DECLARATION

implementing Article 18 (a), (d), (j), (k), (l) and (m) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and amending and supplementing certain related laws, for tobacco products
According to Article 18 (a), (d), (j), (k), (l) and (m) of Act No. 110 / 1997 Coll., on foodstuffs and tobacco products and amending and supplementing certain related laws (hereinafter referred to as "the Act ') for tobacco products:
Tobacco products
§ 1
For the purposes of this decree:
(a) cigarettes, cylindrical tobacco products, manufactured by machine made of finely cut tobacco filling and cigarette paper packaging connected in the direction of the surface line of the cylinder by a glued link, which may be fitted with a mouthpiece or filter, linked to the cigarette by the mouthpiece;
(b) a cigarette roll of tobacco covered with a cover sheet of tobacco or of reconstituted (homogenised) tobacco in the size of a cigarette which may be fitted with a mouthpiece, filter, filter or straw;
(c) cigars of tobacco rope, coated with a cover sheet or a cover and packaging sheet of tobacco or of reconstituted (homogenised) tobacco, which may bear a mouthpiece, filter, filter or straw mouthpiece;
(d) a cigarette tobacco-cut tobacco mixture for the hand-wrapping of cigarettes, where the cutting width is between 0,5 and 1,2 mm;
(e) smoking tobacco and bubble tobacco, cut tobacco for smoking in pipes or pods, where the width of the cut is not less than 1,2 mm;
(f) snorting tobacco powder or granulated tobacco, prepared for snorting or nasal application;
(g) chewing tobacco in rolls, rolls, strips, cubes or slices, prepared for chewing;
(h) reconstituted (homogenised) tobacco manufactured by the combination of finely fragmented tobacco, tobacco waste and tobacco powder;
(i) raw tobacco naturally or artificially dried tobacco leaves of plants of the species Nicotiana tabacum intended for industrial processing;
(j) tobacco cut from raw tobacco or raw tobacco and tobacco foil at a cut width of 0,5 to 1,2 mm, mixed, moistened and flavoured, intended for the industrial manufacture of cigarettes;
(k) auxiliary materials for the manufacture of tobacco products, the materials forming part of those products, in particular cigarette paper, filter, filter, filter wrapping paper, mouthpiece paper, adhesives, mouthpieces,
(l) artificial packaging material, renewed tobacco (tobacco foil), replacing the cover tobacco or cover sheet for cigars and cigarilos;
(m) a filter part of cigarettes, cigars or cigarilos intended to reduce the content of the harmful substances in the smoke which passes through the filter;
(n) a mouthpiece of a component firmly attached to cigarettes, cigars or cigarilos which comes into direct contact with the mouth during smoking;
(o) an mouthpiece paper which is wrapped around the filter and attached to the end of the cigarette bar,
(p) the packaging of the filter material,
(r) cigarette paper, special paper, intended for industrial production and hand-wrapping of cigarettes,
(s) tar, crude, anhydrous and nicotine-free smoke condensate,
(t) nicotine alkaloids of tobacco.
§ 2
Breakdown of species and groups
The breakdown of tobacco products into species and groups is set out in Annex 1.
§ 3
Labelling
(1) In addition to the information provided for in the law and in the special regulation, (1) the packaging of tobacco products shall be accompanied by:
(a) the name of the type of tobacco product;
(b) for tobacco, the designation and name of the group;
(c) for cigarettes, the average level of tar and nicotine

2. "Nicotine: x mg / cig." where x is given to one decimal place,
(d) quantities in packages of cigarettes, cigarettes and cigars for final consumption;
(e) the quantity in grams for packaging of other end-use tobacco products.
§ 4
(1) The packaging of end-use tobacco products intended for smoking shall be printed on the largest surface with a general health warning "Smoking seriously harms health 'and on other end-use tobacco products with a general health warning" Tobacco seriously harms health'.
(2) In the case of packages of cigarettes, cigars, cigarilos, cigarettes, smoking tobacco and lulac tobacco for final consumption, the second largest surface shall, alternately, contain one of the following special health warnings:
(a) "Smoking causes cancer,"
(b) "Smoking causes heart disease,"
(c) "Smoking causes fatal diseases,"
(d) "Do not smoke if you want to stay healthy!"
(3) The packaging of snuff and chewing tobacco intended for final consumption must bear the following specific health warnings "Causes cancer."
(4) Any general and specific health warnings must be given by the text "The Ministry of Health warns:."
(5) The marking must be printed on the contrast background and outside the places where the packaging may be damaged when opening.
(6) Each general and specific health warning must cover on cigarettes at least 4% of each large box area, on other tobacco products at least 1% of the total packaging surface.
§ 5
Quality requirements
(1) The average tar content of cigarettes is set at a maximum of 12 mg per cigarette, to be determined according to technical norem.2)
(2) The moisture content of tobacco in cigarettes must be between 10 and 14%.
(3) The list of substances authorised to be used in the manufacture of tobacco products is set out in Annex 2.
(4) The list of substances prohibited from use in the manufacture of tobacco products is set out in Annex 3.
§ 6
Entry into circulation
Tobacco products are stored and transported in dry, clean and well-ventilated areas, free of pests and separated from substances with distinct odours and odours.
§ 7
Transitional provisions
(1) The average tar content of cigarettes produced until 31 December 1999 is fixed at a maximum of 14 mg per cigarette.
(2) Cigarettes manufactured until 31 March 1998 which do not meet the requirements referred to in paragraph 1 may be put into circulation for a period of six months after that date.
(3) Cigarettes manufactured until 31 December 1999 meeting the requirements referred to in paragraph 1 may be put into circulation for a period of six months after that date.
(4) Tobacco products not complying with the requirements laid down in Article 4 may be manufactured until 31 May 1998 and put into circulation for a period of six months after that date.
(5) The labelling of tobacco products packed between 1 January 1998 and 31 March 1998 is assessed only to the extent of Section 6 of the Act.
§ 8
Efficacy
This Decree shall take effect on the date of its publication, with the exception of the provisions of Sections 3 and 4, which shall take effect on 1 April 1998.
