DECLARATION
of 11 November 2010
on the announcement of the National Natural Monuments of the Chýnovská Cave and the establishment of its closer protection conditions
The Ministry of the Environment provides pursuant to § 79 (4) (h) of Act No. 114 / 1992 Coll., on the Conservation of Nature and Landscape, as amended by Act No. 218 / 2004 Coll., Act No. 312 / 2008 Coll. and Act No. 349 / 2009 Coll.:
Definition of the national natural heritage and its protection zone
(1) The National Natural Monument of the Chýnovská Cave (hereinafter referred to as the "National Natural Monument") and its protection zone are announced.
(2) The national natural monument is situated in the territory of the South Bohemia Region, in the cadastral territory of Lower Hořice. The boundaries of the national natural monument shall be determined by a closed geometric pattern with direct sides whose vertices are determined by coordinates of the uniform trigonometric network of the cadastral1). The list of coordinates of the vertices of the geometric pattern as they follow in the pattern is given in Annex 1 to this decree.
(3) The protection zone of the national natural heritage is situated in the territory of South Bohemia region, in the cadastral territory of Lower Hořice. The boundaries of the national natural heritage protection zone shall be determined by a closed geometric pattern with direct sides whose vertices are determined by coordinates of a single trigonometric network of cadastral1). The list of coordinates of the vertices of the geometric pattern as they follow in the pattern is given in Annex 2 to this decree.
(4) An indicative graphic representation of the territory of the national natural monument and its protection zone is given in Annex 3 to this Decree.
Subject matter of protection
National natural monuments are protected by:
(a) underground and surface karst phenomena formed in coarse and dolomite crystalline limestone and non-crass moldanubica rocks, including the complex of the Hýnov cave, including the natural filling of caves;
(b) rare mineral forms, in particular the purple variety of tremolite hexagonite,
(c) the natural communities of caves, including rare and endangered species of animals, in particular populations and biotope of a highly endangered species of albacore (Myotis nattereri),
(d) habitat types and species for which another legislation (m2) has been declared a European significant site in the Chýnov Cave and which are located in the territory of the national natural heritage.
Closer protection conditions
Only with the consent of the competent nature conservation authority can the national natural monument
(a) make changes to the types of land or methods of exploitation (3);
(b) make changes to completed constructions or changes to structures before their completion (4);
(c) to operate publicly available parts of the Chýnov Cave, including sales and other related services;
(d) carry out research in caves or research into natural phenomena on the surface that are related to caves that do not cause change or damage to the national natural heritage;
e) enter the public of inaccessible caves,
(f) carry out geological work linked to the earth's surface which does not cause change or damage to the national natural heritage; or
(g) to mark cycling or walking paths.
Efficacy
This Decree shall take effect on 15 December 2010.
