DECLARATION
of 10 August 2005
amending Decree No. 218 / 2001 Coll., laying down details of electricity measurements and transmission of technical data, as amended by Decree No. 450 / 2003 Coll.
The Ministry of Industry and Trade provides pursuant to § 98 (6) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 670 / 2004 Coll., for the implementation of § 24 (10) (e), § 25 (11) (f) and § 27 (6) of the Act:
Decree No. 218 / 2001 Coll., laying down the details of electricity measurements and transmission of technical data, as amended by Decree No. 450 / 2003 Coll., is amended as follows:
1. In Paragraph 2 (1), the word "Securing 'is replaced by" Securing'.
2. Paragraph 2 (2) reads as follows:
"(2) Measurement shall determine the quantity of active or reactive electricity supplied or collected and its time course. ';
3. In Article 2, paragraphs 3, 4 and 5 are deleted.
Paragraphs 6 to 10 shall become paragraphs 3 to 7.
4. Paragraph 2 (4) reads as follows:
"(4) The following shall be used to measure the amount of electricity and evaluate the power transmitted:
(a) continuous measurement of electricity with daily remote transmission of data (hereinafter referred to as Type A measurement);
(b) other current measurements of electricity (hereinafter referred to as type B measurements);
(c) other measurements of electricity (hereinafter referred to as "Type C measurement." ';
5. In Section 2, at the end of the text of paragraph 5, the words "directly measured equipment 'are added.
6. In Article 2 (6), the words "from 1 November 2001 'are deleted.
7. In Article 2 (7), "kW and kWh 'is replaced by" kW, kWh, kVar and kVArh';
8. In Article 2, the following paragraph 8 is added:
"(8) Where it is not possible, for technical or economic reasons, to fit the relevant measurement in accordance with Article 3 at a given sampling or transfer point, the electricity shall be measured in another appropriate way in accordance with paragraph 4. ';
9. The heading of Section 3 reads: "Measuring equipment."
10. in Article 3 (1) and (2):
"(1) The location of the measuring devices is specified in the connection contract.
(2) In order to ensure the measurement of electricity,
(a) measurement of type A
1. transfer points between the transmission system and foreign systems,
2. transmission points between transmission and distribution systems with a voltage greater than 1 kV;
3. the final customers' demand points with electricity from the transmission system, if the final customer has fulfilled the obligation under Paragraph 49 (2) of the Act,
4. transfer points between distribution systems with a voltage greater than 52 kV;
5. the transmission points of electricity producers with installed power of 400 kW, provided that the electricity producer has complied with the obligation under Paragraph 49 (2) of the Act;
6. final customers' demand points with a voltage of more than 52 kV, provided that the final customer has complied with the obligation under Paragraph 49 (2) of the Act; and
7. final customer demand points with a voltage of 1 kV to 52 kV and a reserved input of 400 kW if the final customer has fulfilled the obligation under Paragraph 49 (2) of the Act;
(b) at least by measuring type B
1. the transmission points of electricity producers with installed power from 100 kW to 400 kW, if the manufacturer has fulfilled the obligation under Paragraph 49 (2) of the Act,
2. final customer demand points with a voltage of between 1 kV and 52 kV including, if the final customer has fulfilled the obligation under Paragraph 49 (2) of the Act, the demand points of final customers with a voltage of between 1 kV and 52 kV inclusive and a reserved power of up to 400 kW,
3. transfer points between different distribution systems with a voltage of 1 kV to 52 kV inclusive; and
4. final customer demand points with a voltage of up to 1 kV, with a reserved power input of 100 kW or with a main security element of nominal current of 200 A from the first change of the electricity supplier, provided that the final customer has fulfilled the obligation under Paragraph 49 (2) of the Act;
(c) at least by measuring type C
1. the transmission points of other electricity producers; and
2. the sampling points of other final customers with the electricity from the distribution system with the installed measurement. ';
11. in Paragraph 3 (3), the words "Czech Railways" are replaced by the words "rail transport," "1000 W" is replaced by the words "1 kW" and the last sentence is deleted.
12. in Article 3 (7), the words "owned by the transmission system operator or the relevant distribution system operator" and the words "notified" shall be inserted after the words "to the electricity market participant concerned";
13. in Article 3 (8), the words "measuring points" shall be replaced by "installations."
14. in Article 3, paragraph 9 is deleted;
15. in Article 4 (1) (b), the words "with interested parties" shall be replaced by the words "between the electricity market participants concerned."
16. in Article 4, at the end of point (b), the dot is replaced by a comma and the following point (c) is added:
"(c) the measured values in kWh, kW, kVArh and kVar increased in the case of collection or reduced in the case of supply by the relevant price decision of the Energy Regulatory Authority or by the values agreed in the connection contract or in the electricity distribution contract if the electricity consumption or supply is measured on the secondary side of the transformer.";
17. in Paragraph 4 (2):
"(2) The actual values of electricity supplies and withdrawals shall be the input data for the evaluation of the electricity collection or supply of the market participant concerned. The measurement and transmission of the results of the measurement of electricity shall be carried out by the owner of the measuring equipment concerned at the transmission points where the supply and supply of electricity are carried out for several natural or legal persons. ';
18. in Article 4 (3), the words "deliveries and withdrawals" shall be replaced by the words "withdrawals and deliveries" and the words "and, where appropriate, traders," shall be replaced by the words "or electricity producers."
19. Paragraph 4 (5) reads:
"(5) In the event of a failure of the measuring equipment, the replacement values for the sampling and supply of electricity shall be calculated or taken from the measurement in a manner agreed by the contractors. ';
20. Paragraph 4 (6) is deleted.
21. in Article 5 (1) (a), "measuring" is replaced by "evaluation."
22. in Article 5 (1) (c), the words "reserved performance" are replaced by the words "reserved capacity."
23. in Paragraph 5 (1), the comma at the end of point (c) shall be replaced by a dot and point (d) shall be deleted;
24. in Article 5 (2) (a), "measuring" is replaced by "evaluation."
25. in Article 5 (2) (b), the words "reserved performance" are replaced by the words "reserved capacity."
26. in Article 5 (3) (a), including footnote 1,
"(a) the deduction shall be carried out at least once per calendar year; In addition, the state of the measuring equipment is specified (1) when the electricity supplier or the electricity customer changes,
1) Paragraph 21 (6) (d) of Decree No 373 / 2001 Coll., laying down the rules for the organisation of the electricity market and the principle of pricing for the activities of the electricity market operator, as amended. '
27. in Article 5 (3) (b), the words "reserved performance" are replaced by the words "reserved capacity for voltage up to 1 kV";
28. Paragraph 5 (4) is deleted.
29. In Section 6 of the introductory part of the provision, the words "with electricity 'shall be inserted after the words" market operator'.
30. Paragraph under the table in the Annex to Decree No. 218 / 2001 Coll. reads:
"The accuracy class symbol shall be the number indicating the limits of the permitted percentage error for all measurement range values at the unit power factor (and for multi-phase electrometers with symmetrical load) if the electrometer is tested under reference conditions, i.e. including tolerances for reference values defined by the relevant Czech technical standard. ';
This Decree shall take effect on 1 September 2005.
