GOVERNMENT REGULATION
of 31 August 2009
amending Government Regulation No 396 / 2002 Coll., on the use of the resources of the State Housing Development Fund in the form of a loan to cover part of the costs of building an apartment by natural persons affected by floods in 2002, as amended by Government Regulation No 446 / 2002 Coll.
The Government orders pursuant to § 9 of Act No. 211 / 2000 Coll., on the State Housing Development Fund and on the amendment of Act No. 171 / 1991 Coll., on the Jurisdiction of the Bodies of the Czech Republic on Transfers of State Property to Other Persons and on the National Property Fund of the Czech Republic, as amended, as amended by Act No. 61 / 2005 Coll.:
Government Regulation No 396 / 2002 Coll., on the use of the resources of the State Housing Development Fund in the form of a loan to cover part of the costs of building an apartment by natural persons affected by floods in 2002, as amended by Government Regulation No 446 / 2002 Coll., is amended as follows:
1. In the title of the Government Order and in Paragraph 1 (1), the words "2002 'are deleted.
2. in Article 6 (1) (f), the word "Regulation (8)" shall be replaced by "Regulation (8)."
3. In Article 6, the following point (g) is added:
"(g) the construction will be carried out on land outside the territory with a high risk of flood damage; on the site of the original removed object on the property within that territory, it shall be carried out only if the municipality is demonstrably unable to offer another plot of the designated and protected stopping area for the relocation of the installation. '
4. In Paragraph 9 (1), the words "from the operative date until 31 December 2003 'are replaced by the words" within 3 years from the operative date'.
Transitional provision
Legal relations arising under Government Regulation 396 / 2002 Coll., as effective by the date of entry into force of this Regulation and the rights and obligations arising therefrom, shall be governed by existing legislation.
Efficacy
This Regulation shall enter into force on the day of its publication.
