DECLARATION
of 24 September 2012
on the model of application for approval of the Ministry of Finance for the issue of municipal bonds and the content of its annexes
According to Article 45 (1) of Act No. 190 / 2004 Coll., on Bonds, as amended by Act No. 172 / 2012 Coll.:
Model application
The model for the application for approval of the Ministry of Finance for the issue of municipal bonds is set out in the Annex to this Decree.
Annexes to the application and their content
The annexes to the application for approval of the Ministry of Finance for the issue of municipal bonds shall consist of the following documents:
(a) an analysis of the current economic situation of a local authority, an integral part of which is:
1. the financing plan (profile) of the investment, in so far as the purpose referred to in Section 27 (3) (b) (1) of the bond law is concerned,
2. an estimate of the damage in the case of the purpose referred to in Paragraph 27 (3) (b) (2) of the bond law; or
3. the budget of the project and the legal act providing European Union funds, in so far as the purpose referred to in Article 27 (3) (b) (3) of the bond law is concerned,
(b) an overview of the long-term financial obligations of the local authority (e.g. loans, loans, long-term financial assistance, own bonds issued) at the date of the application; for each undertaking, the type of liability, its amount at the time of formation, its date of establishment, its date of maturity, the amount remaining to be paid, the distribution of remaining instalments in each year and the interest burden on the liability,
(c) a budgetary perspective with a view to projecting the repayment or repayment of short-term and long-term liabilities;
(d) an analysis of the projected effects of the issue of municipal bonds on the economic situation of the local authority throughout the period of maturity of the bonds, indicating in particular the expenditure related to the repayment of municipal bonds in each year, broken down into principal instalments and interest;
(e) draft contract for the issue of the issue of municipal bonds;
(f) draft emission conditions;
(g) a resolution by the local authorities on the issue of municipal bonds, the total nominal value of the issue and the purpose of the use of the funds obtained from the issue of bonds, and, where appropriate, the resolution by the local authorities on the discussion of the documents referred to in points (a) to (f);
(h) the last two final accounts of the local authority, including reports on the results of the management review and the resolution of the council on their approval.
Repeal
Decree No. 408 / 2004 Coll., laying down the formalities for the application for approval of the Ministry of Finance for the issue of municipal bonds and annexes thereto, is hereby repealed.
Efficacy
This decree shall take effect on the day of its publication.
