amending Act No. 256 / 2004 Coll., on Capital Market Business, as amended, and Act No. 277 / 2009 Coll., on Insurance, as amended
Parliament has decided on this law of the Czech Republic:
Amendment to the Capital Market Enterprise Act

1. In footnote 2, the sentence "Regulation (EU) 2022 / 858 of the European Parliament and of the Council of 30 May 2022 on a pilot scheme for market infrastructures based on the technology of the distributed registry and amending Regulations (EU) No 600 / 2014 and (EU) No 909 / 2014 and Directive 2014 / 65 / EU is added to the separate line. ';
2. In Paragraph 1 (3), at the end of point (o), the word "a 'is replaced by a comma.
3. In Article 1 (3), at the end of point (p), the dot is replaced by a comma and the following point (q) is added:
"(q) a directly applicable European Union regulation governing the pilot regime for market infrastructures based on the technology distributed by the registra109).
(109) Regulation (EU) 2022 / 858 of the European Parliament and of the Council of 30 May 2022 on a pilot scheme for market infrastructures based on the technology of the distributed register and amending Regulations (EU) No 600 / 2014 and (EU) No 909 / 2014 and Directive 2014 / 65 / EU. ';
4. In Article 3, the following paragraph 7 is inserted after paragraph 6:
"(7) An investment instrument is also an investment instrument issued using the technology of the distributed registry."
Paragraph 7 shall become paragraph 8.
5. Paragraph 100 (1) reads as follows:
"(1) A CSD is a person as referred to in Article 2 (1) (1) of Regulation (EU) No 909 / 2014 of the European Parliament and of the Council, which has its registered office in the Czech Republic. ';
6. In Paragraph 135, the dot is replaced by a comma at the end of paragraph 1 and the following point (zf) is added:
"(zf) a person subject to obligations or prohibitions under a directly applicable European Union regulation governing the pilot regime for market infrastructures based on the technology distributed by the registra109). ';
7. In Article 137, the following paragraph 6 is added:
"(6) Lower limits than those established pursuant to Article 3 (1) and (2) of Regulation (EU) 2022 / 858 of the European Parliament and of the Council may be set by the Czech National Bank in accordance with Article 3 (6) of this Regulation against an unspecified circle of persons by general measures. ';
8. In Article 192a, at the end of paragraph 1, the dot is replaced by a comma and the following point (n) is added:
"(n) by the competent authority in accordance with the directly applicable European Union regulation governing the pilot regime for market infrastructures based on the technology distributed by the registra109).";

1. in § 79a (a), "2 500 000" is replaced by "2 700 000."
2. in Article 79a (b) and (c), "3 700 000" is replaced by "4 000 000."
3. in Paragraph 79a (d), "3 600 000" is replaced by "3 900 000."
4. in Paragraph 79a (e), "1 200 000" is replaced by "1 300 000."
5. in Paragraph 131 (1) (c) (1), "6 200 000" is replaced by "6 600 000."
6. in Paragraph 131 (1) (c) (2), "12 800 000" is replaced by "13 600 000."
EFFECTIVE
This Act shall take effect on the day following its publication.
