amending Act No. 588 / 2020 Coll., on Replacement Nutrition for an Uninsured Child and amending certain related Acts (Replacement Maintenance Act)
Parliament has decided on this law of the Czech Republic:
In Article 14 (3) (a) of Act No. 588 / 2020 Coll., on Replacement Maintenance for Unprovided Child and on the Amendment of Certain Related Laws (Replacement Maintenance Act), "24 'is replaced by" 48'.
Transitional provisions
1. If the beneficiary has exhausted the 24 payment of the replacement maintenance pursuant to Act No. 588 / 2020 Coll., as effective until the date of entry into force of this Act, the monthly payment of the replacement maintenance during the period from 1 July 2023 until the date of entry into force of this Act shall be paid retroactively, provided that the beneficiary fulfils the conditions for entitlement to the benefit. The monthly payment of the replacement maintenance for the period referred to in the first sentence shall be subject to proof of the amount of the paid maintenance for the period 4 calendar months preceding the calendar month immediately following the calendar month for which the 24th payment of the replacement maintenance pursuant to Act No. 588 / 2020, Coll., was paid. For the purposes of determining the amount of replacement maintenance in the period mentioned in the first sentence, the provisions of Section 4 of Act No. 588 / 2020 Coll., as effective by the date of entry into force of this Act, shall apply mutatis mutandis.
2. The number of payments which the beneficiary has exhausted in accordance with point 1 retroactively during the period from 1 July 2023 until the date of entry into force of this Act shall be counted against the total of 48 payments of replacement maintenance pursuant to Section 14 (3) (a) of Act No. 588 / 2020 Coll., as effective from the date of entry into force of this Act.
3. The number of payments spent by the beneficiary pursuant to Act No. 588 / 2020 Coll., as effective until the date of entry into force of this Act, shall be counted against the total number of 48 payments of replacement maintenance pursuant to § 14 (3) (a) of Act No. 588 / 2020 Coll., as effective from the date of entry into force of the Act.
Efficacy
That law shall take effect on the first day of the calendar month following its publication.
