed place to a publicly available universal service telephone service (hereinafter referred to as "access") is an access requirement which allows, directly or indirectly, national and international telephone calls to be made in the spoken language, facsimile communication for analogue interfaces and data transfer for Internet access under the conditions set out in Section 3.
(2) The access referred to in paragraph 1 shall allow access to the publicly available telephone service of each service provider.
Conditions for Internet access
(1) The connection circuit shall allow data transmission at speeds sufficient for applications used via narrowband access.
(2) Access to the Internet must also include the possibility to verify the actual rate of data transmission with a minimum time of 5 minutes, by accessing the participant's terminal device to the universal service provider's test equipment for measuring the speed of data transmission.
Efficacy
This Decree shall take effect on 1 July 2006.
